Re Extension of FCC Shot-Clock Deadline on AT&T Small Wireless Facility Application

Dear Mayor Foster
With respect to the above referenced application,the federal Telecommunications Act of 1996,47 U S C
§ 332(c)(7)(B)(ii), requires the City of Redlands to take action "within a reasonable period of time"
Federal Communications Commission rules and regulations establish applicable review timeframes
(called "shot clocks")to implement this requirement The FCC has explained that siting authorities must
take action on all approvals and authorizations necessary for deployment within these review
timeframes The reasonable period of time to act may be extended or otherwise defined by mutual
agreement between the City and AT&T AT&T and the City previously agreed to extend the applicable
shot clock for this application Additional time is needed for AT&T to secure authorization from Caltrans
with respect to the site for this small wireless facility Thus, AT&T and the City of Redlands agree to
extend the FCC shot clock deadline for this application to and including December 6, 2019 The parties
further agree that no limitations period for any claim of unreasonable or unlawful delay in processing the
application shall commence to run before December 6,2019
In addition this application is subject to an appeal to City Council AT&T has agreed to a continuance of
that appeal, and for the City to hold that appeal in abeyance, while the City processes the application as
an encroachment permit application
