The CITY OF REDLANDS, hereinafter called "CITY", and REGENTS SQUARE, a general
partnership, their assignees, heirs, and successors in interest, hereinafter called
"REGENTS", do hereby agree as follows:
"REGENTS" is the owner of real property in the City of Redlands, State of
California, described as follows:
Being all land lying between Central Avenue on the North,
Citrus Avenue on the South, Cook Street on the West, and
Grove Street on the East, all as shown on the map of
Tract 7379, including that land labeled "Not a part", as
recorded in Map Book 91, Pages 84 and 85, in the Office
of the County Recorderp County of San Bernardino, State of
California.
Said real property shall hereinafter be called "property".
"REGENTS" agrees to relieve the "CITY" of the responsibility from any and all
damages from the falling of Washingtonia Robusta Palm Trees along the South curb
on the North side of a drainage ditch, located on said property and including
vehicular damage and personal injury. It is recognized that the disturbance of the
roots of said palms during the work of installing of curbs and gutters may tend to
cause some of the palm trees to fall and such condition is subject to this hold
harmless agreement.
"REGENTS" further agrees to hold harmless the "CITY" and any other Public Agency,
or their agents, employees, or contractors, from any damage claims that may be sub-
mitted from any property owners who may be damaged by the trees, and to indemnify
them from such claims.
This agreement shall be recorded with the County Recorderle Office and shall
be binding as a covenant running against the said property and upon all subsequent
owners of the said property.
