TO AGREEMENT DATED DECEMBER 19, 1995
BETWEEN THE CITY OF REDLANDS AND
TOM DODSON & ASSOCIATES
TASK ORDER 4a
ENVIRONMENTAL SERVICES
This amendment authorizes the Consultant to perform services as defined in Attachment I - Task 4a,
in accordance with the Agreement dated December 19, 1995, for environmental services in connection
with the California Street Landfill.
This Amendment makes the following changes to the Agreement;all other provisions of the Agreement
remain in effect.
Section I.,Engagement of Consultant
The Scope of Tasks is amended to include Attachment 1, which defines the scope of work for
environmental services associated with the California Street Landfill.
Section 2. Responsibilities.,of the City
No Changes.
Section 3, Period of Service
The time period for performance of the Consultant's services under this Amendment is set forth
in Attachment 1.
Section 4. Payments to Consultant
The total compensation to perform work under this Amendment shall be in accordance with
Attachment I.
Section 5. Insurance and Indemnification
No Changes.
Section 6. Attorneys'.,Fees

Re: Focused Santa Ana River Woollystar(Woollystar) and Slender-homed
Spineflower(Spineflower) survey, California Street storm drain-
Deaf Ms. Shatynski,
As we discussed yesterday,the U.S. Fish and Wildlife Service(USFWS) and the U.S. Army Corps
of Engineers (Corps) has agreed to accept the results of a Woollystar and Spineflower survey
performed at this time of year. This means that rather than waiting until late spring or early summer
to determine their presence or absence, we will know immediately if they occur onsite. This is
important because a project is not authorized under a Nationwide Permit if it affects a listed species.
Based on our previous work in the area,we do not feel these plants occur in the area of the proposed
outlet structure. Confirmation of that at this time will allow this project to proceed under a
Nationwide Permit rather than waiting until summer to make that determination.
Should these plant species be found, it will be necessary to initiate consultation with the USFW S.
Tins consultation can take up to i Sia days to complete and could affect your schedule for constructing
the pipeline. TDA,therefore,recommends that we perform the survey at this time. If the plants are
found, consultations can be completed in time for the City to construct the project on schedule.
Our present contract on this project, Amendment No. 1 to the TDA Master Agreement does not
include this biotic survey. It is identified as a fixture task. TDA recommends that Amendment
No. 1 be revised to include the following scope of services a this time:
TDA will perform a focused WoollystarlSpineflower survey that includes a general biological
evaluation ofthe site. TDA will prepare a report of the findings of this survey. Based on the results
of this biological evaluation, TDA will make recommendations to the City on what we feel is the
appropriate course of action to secure regulatory permitting of the project. At this time, we feel it
will be authorized under: a Nationwide Permit. TDA will perform the above scope of services for
a fee of$1,000.00.
