NOW, THEREFORE, it is hereby agreed to amend County Contract No. 04-1053 between the County and the Cities as follows: 1. DELETE the existing fourth WHEREAS statement, and SUBSTITUTE therefore the following as a new fourth WHEREAS statement: WHEREAS, the total project cost is estimated to be $411,428. COUNTY's share of project cost is estimated at $102,857 (25%), LOMA LINDA's share of project cost is estimated at $102,857 (25%), and REDLANDS' share of project cost is estimated at $205,714 (50%), and as more particularly set forth in the Revised Exhibit "A", attached hereto and incorporated herein by reference; and 2. DELETE the existing Section 1.10 and SUBSTITUTE therefore the following as anew Section 1.10: Auditor/Controller—Recorder Use Only 0 Contract Database 0 FAS Input Date Keyed By Page 1 of 2 Pay for its proportionate share of the PROJECT costs. The PROJECT costs shall include the cost of PROJECT construction, design, construction engineering, right-of-way acquisition, compliance with CEQA requirements, and overhead. REDLANDS' proportionate share is 50% of the PROJECT costs, which is estimated at $205,714. REDLANDS shall be responsible for the sum $205,714, plus its proportionate share of any PROJECT cost increases pursuant to Section 4.7. 1 DELETE the existing Section 2.1 and SUBSTITUTE therefore the following as a new Section 2.1: Pay for its proportionate share of the PROJECT costs. The PROJECT costs shall include the cost of PROJECT construction, design, construction engineering, compliance with CEQA requirements, and overhead. COUNTY's proportionate share is 25% of the PROJECT costs, which is estimated at $102,857. The COUNTY will also pay for its proportionate share of right-of-way costs. 4. DELETE the existing Section 3.1 and SUBSTITUTE therefore the following as a new Section 3,1: Pay for its proportionate share of the PROJECT costs. The PROJECT costs shall include the cost of PROJECT construction, design, construction engineering, compliance with CEQA requirements, and overhead, LOMA LINDA's proportionate share is 25% of the PROJECT costs, which is estimated at $102,857. The COUNTY will also pay for its proportionate share of right-of-way costs. 5. Replace Exhibit "A" with the attached Revised Exhibit "A". Griffiths MAR 2; 9 ZOU7 Senior Civil Engineer RE: COOPERATIVE AGREEMENT NO. 04-1053 VA C WORK$ P Dear Mr. Griffiths: On October 5, 2004, the County of San Bernardino Board of Supervisors approved Cooperative Agreement No. 04-1053 between the County and the Cities of Redlands and Loma Linda for the project to install a traffic signal at the intersection of San Timoteo Canyon Road and Barton Road. The City of Redlands has revised the cost for this project due to recent material cost hikes. The project cost is now $411,427.02, which is 105% above the amount agreed upon in the cooperative agreement. Of this amount, the County's share of cost is $102,856.75 (25%), an increase of $52,856.75, the City of Loma Linda's share of cost is $102,856.75 (25%), an increase of$52,856.75, and the City of Redlands' share of cost is $205,713.52 (50%), an increase of$105,713.52. Pursuant to Section 4.11 of the cooperative agreement, due to the cost overrun exceeding 25% of the County of San Bernardino and Cities of Loma Linda and Redlands mutually agreed upon project cost, an amendment to Cooperative Agreement No. 04-1053 is required. Enclosed for your review and approval are three amendments to the above mentioned agreement. Please obtain the appropriate signature and return all three copies to my attention.
