THIS COVENANT, dated the 22nd day of June 19_77:
is made and entered by and between THE CITY OF REDLANDS, hereinafter
called "CITY" and Cecil J. Dunithan and Bernice Dunithan, husband and wife
as joint tenants
hereinafter called "OWNER" as a covenant Running With The Land,
Recitals
1. Owner owns the real property situate in the County of San
Bernardino, State of California, described on Exhibit A attached hereto,
and incorporated as a part of this covenant, and hereinafter referred
to as "property".
2, Owner desires to obtain a domestic family dwelling water/sewer
connection to the Redlands Domestic Water System/Sewerage System.
FOR AND IN ODNSIDERATION of the covenant contained herein the City
and the Owner agree as follows;
1. That Owner may make a connection to the Redlands Domestic
Water System/Sewerage System for a domestic family dwelling subject to
the terms, conditions, and requirements of all ordinances, resolutions,

rules, and rates adopted by the City, and performance by Owner of the

covenants herein.®
2. That Owner shall annex property to the City of Redlands no
later than 120 days after the City makes a written request for such
annexation by personal delivery to Owner or by registered letter,
deposited at a United States post Office, bearing the following address:
Owner: Cecil J. Dunithan and Bernice Dunithan
Address: 2394 Mill Creek Road, Mentone, CA 92359
3. That Owner shall be charged and pay twice the water/sewer
rates established by City ordinance or resolution for service to
properties situate outside City upon Owner's failure to consent to
annexation of property no later than 120 days after the request to do
so. The rates which shall be doubled in the event of Owner's refusal

to annex shall be the outside rates in effect on the 121st day after
the City°s request for annexation.
4. That this covenant shall be recorded in the office of the
County Recorder of San Bernardino County, a covenant running with
the land described herein, which covenant shall obligate and be
binding upon Owner, his assigns, transferees, executors, trustees,
and every other successor in interest.

EXHIBIT "A"
That portion of Lot 3, Block 23, Stretch's Map of Mentone, as per plat
recorded in Book 8 of Maps, Page 81, records of San Bernardino County,
described as follows: ,
Commencing at a point on the east Line of said Lot 3, 147 feet north of
the southeast corner of said Lot 3; thence west parallel with the south
line of said lot, 166 feet to a point in the east line of the property
conveyed to Martin C. Whitmer and wife, by deed recorded February 17,
1947, as Instrument No. 23, in Book 2042, Page 68, Official Records;
thence north along the east line of said Whitmer property 53 feet to
the northeast corner thereof; thence west along the north line of
said Whitmer property 96 feet to the northeast corner of Parcel No. 1
of the property conveyed to Rolla F. Bremner and wife, by deed recorded
October 27, 1947, in Book 2091, Page 362, Official Records, said point
also being the true point of beginning; thence continuing west along
the north line of Parcel Nos. 1 and 2 of said Bremner property, 194
feet, more or less, to the northwest corner of Parcel No. 2 of said
Bremner property; thence along a line parallel with the east line of
Lot 3, north 260.12 feet, more of less, to a point in the southerly
line of Mill Creek, Road; thence easterly along said southerly line of
Mill Creek Road to the northwest corner of the property conveyed to
Cecil J. Dunithan and wife, recorded February 2, 1950, in Book 2523,
Page 17, Official Records; thence south along the west line of said
Dunithan property, 179.8 feet to the northwest corner of the property
conveyed to Robert W. Coburn and wife, recorded August 29, 1957, in
Book 4313, Page 121, Official Records; thence continuing along the
west line of said Coburn property to the point -of beginning.
