Donnelly DATE: December 12, 1978 SUBJECT: Consultant Agreement, Marvin .Johnston -City Marvin Johnston is currently under contract to provide inspection services for the City on Public Works related projects. The need to employ him was necessitated by the building boom that began in Redlands some 18 months ago. Public Works has one authorized position as a Public Works inspector. This contract provided us with a means to cope with the construction without adding to permanent staff. The contract will expire on January 17, 1979. This is a request that the contract be extended .for a period of six months and that $9,950.00 be allocated to provide salary. We now have 49 subdivisions and many Minor Subdivisions and C.U.P.'s under construction. We have an additional 29 subdivisions with 1160 lots which have received final approval but have not started construction. This workload is really more than two people can handle, but with as needed assistance from staff of the Engineering Division, we can manage. For your agreement identical Att. V` convenience, I ain attaching a copy of the current I am proposing that the new agreement be with no increase in salary. CONSULTANT AGREEMENT THIS AGREEMENT by and between the City of Redlands, sometimes called "City" and Mr. Marvin Johnston, also referred to as "Consultant" is dated this 17th day of July, 1978. For and in consideration of the mutual covenants contained herein, City agrees as follows: 1. To engage the consultant under contract with the City as Construction Inspector to perform services related to the construction of Public Works facilities such as utilities, parking lots, area lighting, landscaping, irrigation, paving, curbs & gutters and sidewalks. Tasks shall involve coordina- tion of several contractors activities working in the area simultaneously, plan interpretation, inspection of placement of all materials, observation of required tests of materials used on the job and approval of test results, inspection of the installation of all utility systems and equipment, and the observation and approval of testing and demonstration of all such systems. Consultant shall also be responsible to the City to assure that all materials and equipment included in the work meet the minimum requirements established in the specifications and further, to represent the City in all determinations where "or equal" items or materials are submitted for approval. 2. To compensate consultant for such services at the rate of $9.50 per hour, payable on Wednesday of every other week, It is anticipated that work load may vary, consultant agrees to work the hours required to accomplish the contracted services. For and consideration 'of the mutual covenants contained herein, the consultant agrees as follows: 1. To diligently and promptly perform services as Construction Inspector under the general supervision of the City Director of Public Works. 2. To be compensated for such services as enumerated above. 3. To perform said services during each normal work Meek or other reasonable hours. The parties hereto agree that employment will begin on July 17, 1978 and may be terminated by either party upon giving thirty (30) days notice, in writing, or any time by mutual agreement of the parties in writing. In any case, the contract shall terminate January 17, 1979. Resolution On motion of Councilman Elliott, seconded by Councilman No. 3551 DeMirjyn, Resolution No. 3551, a resolution of the City Council authorizing the City Manager to have access to Personnel State and Local Summary Criminal History Information, was unanimously adopted. Resolution On motion of Councilman DeMirjyn, seconded by Councilman No. 3552 Knudsen, Resolution No. 3552, a resolution of the City Council authorizing execution of a Mutual Assistance Fire Agreement for fire protection with the City of Loma Protection Linda, was unanimously adopted: CITY MANAGER The Consultant Agreement between Marvin Johnston and the City under which Mr. Johnston provides inspection service Public Works for the City on Public Works related projects will Consultant expire on January 17, 1979. The Department asks that j, Council authorize extension of this contract for an Agreement additional six months. On motion of Councilman Knudsen, seconded by Councilman DeMirjyn, the contract agreement between Mr. Johnston and the City was approved for six months from January 17, 1979. On motion of Councilman Knudsen, seconded by Councilman DeMirjyn, unanimous approval was given to a request for authorization for the Department of Public Works to enter into an agreement with Signal Maintenance, Inc. to provide the needed controllers and installations Traffic necessary for the intersections of Redlands Boulevard Signal with Palm, Cypress, and Citrus Avenues at a total cost Controllers of $29,785.62. The company that originally provided the controllers for these intersections is out of business and parts are not available. This approval was given with waiver of going to bid unanimously by the City Council. A Declaration of Dedication to the City from Joseph and Declaration Ellen Khoury for street right-of-way purposes in of connection with a building permit was unanimously Dedication approved on motion of Councilman DeMirjyn, seconded by Councilman Riordan.
