CONTRACT FOR M11 LEAF BEETLE SPRAYING This Agreement made and entered into this 27th day of July, 1973 s by and between the City of Redlands, a municipal corporation of the State of California, hereafter called "City", and the J. Harold Mitchell Co. address . �05 Agostino_Road2 San Gabriel California 91776 , hereafter called "Contractor". The City and Contractor agree as follows: 1. The Contractor shall furnish and apply Sevin spray (#1 actual per 100 gal. of grater) to all designated elm trees at various locations, for the lump sum price of S.09 per gallon. 2. The City to furnish one man to accompany rig or rigs to notify residents and secure permission of the occupants, keep records of properties sprayed and gallonage applied, etc. 3. The City to furnish all water at the nearest fire hydrant at no charge to the Contractor. 4. The Contractor to secure a business license, approval from the fire department of approved tools to use at the hydrants, and provide an approved air gap pipe to load all spray equipment tanks. j. The Contractor to provide a Certificate of Insurance to the City -before commencing work on the starting day of on or around July 319 1973. 6. The Contractor to complete all work on or before August 309 19739 work to be performed to the requirements and satisfaction of the County of San Bernardino Department of Agriculture and the City of Redlands Park Department personnel assigned to the job. 7. Payment to be made by the City to the Contractor within 30 days after completion of the job. S. The Contractor will confine his equipment to City rights of way whenever and wherever possible. 9. The Contractor shall provide and maintain adequate Norkmen's Compensation Insurance for all work performed under this contract. Merritt, Jr., City Manager SUBJECT: Elm Tree Leaf Beetle Spray Program At the time of the Council meeting when the above matter was considered, we had received four quotations for tree spraying. The low quotation was that of the Phelps Spray Service of Redlands at a figure of .08<- per gallon sprayed. Apparently, Mr. Phelps did not recognize his responsibilities to the City for this service and that he would be required to be responsible for any damage caused by his sub -contractor on private or public property. He has, therefore, withdrawn his bid and requested that he be released. Consequently, we are awarding the contract to the next lowest quotation which is that of J. Harold Mitchell Company of San Gabriel at a price of .09� per gallon. The Mitchell firm is well qualified to do the work. R. RPM:my cc: J. Miller, Councilman PUBLIC HEARING Resolution No. 3023 - Downtown Mall Project - Continuation Public hearing on the Downtown Mall Project was continued to this meeting from the meeting of July 17, 1973. Mayor Cummings declared the meeting open as a continuation of the public hearing for any comments or questions concerning this project. No comments were forthcoming. City Attorney Taylor reported that the case remains under consideration in Superior Court in San Bernardino. Judge Katz states that he considers this an important case and wishes to review all the evidence received over a three- month period. He gave no indication of the date at which he will make a determination. The public hearing was continued to the Council meeting of September 4, 1973. UNFINISHED BUSINESS The request for closure of Fifth Street for the purpose of a Camp Fire Girls Fair was tabled to this time. Mr. Street Merritt recommended that approval be given .for the Closure closure of Fifth Street on September 110, 1973 between the hours of 10:00 A.M. and 2000 P.M. as all departments have Fifth approved the application. The property owners in the Street downtown division do request that the alley be kept open east and west across Fifth Street, Following brief discussion on motion of Councilman Knudsen., seconded by Councilman Sewall, approval for the closure of Fifth Street as described by the City Manager, subject to the requirements of all departments, with the alley being kept open east and west, was approved by AYE votes of all present. Page one - July 24, 1973 CITY MANAGER City Manager Merritt briefly described the present infestation of elm trees in Redlands by the Elm Deaf Beetle, stated that the infestation was discovered only within the last week, and presented the recommendation Elm Tree of Mr, Gene Ma Harper, Assistant Agricultural Commissioner Control for the County of San Bernardino, The recommendation Program is for two spraying programs, one to be completed not later than August 30, 1973, and the other to be started on June 1, 1974. The estimated cost for this service is $20,000, with the lowest quotation of five received being Phelps Spray Service. City Manager Merritt urged authorization of this program immediately, with the funds to be taken from Park Surplus, Council discussed this problem at length. Park Director MacKenzie explained that the desert communities have been fighting this beetle for twelve years, but it is also existing now in Hemet and Riverside, it was further explained that all trees within the City will be treated and that this is necessary in order to stop the infestation, Noting that this was being done for the health, safety and welfare, on motion of Councilman DeMirjyn, seconded by Councilman Knudsen, the recommendation was approved as made by Mr, Merritt, by AYE votes of all present. Bid Call on motion of Councilman Knudsen., seconded by Councilman DeMirjyn, the City Clerk was authorized to advertise for Disposal bids on two 20 cubic yard disposal trucks, by AYE votes Trucks of all present. This is a budgeted item, Mayor Cummings brought notice that the Citrus Belt Firemen's Association were planning to hold a high -wire act at Chaffey College on. August 21, 1973, and requested waiver of business license in order to sell tickets for the event. This request was received at L1o00 AaM. this date® Council discussed the matter at length and requested further information, However, no one was in attendance at the meeting to give additional explanation. Following lengthy discussion of this matter and other requests for waiver of business license, it was deter- mined, on motion of Councilman Knudsen, seconded by Councilman, DeMirjyn, to approve this one request at this time, by AYE votes of all present, The staff was requested to put this matter of waiver of business Licenses on the agenda for a future meeting with possible recommendations for guidelines for waiving business ,licenses, Page two -- July 24, 1973
