Merritt, Jr. City Manager City Hall Redlands, California Dear Mr. Merritt: 350 WEST 5TII STREET, SUITE 208 SAN BERNARI)IN0, CALWORNIA 92401 Re: Proposed Redevelopment Agency City of Redlands Redlands, California Pursuant to your request, I am submitting to you time and charges to make an appraisal of approximately 26 ownerships (41 Assessor's parcel numbers) located in an area surrounded by Redlands Boulevard, Orange Street, West Citrus Avenue, and South Eureka Street, in the City of Redlands. The cost to prepare an appraisal report covering the 26 ownerships will be in the amount of $20,000.00. This office is in the position to start on this assignment immediately after acceptance of the contract and completing said assign- ment within 120 days. In the event that the City of Redlands has acquired market data, lease data, etc., through the efforts of the American Appraisal Company in their feasibility report, the above mentioned fee will be renegotiated, depending upon the data furnished by the City. The appraisal report will be used for negotiation purposes and, in the event there is a condemnation filed, any addition- al research, pre-trial conferences, and court appearances, then my services will be based on a rate of $150.00 per diem. The appraisal report will cover land and improvements for each parcel assigned. The report will include market data and improvements, lease data, an economic study of the neighborhood, highest and best use data, photographs, maps, and other pertinent data used in estimating the present Fair Market Value of the properties appraised. it is understood that all the appraisals will be contained in one volume and that no preliminary values will be submitted on any of the properties. Hastings Engaged in general real estate appraisal practice with office at 350 West Fifth Street, Suite 208, San Bernardino, California 92401. 1959 to 1953 - Independent appraiser associated with Albert L. Johnson, M.A.I. 1954 to 1959 - Independent appraiser associated with W.A. Savage, M.A.I., and Albert L. Johnson, M.A.I. 1949 to 1954 - Employed by the County of San Bernardino as appraiser in the office of the County Assessor. Also, part time employment as appraiser. 1947 to 1949 - Employed by Bank of America, Base Line Branch, as a teller. Real estate business in San Bernardino for period of about one year. Have appeared as witness on real property values in the Superior Courts of the State of California in and for the Counties of San Bernardino, Riverside and Orange, and in the Eighth Judicial District Court of the State of Nevada in and for the County of Clark. Appraisal experience has included agricultural land, residences, residential lots, subdivisions, commercial, industrial and all types of acreage and desert lands. Have appraised easements, rights of way and partial takings. DeM.irjyn, 'Vice Mayor This special meeting of the City Council was necessitated by the lack of agreement on appointment of an appraiser for the Redevelopment Area, In calling the meeting to order, Mayor Cummings explained that in the personnel session held following the last special meeting, Council received the detailed reasons for City Manager Merritt's recommendation of Mr. Ray R. Hastings as appraiser. Mr. Cummings added that each Appraiser Councilman had received by messenger last evening presentations from Don D. Morrison, Edward G. Hill, Jr., Redevelop- meat Area and Ray R. Hastings. City Manager Merritt stated that the recommendation remained as originally presented, Council again discussed qualifications briefly. City Attorney Taylor entered the chambers at this time, Councilman Sewall stated that he had four questions to ask Mr. Knudsen, not intended to be "unfriendly" but to avoid problems 1. "I believe Councilman Knudsen is a realtor by profession "No, :licensed Real .Estate Broker". 2. "Have ycu, had .formally, or informally, business dealings with either of the two men you recommend?" "Yes, extensively, and have attended courses given by Don Morrison. Have sat in on hearings and meetings; and know how thorough they are in business. However, not in the last three years since they dissolved Partnership." Page one - October 26, 1972 30 "Do you or any member of your family own prop- erty in the Redevelopment Area?06 '-Yes, I am a member of a corporation which owns a parcel of lard in this area." Council concurred that having made known an existing in- terest, a member of the City staff, a Commission or the Council was then free to vote on a matter under consid- eration. 4. "There is no other property owned by you or members of your family in the six -block area?" "'No, 9D Mayor Cummings then asked: '-Have you had business deal- ings with Hastings?" Answering, Mr. Knudsen said: "Not directly, some tangentially." Stating that he believed the City Manager had studied the matter of qualified appraisers very, well, Council- man Sewall moved that Council accept the recommendation and approve Mr. Ray R. Hastings for this service. Motion was seconded by Councilman Miller and approved by AYE votes of all present., Mr. Knudsen stated that it was well that these questions were asked and that he was not embarrassed by theme He suggested that if "back-up" work were needed, the other men be used® On motion of Councilman Knudsen, seconded by Councilman Grant Deed Miller, the City Manager was authorized to execute the 11 Grant certificate of acceptance in behalf of the City for the Street grant deed on the property at 11 Grant Street. Purchase of this property was authorized at the meeting of Sept.. 19, 1972. Motion carried by AYE votes of all present. This concluded the business scheduled for this time and place. Council discussed other matters informally. Council adjourned on motion at 7:55 A.M. Moseley, City Clerk Erwin So Hein, Redlands Daily Facts Chuck Palmer, San Bernardino Sun ABSENT None This Special Meeting of the City Council was called for the following; la Consideration of interim Environmental Review Procedures 20 Amend Resolution No. 2951 Amend Resolution No. 2980 3, Downtown Redevelopment Contractual Requirements 4� Adopt Resolution No. 2996 - Authorizing Filing for State Payment under Open Space Subvention Act City Attorney Taylor briefly explained the recent deci- sion of the California Supreme Court in relation to environmental conservation. He then presented an Interim Resolution Environmental Review Procedure w3iich if adopted by the No. 2995 City Council will assure compliance by the city with the California Environmental Quality Act of 1970 (specifi- Environmental cally Sec. 21151 of the California Public Resources Code) Review Procedure Following lengthy discussion and explanation and answers from Planning Director Schindler, on motion of Council man Miller, seconded by Councilman Sewall, Resolution No. 2995, a resolution of the City Council establishing Interim Environmental Review Procedure, was unanimously adopted by the City Council. City Attorney Taylor presented Resolution No. 2994, which Resolution sets the time for the continuation of the Public Hearing No, 2994 on Resolution No. 2951 - Pedestrian Mall - for February Pedestrian 6, 1973 Following discussion, on motion of Councilman Mall Miller, seconded by Councilman De-?4i.rjyn, Resolution No. 2994 was unanimously adopted. Page one October 24, 1972 City Manager Merritt explained that under the agreement with the Howard E. Connor Consortium, the City has the responsibility of arranging for the appraisal of the six -block area in the redevelopment agreement® Mr. Merritt presented the name of Ray Hastings of San Bernardino, stating that he was fully qualified, highly respected in his field and available to perform this service. Following discussion, during which Councilman Knudsen mentioned the names of Don Morrison and Edward Hill, Council moved to table the matter to the next meeting. Property The motion failed by the following roll call vote: Appraisal AYES: Councilmen DeMirjyn, Knudsen NOES: Councilman Sewall, Mayor Cummings ABSTAIN: Councilman Miller Council resumed discussion of this matter. City Manager Merritt stressed that he had researched the field thoroughly, and pointed out the advantage of Mr. Hastings' availability. Council then concurred in having a personnel session to consider this matter at 4:00 P.M. this date, and setting an adjourned special meeting for 7.30 A.M. on October 26. Resolution On motion of Councilman Sewall, seconded by Councilman No. 2996 Miller, Resolution No. 2996, a resolution of the City Open Space Council authorizing the filing for State of California Subvention Payment under the Open Space Subvention Act, was Act unanimously adopted, with the City Manager authorized to sign the application® There being no further business scheduled for this meeting, on motion the Council adjourned to a special adjourned meeting to be held October 26, 1972 at 7:30 AaMo Next regular meeting, November 7, 1972a Respectfully submitted, Ci er7� Page two October 24, 1972
