Acting on the recommendation of the Law & Justice Agency Administrator,
on motion by Supervisor Hansberger, duly seconded by Supervisor Kamansky
and carried, the Board of Supervisors hereby approves Amendment #1 to
Agreement =76-734 between the County, through the Sheriff's Department
and the City of Redlands providing for an adjustment in the ann,ial
contract fee for fiscal year 1977/78 for helicopter patrol services ,
further, the Board authorizes the Chairman to sign said amendment ,
inaicating this Board's approval of the terms and conditions therein
contained.

APPLICATIONS AND PETITIONS
The request of the Redlands Council of the Art for per-
mission to hold the Mexican-American portion of the
Redlands Celebration of the Arts in the Redlands Bowl on Sunday,
Council of July 10, 1977, with waivei of bowl fees, permission to
the Art sell food and beverage, and a waiver of business license
fees for the sale were approved on motion of Councilman
Miller, seconded by Councilman Elliott, by AYE votes of
all present.
The request of the Redlands Theatre Festival foi permis-
sion to use the theatre site in Prospect Park for Monday,
Redlands June 20 through August 22, 1977, permission to sell
Theatre beverages during their performances . and traJ ver of the
FcstLval business license fees for such sale was approved on
motion of Councilman Knudsen, seconded by Councilman
Miller, by AYE votes of all present.
COMMU;a COTTONS
Appointments - Airport Advisory Board On motion of
Councilman Knudsen, seconded by Councilman Miller, Mr
Dudley Ketcheiside was appointed to the Airport Advisory
Appointment Board to replace Mr Joseph Stuart who resigned recently.
Letters of appreciation to Mr Stuart for his service
and one informing Mr KeLcherside of his appointment will
be sent over the Mayor ' s signature.
Council briefly discussed the problem of badly torn -up
streets resulting from development which cause traffic
hazards and inconvenience for residents in areas of new
home construction, and referred particularly to l.he area
at Terracina Boulevard and Cypress Avenue Mr. Shefchik
explained that a contractor has within 60 days from the
issuing of the license to complete street work Council
discussed the possibility of requiring a cash deposit,
setting up a time frame, and assuring proper consideration
for the residents The matter was referred to staff Ear
recommendation .
NEW BUSINESS
On motion of Councilman Elliott, seconded by Councilman
Miller, Resolution No 3365, a resolution of the City
Resolution of Redlands amending Salary Resolution No . 3360 and
realigning of Park Department salary structure was
No. 3365 approved By the same motion, a temporary, rotating
Salary position in the Police Department was approved to be
handled administratively

CITY MANAGER
Acting City Manager Archbold presented a contract between
Lynn McEuen and the City of Redlands for consultant
services at the Joslyn Senior Center. On motion of
Joslyn Councilman Miller, seconded by Councilman Knudsen, the
Senior Center contract was approved with the City Manager authorized
Consultant to sign in behalf of the City. Terms of the contract
Contract shall be from July 1, 1977, to June 2, 1978 ; contractor
shall pay $9 00 per hour for 768 hours of work totaling
$6, 912 .00 payable semi-annually for the period of this
contract
Mr Archbold presented an agreement for loan and repayment
between the City and the Redevelopment Agency to provide
the Agency with adequate cash flow and requested •authori-
zation for the Mayor to sign the agreement in behalf of
the City and the Agency

Loan Mr Archbold stated that the maximum amount would not

Acting City Manager presented a request from Chief
Brickley for Council approval of a contract for the
Sheriff ' s helicopter services for fiscal year 1977-78
Helicopter between the City of Redlands and the County of San
Services Bernardino Chief Brickley also asked that the Mayor be

of $25, 330 37 On motion of Councilman Miller, seconded
by Councilman Knudsen, the agreement was approved as
described by AYE votes of all present
The Underground Utilities Advisory Committee of the City
of Redlands recommended that the City establish Under-
ground Utilities District No 5 in the vicinity of the
San Bernardino County Museum in conjunction with the
County of San Bernardino On motion of Councilman Miller,
Underground seconded by Councilman Knudsen, approval of this recom-
Utilities mendation and authorization to hold a public hearing on
District July 5, 1977, was given following the assurance by Mr
No . 5 Shefchik that the City of Redlands ' Rules-20 funds will
not be involved in this underground district. This
motion was approved by AYE votes of all present The
public hearing will be held in the Council Chambers at
7 :00 P M on Tuesday, July 5, 1977 .

IT IS HEREBY AGREED AS FOLLOWS

IITSEAS, City and County desire to provide by contract for performance of law
enforcement helicopter patrol services within the territorial boundaries of the City,
effective on July 1, 1976,
All, THEREFORE, IT IS AGREED AS FOIE. "S:
Comity shall provide, through the Sheriff of San Bernardino County (hereinafter
referred to as Sheriff) law enforcerent helicopter patrol within the corporate 1 it 4 to of
City as the same now exist, or as such lints ney be modified by annexation or exclusion
during the terns of this att ee-marit, to the extent aad on the terus and conditions herein-
after set out.
II.
The helicopter services to be provided by Co my and furnished to City here-
under shall include:
A. The helicopter will patrol and respond to calls for service.
B. The Sheriff will maintain a twenty-four (24) hour standby service
for calls which occur during unscheduled flight shifts.
C. The Sheriff shall provide disks to the City Police Departaent for
dissemination to vacationers.
III.
The services to be provided by County hereunder shall also include all equi ent
(including repairs thereto or depreciation thereon) , supplies, ccmursications, services,

administration, labor, insurance, losses, vacation and sick leave, any
retirement contributions, gasoline, oil and all other services, obligations
or expenditures necessary or incidental to the performance of the duties to
be performed by Sheriff under the terms of this agreement
IV
In full and complete consideration for County's furnishing and
performance of all services provided for herein (including all expenditures
in or related to the furnishing of such services) , City shall pay to County
the sun as determined in attached Exhibit "A" Exhibit "A" also includes
scheduled payments of said sum which City shall pay accordingly. County
shall have the right to renegotiate the said rate at the end of each fiscal
year for the ensuing fiscal year, and said rate may be adjusted upward or
downward to reflect the actual average cost for helicopter patrol services.
Otherwise than is stated in this paragraph, supra, City shall not
be obligated to pay, and assumes no liability for, any cost, expenditure,
charge, salary or liability whatsoever incurred by County in or related to
the performance of the provisions of this agreement by County City shall
not be liable for compensation or indemnity to any County employee for
injury or sickness arising out of his or her employment while engaged in the
performance of this agreement by County

The term of this contract shall be a period of time commencing at
July 1, 1976, and terminating only as hereafter provided This agreement
may be terminated at any time with or without cause by City or by County
upon written notice given to the other at least ninety (90) days before the
date specified for such termination Any such termination date shall
coincide with the end of a calendar month. In the event of such termination
each party shall fully pay and discharge all obligations in favor of the
other accruing prior to the date of such termination and each party shall be
released from all obligations or performance which wiould otherwise accrue
subsequent to the date of such termination Neither party shall incur any
liability to the other by reason of such termination

in writing by registered or certified mail, postage prepaid. The addresses

The standards of performance, the method of performance, the disci-
pline of officers, the control of personnel, the advancement of compensation
of personnel, the determination of practices and procedures and all other
matters incidental to the manner of performance of services by the Sheriff
hereunder shall be determined by the Sheriff in his sole discretion

All persons directly or indirectly -usloyed by County in the
performance of the services and functions to be provided to City hereunder,
shall be employees of County.

Acting on the recommendation of the Law and Justice Agency Administrator,
on motion by Supervisor Townsend, duly seconded by Supervisor Smith and
carried, the Board of Supervisors approves agreement #--76--734 between the
County through the Sheriff' s Department and the City of Redlands , for
provision of general hell, opter patrol services within the incorporated
limits of the City of Redlands; further the Board authorizes the Chairman
to sign said agreement indicating this Board's approval of the terms
and conditions therein contained.

NEW BUSINESS (Continued)
Ordinance Ordinance No. 1580, an ordinance amending the Redlands Ordi-
No. 1580 nance Code as relates to the position of City Manager, was
City given first reading of the title and laid over under the
Manager rules, with second reading set for November 2, 1976 at 7:00
P.M.
Ordinance Ordinance No, 1595, an ordinance regulating discharge of
No. 1595 wastes into the sewerage system as required by the Santa
Ana Regional Water Quality Control Board, was given first
Regulating reading of the title and laid over under the rules, with
Discharge second reading set for November 2, 1976 at 7-00 P.M. The
Di Wastes ordinance was discussed at length by Mr. Knudsen with Mr.
ofinto Sewer Ray Greeley. Mr. Shefchik explained the Board ' s restric-
System tions imposed on the City of Redlands.
Resolution Resolution No. 3293, a resolution of the City of Redlands
No. 3293 authorizing execution of a right-of-way certificate for
the Garden Street drain project, was adopted on motion of
Garden St, Councilman Miller, seconded by Councilman Elliott, by AYE
Drain votes of all present.
Resolution Resolution No, 3294, a resolution of the City of Redlands
No. 3294 declaring surplus and authorizing the sale of a structure
on property at the southwest corner of Olive Avenue and San
Structure Mateo Street, was approved by AYE votes of all present, on
Sale motion of Councilman Miller, seconded by Councilman Knudsen.
CITY MANAGER
An additional appropriation from Revenue Sharing Funds in
Funds the amount of $9,440 for payment for the properties for
Senior construction of the Joslyn Senior Center was approved on
Center motion of Councilman Knudsen, seconded by Councilman Miller.
This monetary appropriation in the 1975-76 budget failed to
be re-encumbered in the 1976-77 budget.
Funds An additional appropriation from Revenue Sharing Funds in
the amount of $1,850 for payment for a police transmitter
Police was approved on motion of Councilman Knudsen, seconded by
Transmitter Councilman Elliott. These funds were expended in the 1976-
77 budget, but failed to be re-encumbered from the 1975-76
budget.
Council approved the submittal of applications for four
Public projects under the Public Works Employment Act by the fol.-
Works lowing motion by Councilman Miller:
Employment
Act "I move approval for the filing of applications under the
Public Works Employment Act, including assurances and
certification that the City as applicant shall comply with
the regulations, policies, guidelines and requirements, in-
cluding Office of Management and Budget Circular A-95 and

"Federal Management Circular 74-4 and 74-7, as they relate
to the application, acceptance and use of Federal funds
for this federally assisted project, and that Mr. W. C.
Schindler, Community Development Director, is identified
as the official representative of the City, for the fol-
lowing projects:
"1. Construction of trunk sewer - Mountain View, San
Bernardino and Lugonia Avenues.
"2. Sewers for certain existing developed areas.
"3. Construction of water main from Fifth and King to
Redlands Boulevard and Ford Street.
"4. Construction of a Shakespeare Theater - Prospect Park. "
This motion was seconded by Councilman Knudsen and carried
by AYE votes of all present.
Outside-City The request of Mr. Frank Lee of 26947 West Redlands Boule-
Water yard for increase in water meter size from. 3/4" to 1-1/2"
Service was approved on motion of Councilman Knudsen, seconded by
Councilman Elliott.
On motion of Councilman Miller, seconded by Councilman
Helicopter Elliott, the Mayor was authorized to sign an agreement with
Patrol� the County of San Bernardino for law enforcement helicopter
---�"` patrol services, the contract to start July 1, 1976.
Bills and salaries were ordered paid as approved by the
Finance Committee.
There being no further business, the Council adjourned,
on motion, at 8:30 P.M. , to an adjourned meeting at 2-00
P.M. on October 26, 1976.
