HomeMy WebLinkAbout8013RESOLUTION NO 8013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING SIGN CONDITIONAL USE PERMIT NO 25 TO CONSTRUCT ONE FREESTANDING SCOREBOARD INCLUDING VIDEO DISPLAY BOARD WITHIN TED RUNNER STADIUM AT THE UNIVERSITY OF REDLANDS, LOCATED AT 1215 EAST BROCKTON AVENUE WHEREAS, the University of Redlands has submitted an application for Sign Conditional Use Perrnit No 25 to construct a freestanding scoreboard sign with LED display board at the easterly interior side of Ted Runner Stadium located on the University of Redlands campus The sign face will be approximately 38 feet high by 33 6 feet wide (including scoreboard, timers, LED video display board, sponsor signs, and speakeis), and 48 feet to top of structure The project site is located at 1215 East Brockton Avenue (APN 1212-431-02-0000) in the Educational (E) District, and WHEREAS, the Planning Commission held a duly noticed public hearing on July 23, 2019, to consider the staff report and testimony m support of, or opposition to, the proposed project and considered Sign Conditional Use Permit No 25, and WHEREAS, on July 23, 2019, the Planning Commission unanimously adopted a resolution recommending the City Council approve Sign Conditional Use Permit No 25, and WHEREAS, on July 26, 2019, the City Clerk caused a public notice to be published in a newspaper of general circulation in the city, and WHEREAS, on or about July 24, 2019, written notice of the City Council's public hearing for the Project Entitlements was mailed via U S Mail to property owners within a 300 -foot radius of the project site, and WHEREAS, on August 6, 2019, the City Council of the City of Redlands held a duly noticed public hearing to consider the recommendation of the Planning Commission, and WHEREAS, following the public hearing for the Project Entitlements, the City Council determined that approval of the proposed project will be consistent with the best interests of the public health, safety, and general welfare NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION 1 Findings for Approval of a Sign Conditional Use Permit Sign Conditional Use Permit No 25 is hereby approved based upon the following findings 1) The size of the sign is compatible with the design, al chitectui e, and scale of the building(s) and/oi project 1 1 \Resolutions\Res 8000-8099\8013 Application for Sign Conditional Use Permit No 25 docx The proposed design and scale of the scoreboard and mtegral video display board will be compatible with the design, architecture, and scale of the existmg stadium facility (to include spectator seating areas on both sides of the field and the press box) The sign manufacturer (Daktronics) is a leading producer of sports products for professional, collegiate, high school, and civic athletic facilities, and has designed the proposed sign appropriately for Ted Runner Stadium 2) The size of the sign is aesthetically consistent with the project, adjacent areas, and the city The proposed size of the scoreboard and integral video display board will be aesthetically consistent with the height and scale of the existing stadium facility including the press box and top of the spectator seating The proposed sign will be consistent with surrounding University athletic facilities such as the Thompson Aquatic Center (to the south of the stadium) and the practice fields (to the east of the stadium) The proposed sign will not be significantly visible from areas surrounding the stadium, and will not otherwise result m any inconsistencies with adjacent areas or the city 3) The size of the sign is needed to provide necessary project identity for the benefit of the general public The proposed sign is needed to serve the existing athletic events and other events that typically occur within Ted Runner Stadium, and will only be utilized during official contests or events (the scoreboard and video display will not otherwise be lit or utilized at any other times) The sign is needed to provide necessary information to spectators within the stadium only, is necessary for project identity for Ted Runner Stadium, and the sign will not be utilized for off- site commercial advertising SECTION 2 Project Approval Sign Conditional Use Pernut No 25 is hereby approved, subject to the Conditions of Approval contained m Exhibit "A" attached hereto SECTION 3 Effective Date This Resolution shall become effective upon adoption ADOPTED, SIGNED AND APPROVED this 6th day of August, 2019 ATTEST e Donaldson, City Clerk construction of one freestanding scoreboard sign with LED video display board with internal illumination at the easterly interior side of Ted Runner Stadium located on the University of Redlands campus The freestanding sign has a sign face 38 feet high by 33 6 feet wide (to include scoreboard, game timing devices, sponsor panels, and one LED display screen with internal illumination), and a maximum height of 48 feet to top of structure The project site is located at 1215 East Brockton Avenue (APN 1212-431-02-0000) in the Educational (E) District 2 This Sign Conditional Use Permit shall automatically expire two (2) years from the date of City Council approval unless Developer has diligently developed the proposed project, as shown by the application for a building permit, or has obtained an extension of tune in accordance with the Redlands Municipal Code 3 The issuance of any permits shall comply with all provisions of the Redlands California Municipal Code currently in effect 4 All plans submitted to the City shall be m substantial conformance to the Planning Commission/City Council approval and any other changes required by the Planning Commission/City Council The apphcant shall not make any modifications or changes during construction that are in conflict or contrary to the sign's approved design or location without first consulting with the Development Services Director or designee 5 Pursuant to Govenunent Code Section 66020(d), certain fees, dedications, reservations or exactions unposed by the City as a condition of approval of this project are subject to a statutory ninety (90) day protest period Please be advised that the ninety (90) day protest period foi those fees, dedications, reservations and exactions which are subject to Government Code Section 66020(a) has commenced to run on the date this project was approved by the City 6 The applicant for this permit, and its successors and assigns, shall defend, indemnify and hold harmless the City of Redlands, and its elected officials, officers, agents and employees, from and against any and all claims, actions, and proceedings to attack, set aside, void or annul the approval of this permit by the City, or brought against the City due to acts or omissions in any way connected to the applicant's project that is the subject of this permit This mdeinnification shall include, but not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions or proceedings, mcludmg damages for the injury to property or persons, including death of a person, and any award of attorneys' fees In the event any such action is commenced to attack, set aside, void or annul all, or any, provisions of this permit, or is commenced for any other reason against the City for acts or omissions relating to the applicant's project, within fourteen (14) City business days of the same, the apphcant shall file with the City a performance bond or irrevocable letter of credit performance of its defense and indemnity obligations under this condition The failure of the applicant to provide the Security shall be deemed an express acknowledgement and agreement by the applicant that the City shall have the authority and right, without objection by the applicant, to revoke all entitlements granted for the project pursuant to this permit The City shall have no liability to the applicant for the exercise of City's right to revoke this permit 7 Prior to building permit issuance, the Applicant shall pay all applicable permit fees and any other outstanding fees 5 1
