Redden Deputy District Director Project Development Local Agency City of Recd1l 'An, S Supplement No. 8 To Local Agency—State Agreement No. 09-5083 Proiect No. M-8029 (1) PROGRAM OF LOCAL AGENCY FEDERAL AID URBAN SYSTEM PROJECTS IN THE City of Redlands Local Agency Pursuant to the Federal Aid for Urban Systems Acts, the attached "Program" of Federal Aid Urban System Projects marred "Exhibit B" is tiereby incorporated in that Master Agreement for the Federal-Aid Program which was entered into between the above named LOCAL AGENCY and the STATE on Ay-)r il 10 , 1979 and is subject to all of the terms and conditions thereof. The subject program is adopted in accordance with Paragraph 2 of Article H of the aforemen- tioned agreement under authority of City/Ccuxty Resolution No. 3735 approved by the City Council/,UXdU,3upe=1_&x.K on February 17 , 1981 (See copy attached). Federal runds —7-2LcVnFunds* — M-R029 (1) In San Bernardino, CONSTRUCTION ENGINEERING AND CONSTRUCTION in the City of Redlands, on Redlands City 169 .1 Boulevard from Funds Funds Alabama Street to Citrus Avenue. $440,450 $379, 183 $27, 254 $34 , 013 *Local Agency Funds unless otherwise specified Special Covenants or Remarks: 1. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the City of Redlands at regular intervals or as required for efficient operation of the completed improvements . DLA-411 (10/30) EXHIBIT B Page 2 January 8 , 1981 2. The City will prepare PS&E. The State will advertise , award the contract, administer construction and pay the contractor on this project. 3. The actual funds for the project will be set up on the basis of contract prices after the bids for the work have been opened. In awarding, or agreeing to ward the contract, the local agency agrees that the payment of Federal funds will be limited to the Detail Estimate amount approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) , or its modification (PR-2A) , and accepts any increases in local agency funds. 4 . The availability of Federal funds will be subject to meeting deadlines and/or other conditions as may be imposed by the Director upon the recommendation of the Federal-Aid Urban Advisory Committee. 5. The use of Federal funds for this project is subject to the project being included in the multiyear FAU Program for San Bernardino County. 6. The portion of the local agency funds, as contained herein in Exhibit B, required to match Federal Highway Funds in this project will be provided by the State as authorized by Item 169 . 1 of the Budget Act of 1979 and allocated by the California Transportation Commission. 7. The local agency' s share of matching funds will be 100% of the amount remaining and not covered by Federal participation and 169 .1 funds. 8. The 169. 1 funds in the project will be set up on the basis of the Preliminary Estimate as shown on Exhibit B and may be increased, if funds are available , to the amount required to matching Federal funds as shown in the Detail Estimate and approved by the FHWA in the Federal-Aid Project Agreement (PR-2) , or its modification (PR-2A) . 9 . In the event the 169.1 funds required are less than the amount shown in Exhibit B or the Detail Estimate, the excess may revert to (1) the county allocation provided the funds are released prior to June 30, 1980; (2) county projects provided the funds are released prior to June 30, 1982 , and providing project (s) containing Item 169 .1 funds can utilize the released funds . EXITTBIT B Page 3 January 8 , 1981 10. Unexpended Item 169 .1 funds may revert to the 169 . 1 appropriation after June 30 , 1982 . 11. The County may be required to report to the California Transportation Commission concerning use of Item 169 . 1 funds and that the use of any funds freed as a result of the receipt of Item 169 . 1 funds are identified. 12. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned master Agreement for Federal-Aid Program.
