HomeMy WebLinkAboutContracts & Agreements_5-1979_CCv0001.pdf January 15, 1979 TO: See Distribution SUBJECT: AGREEMENT REGARDING POSSIBLE REMNANT PARCEL AT INTERSECTION OF FERN AVENUE AND SAN TIMOTE0 CANYON ROAD Recent actions by the Planning Commission was an occasion for presentation of an agreement concerning this subject signed by the undersigned and Mr. William Cunningham. It should be understood that the agreement was signed in the context that should the City of Redlands rebuild Fern Avenue, including the intersection with San Timoteo Canyon Road as a gas tax project, a remnant parcel could result. It was considered that it would be in the best interest of the city to trade this remnant parcel to Mr. Cunningham for other property he owns that would be required for the street improvements. it was fully realized by the undersigned and Mr. Cunningham that circumstances could occur such as other adjacent property owners being required to deed right-of-ways as a requirement for development that would make it unnecessary for the city to purchase property creating city ownership of the remnant. In addition, it was realized that the agreement referred to a tentative drawing that could change, thereby eliminating the remnant parcel. It would be unfortunate and misleading should claims be made that the agreement makes it mandatory that the remnant parcel as shown on the tentative drawing be delivered to Mr. Cunningham or that the city is in any way obligated to alter its policies when considering applications for development by adjacent ,-pY0p,erty owners . Cunningham, owner of the property lying on the southerly side of Fern Avenue between Terracina Boulevard and San Timoteo Canyon Road agree to dedicate all right-of-way required for the reconstruction of said Fern Avenue on an alignment as shown on a map in the Director of Public Works office dated June 28, 1974, at such time as the city desires to undertake the project. City also agrees to deed to William E. Cunningham all land lying adjacent to his property including vacated Fern Avenue in the intersection of reconstructed Fern Avenue and San Timoteo Canyon Road and any remnant parcel resulting from said realignment. Mitchell dated December 20 , 1977 concerning property adjacent to the intersection of San Timoteo Canyon Road and Fern Avenue . The purpose of this supplement is to provide additional reference data, as requested by Mr. Cunningham, to further identify the remnant parcel that would be deeded to him when Fern Avenue is improved and realigned. The remnant parcel is now a part of a parcel of property identified in the San Bernardino Assessor's Book as 172-151-02 . If and when deeded to Mr. Cunningham it would become part of parcel number 172-152-01 or, at the discretion of the County Assessor, be assigned a new parcel number. January 5, 1979 Date Ro rt H.
