The parties to this agreement, dated this 25th day of July ,
197__7_, are the City of Redlands, a Municipal Corporation, hereinafter called
"City", and M. L: Mar'ujdz, jai. and Jesus R. Roque including
all assignees, heirs, mortgagees, and successors in interest, hereinafter
called "Applicant".
RECITAL
WHEREAS the Planning Commission, in its approval of Minor Subdivision 31
has required the installation of sanitary sewer along the frontage of
applicants' property shown on Exhibit "A" attached hereto and made a part
of this agreement, and
WHEREAS the City Council has authority to suspend the requirement for installa-
tion of sanitary sewers and water mains provided that such an action will not
adversely affect the health, safety, and welfare of the public, and further
provided that appellant agrees in writing to install the required sanitary
sewer and water mains at the time Parcel 2 fronting on Pioneer St. is developed
or when the City deems it necessary, and that such agreement shall be recorded
with the County Recorder by the City Clerk.
COVENANTS
Applicant hereby covenants as follows:
1. To install a sanitary sewer along the frontage on Pioneer St. of their
property shown on Exhibit "A" at such time as the required installation
will provide for a completed and useable system.
2. To install water mains within Judson St. and Pioneer St. including a
Standard Fire Hydrant as shown on Exhibit "A" at such time as Parcel 2
of Minor Subdivision No. 31 is developed.
3. This agreement shall be binding upon and enforceable against applicants
and all assignees, heirs, mortgagees, and successors in interest, and
shall be recorded in the office of the County Recorder.
4. If applicant or any successor in interest fails to comply with any term
of this agreement or acts contrary to any ordinance of the City of
Redlands, the City may initiate proceedings and file a proper action to
enforce this agreement. Applicant and all successors in interest agree
to pay all costs of suit and reasonable attorney's fees for such action.
The City hereby covenants as follows:
I. That on the 19th day of July- , 1977 , the City Council has
determined that the provisions of this agreement do not adversely affect
the health, safety, and welfare of the public.

2. That the requirement to install the sanitary sewer along the Pioneer St.
frontage of the applicant's property and the requirement to install water
mains and a Standard Fire Hydrant as shown on Exhibit "A" is hereby
suspended provided that applicants agree in writing to install these
facilities at such time as the required installations will provide for
completed and useable systems.

PLANNING COMMISSION RECOMMENDATIONS (.Continued)
10. house Moving Permit No. 73 - Mr. John V. Creatura
That the request for permission to move a single family
residence from 304 East Citrus Avenue to 1130 Washington
Street be approved subject to compliance with.all depart-
mental recommendations as contained in Planning Commission
minutes dated July 12, 1977. On motion of Councilwoman
Grace, seconded by Councilman Miller, this recommendation
of the Planning Commission wa's adopted by AYE votes of
all present.
ll. Minor Subdivision No. 31 -- M. Mar uez -- Final Approval
A request for permission to sign a construction agree-
ment for installation of the Public Works' requirements
for 2,350 feet of 8-inch water main and installation of
dry sewer along Pioneer Avenue at the time the five
acres Pioneer Avenue property is developed was approved
on motion of Councilman Miller, seconded by Councilman
Elliott. All other .requirements as outlined in Council
minutes dated June 21, 1977, having been complied with,
final approval was given for Minor Subdivision 31
subject to signing of the above agreement on motion of
Councilman Miller, seconded by Councilman Elliott, by
r AYE votes of all present.
12. Minor Subdivision No. 34 -- I-10; 17 Acres, A Limited
Partnership
Tentative approval of Minor Subdivision No. 34 was
given at the Council meeting of July 5, 1977, pending
payment of funds from Mr. Donald Walcott. At this
time tentative approval of Minor Subdivision No. 34 was
confirmed subject to the recommendations of all depart-
ments as outlined in Planning Commission minutes dated
June 28, 1977, on motion of Councilwoman Grace, seconded
by Councilman Elliott.
