SUBJECT: AGREEMENT WITH THE CITY OF REDLANDS FOR THE DESIGN AND
RECONSTRUCTION OF MILL GREEK ZANJA EXPANDED INLET AND NINTH
STREET CULVERT
RECOMMENDATION: Acting as the governing body of the of the Flood Control District (District), approve
agreement with the City of Redlands (City) to administer the design and reconstruction of the Mill Creek
Zanja Expanded Inlet and the Ninth Street Culvert (Project) in which the City will pay the District an amount
not to exceed $1 million, less any environmental costs/fees.
BACKGROUND INFORMATION: The Mill Creek Zanja Inlet and the Ninth Street Culvert are considered
inadequate to convey major storm flows. As a result, the City has experienced frequent flooding along
Redlands Boulevard. The District and the City have jointly requested, in the past, for the Army Corps of
Engineers (Corps) to fund and reconstruct the Project but the Corps, after extensive review and analysis,
did not feel that the Project met the criteria under the policies and guidelines of the Corps. Recently, the
City applied for and obtained a $1 million grant from the Department of Housing Affairs under the Federal
Disaster Recovery Initiative Grant program for the design and reconstruction of the Project. With these
funds now available, the City has requested that the District be responsible for administering the Project's
design and construction.
Under terms of this agreement, the City shall review and approve the Project's plans and specifications,
prepare required environmental documentation, and provide funding to the District in an amount not to
exceed $1 million, less any environmental costs/fees. The District shall prepare all plans, specifications and
cost estimates, advertise, award and administer the construction contract, and pay all Project costs
exceeding $1 million, less any environmental costs/fees. Once completed, the District will own, operate and
maintain the Project, except for that portion within the right-of-way for Ninth Street. The City and District will
enter into a separate"Common Use Agreement" outlining the maintenance and liability responsibilities.
REVIEW BY OTHERS: This item was reviewed by Deputy County Counsel Charles S. Scolastico on July 5,
2000 and the County Administrative Office (Tom Forster, Administrative Analyst).
FINANCIAL IMPACT: The total cost of the Project is estimated to be $1,055,000. The City will pay up to $1
million, less any environmental costs/fees, The Federal Government will pay the environmental costs/fees.
Funds to cover the additional anticipated cost, in the amount of $55,000, have been allocated in District's
Zone 3 budget for Fiscal Year 2000/01.

WITNESSETH
WHEREAS, the San Bernardino County Flood Control District's (DISTRICT) Mill Creek
Zanja Inlet at Redlands Boulevard, west of Ninth Street (INLET) is considered inadequate to
convey major storm flaws; and
WHEREAS, the City of Redlands (CITY) has experienced frequent flooding along
Redlands Boulevard as a result of inadequate capacity of the INLET; and
WHEREAS, DISTRICT and CITY desire to improve the INLET and havejointly requested
and funded a U.S. Army Corps of Engineers Feasibility Study for a project to fund and
reconstruct the INLET; and
WHEREAS, the U.S. Army Corps of Engineers determined that the Corps Project was
not feasible under the policies and guidelines of the Corps of Engineers; and
