STATE OF CALIFOP'tiIA AL6/R33.3 3/30. 166209 Department of TransportationL SBd 10/30 Federal Aid No' I Ow=ner's File I-010-2(63) UTILITY Y AGREEME T NO. 8626-A DATE State of Calilfornia, acting bN, and through the Deartment of Transportation, hereinafter called S'I`ATF pro- poses to on SBd-10 from California Street 1 o Orange Street, construct freeway; reconstruct 10/10 Inter chan e and CITY REDLANDS hereinafter called OWNER,owns and maintains 10" water main within the limits of State's project which require Relocation to accommodate State's project. It is hereby mutually agreed that: I. WORK TO BE DONE In accordance with Notice to Owner No. 8626-A dated August 30, 1989 Owner shall relocate facilities as follows: Item (A) Remove and replace existing 10" Water main lying within present right of way (no cost to State) . Extend pipeline and casing to point outside right- of-way limits on an alignment to eliminate angle points, thus allowing water main to be removed from casing for maintenance. Pressure test pipeline for leaks. All work shall be performed substantially in accordance with Owner's Plan, a copy of which is on file in the District Office of the Department of Transportation at 247 West Third Street, San Bernardino, California, 92403. Minor deviations from the above-described work may be made and incidental work performed by the Owner when mutually acceptable to both parties and upon approval by the State. LIABILITY FOR WORK The existing facilities are publicly owned and lawfully maintained in their present location and qualify for relocation at State expense under the provision of Section 703 of the Streets and Highways Code. III. PERFORMANCE OF WORK Owner agrees to perform the herein-described work with its own forces and to provide and furnish all necessary labor, materials, tools and equipment required therefor, and to prosecute said work diligently to completion. IV. PAYMENT FOR WORK The State shall pay its share of the actual cost of said relocation within 90 days after receipt of an itemized bill in quintuplicate, signed by a responsible official of Owner's organization, compiled on the basis of the actual cost and expense. The owner shall maintain records of the actual costs incurred and charged or allocated to the project in accordance with recognized accounting principles. It is understood and agreed that the State will not pay for any betterment or increase in capacity of Owner's facilities and that Owner shall give credit to the State for all accrued depreciation on the replaced facilities and for the salvage value of any material or parts salvaged and retained or sold by Owner. At the election of the Owner, progress bills for costs incurred may be submitted not to exceed Owner's recorded costs as of a specific date less estimated credits applicable to completed work where the recorded costs are sufficient to warrant such billing. The final billing shall be in the form of an itemized statement of the total costs charged to the project, less the credits provided for in the Agreement, and less any amounts covered by progress billings. Detailed records from which the billing is compiled shall be retained by the Owner for a period of four years from the date of the final bill and shall be made available for verification by State and Federal auditors. R/W 05-2 2 of 3 0-osr, V. GENERAL CONDITIONS owner shall submit a Notice of Completion to the District Utilities Coordinator within 30 days of the completion of the work described herein. All costs accrued by owner as a result of State's request to review, study and/or prepare relocation plans and estimates for the project associated with this Agreement may be billed pursuant to the terms and conditions of this Agreement. If State's project which precipitated this Agreement is canceled or modified so as to eliminate the necessity of work by owner, State will notify Owner in writing and State reserves the right to terminate this Agreement by Amendment. The Amendment shall provide mutually acceptable terms and conditions for terminating the Agreement. It is understood that said highway is a Federal-Aid highway and accordingly FHPM 6-6-3-1 is hereby incorporated into this Agreement. TRANSMITTAL OF UTILITIES AGREEMENT Accompanying this letter are items Prepared in connection with necessary extension of the 14" water main lying within Alabama Street right of way which crosses Route 14 within the above- referenced proposed freeway improvement project. Attached, in triplicate, is Utilities Agreement No. 8626-A providing the terms by which State will reimburse your Company for a portion of the cast. Please review the Agreement, and if found to be satisfactory, have the original and one copy executed and return to me for further execution by State.
