SANTA ANA RIVER AT ALABAMA STREET
THIS AGREEMENT, made and entered into this _2 day of
1973, by and between the SAN BERNARDINO COUNTY
FL OD CON OL DISTRICT, a body corporate and politic of the State of
California, hereinafter referred to as "DISTRICT" and the CITY OF
REDLANDS, a municipal corporation of the State of California, herein-
after referred to as "CITY".
W I T N E S S E T H
WHEREAS, DISTRICT's Zone 3 has budgeted funds for construction
-of a levee and revetment along the south bank of the Santa Ana River
-between Alabama Street and Tennessee Street in the current fiscal
year; and
WHEREAS, CITY is planning to construct sewage effluent ponds
at this location for the purpose of spreading sewage effluent to recharge
the underground basin and is agreeable to the inclusion of District's
levees and revetment work in the construction contract; and
WHEREAS, it is the mutual interest of both DISTRICT and CITY to
have CITY construct the levee and revetment as a part of the construction
of its spreading ponds.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
I. CITY SHALL:
1. Construct the levee and revetment between -Alabama Street and
Tennessee Street in accordance with plans and specifications
approved in advance by DISTRICT's Flood Control Engineer.

2. Indemnify DISTRICT, its officers, agents, and employees
against and hold them free of'and harmless from all claims and
liabilities of any kind arising out of, in connection with, or
resulting from acts or omissions or negligence on the part of
CITY, its officers, agents, contractors or employees in construct-
ion of the levee and revetment and ponds, and maintenance of ponds.
3. Pay any cost over and above the amount set forth in Item II-1
below.
4. Refund to DISTRICT any balance, should th-e. cost of the levee
and revetment be less than the amount set forth in Item II-1.
S. Furnish to DISTRICT a copy of the tabulation of contract bids
for the work upon receipt of bids, and furnish "as constructed"
drawings upon completion of the work.
II. DISTRICT SHALL:
1. Pay to CITY the sum of $38,000, upon receipt and approval of
CITY's construction plans and specifications.
IN WITNESS WHEREOF, the parties hereto have caused this agreement
to be executed by their respective officials thereunto duly authorized.

Mood Control Engineer 11. A.' Sidler presents to the Board for their
approval Participation agreement by . and between the San Bernardino
County*Flood Control District and the City of Redlands in connection
with the construction -of levee and revetment on the south sine of
the Santa Ana River between Alabama Street and Tennessee Street
necessary for the Zone 3, Santa Ana River project. Mr. Si.dler states
that the City of Redlands proposes to construct sewage effluent ponds
at this location and they are willing to include the levee and revetment
work in this pr.oject._p
Whereupon, on motion by Supervisor Mi.kesell, duly seconded by
Supervisor Fansberger, and carried, the Board of Supervisors hereby
approves said Participation Agreement dated January 22, 1973 and
authorizes its Chairman to sign said agreement, indicating this Board's
approval of the terms and conditions therein contained.
