This agreement, made and entered into this lith, day of
March
19 6J , by and
between the Gity of Redlands, a municipal corporation of the State of California,
hereinafter called "City", its assigns and successors in interest, and Brookside Dairy
Distributors, a co -partnership composed of Joe Van Mouweriik, Jan Van Mouwerik and
Henry H. Van Mouweri k, hereinafter called "Owner", its heirs, executors, administrators,
agents or assigns.
1TNESSETH:
WHEREAS, the City desires an easement and right to construct, place, operate, inspect,
maintain, replace, repair and remove sewer facilities in that real estate and real
property to which the Owner has title and owns described as:
A 10 foot wide strip of Lot 3, Blocl- 27 of a portion of West Redlands as
per plat recorded in Book 9 of Maps, Page 22, records of said County, lying
southwesterly of the following described line:
Beginning at the intersection of the centerline of Kansas Street and closed
Barton Road, thence south 0° 171 to the centerline of Alder Way which is
also the terminus of said line,
AND WHEREAS, the Owner agrees to grant said easement and right to construct, place,
operate, inspect, maintain, replace, repair and remove sewer facilities in said real
estate and real property.
NON THEREFORE, it is hereby agreed as follows.
The Gity, in consideration for said easement and right, does hereby grant to the Ower
the right to make direct connections to the sewer trunk line to be constructed in said
easement to provide sanitary sewer service for that real property located immediately
adjacent to said sewer trunk line without frontage connection charges being levied.
The City does also grant to the Owner the right to extend a sanitary sewer line from
said sewer trunk line without connection charges being levied provided that said sani-
tary sewer extension is located in public right-of-way or easement acceptable to the
City and serves only that property described in Exhibit A (attached). All costs
incurred in making connections to said sewer trunk line or in extending sanitary sewer
lines from said sewer trunk line shall be borne by the Owner. All other charges or
rates now in effect or established subsequent to this date by the City shall apply.
TO HAVE AND TO HOLD the said right unto the Owner, its heirs, executors, administrators,
