HomeMy WebLinkAbout8028RESOLUTION NO. 8028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO NO.3236 (CITY OF REDLANDS ANNEXATION NO. 93) FOR A PORTION OF REAL PROPERTY LOCATED AT THE NORTHWEST CORNER OF WEST LUGONIA AVENUE AND TENNESSEE STREET (APN: 0167-171-13-0000). WHEREAS, the property owner has initiated proceedings pursuant to the Cortese-K nox- Herzberg Local Governinent Reorganization Act of 2000 of the California Govenunent Code described as: LAFCO 3236 -- Reorganization to include Annexation to the City of Redlands and Detachment from San Bernardino County Fire Protection District, its Valley Service Area, and its Zone FP-5, County Service Area 70. WHEREAS, the City of Redlands adopted Resolution No. 7890 on July 17, 2018, supporting adjustment to the City of Redlands boundary for the westerly 0.764-acre of the subject property located at the northwest corner of West Lugonia Avenue and Tennessee Street; and WHEREAS, adoption of this Resolution is not subject to environinental review under the California Environunental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061(b)(3), as the City has determined there is no possibility of any enviromnental effects. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION 1. The City Council of the City of Redlands hereby determines that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a Certificate of Filing by the Local Agency Fornation Commission (LAFCO) Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the County of San Bernard no shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. C. The City Council of the City of Redlands and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result L\Resolutions\Res 8000-9099\8028 Receiving Tax Apportionment.doc of the following jurisdictional change: LAFCO NO. 3236 — CITY OF REDLANDS ANNEXATION NO. 93 SECTION 2. The City Council of the City of Redlands hereby resolves and orders that: A. The negotiated exchange of property tax revenue between the City of Redlands and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above -referenced jurisdictional change is hereby approved and accepted. B. The exchange of property tax revenues between the City of Redlands and the County of San Bernardino resulting from the above -described jurisdictional change is approved and accepted, and results in no exchange of said revenues since the City of Redlands already receives its property tax allocation generated from the subject property as majority of the subject propertyis alreadywithin the City of Redlands and said subject property is already assigned a Tax Rate Area that allocates a share of property tax to the City. C. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change, shall be allocated in future years pursuant to the provision of Section 99 of the Revenue and Taxation Code. SECTION 3. The City Council hereby determines that the adoption of this Resolution is exempt from enviroiunental review under the California Environmental Quality Act (Public Resources Code, §21000 et seq.) pursuant to State CEQA Guidelines (Cal. Code Regs., § 15000 et seq.) Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of this Resolution may have a significant effect on the environment. SECTION 4. The City Clerk of the City of Redlands is hereby directed to certify the passage of this Resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Fonnation Com nission (LAFCO) of the County of San Bernardino.
