HomeMy WebLinkAboutContracts & Agreements_216-2005_CCv0001.pdf AMENDMENT NO. 1 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF REDLANDS AND REDLANDS ASSOCIATION OF MANAGEMENT EMPLOYEES This Amendment No. l to the Memorandum of Understanding dated October 4, 2004 by and between the City of Redlands ("City") and Redlands Association of Management Employees (`"RAME") is made and entered into this I" day of November, 2005. RECITALS WHEREAS, the City and RAME met and conferred in good faith and in accordance with law with regard to amending the Memorandum of Understanding between the City of Redlands and Redlands Association of Management Employees; WHEREAS, the City agreed to pay the costs of establishing, and allow RAME to participate in a 401(a) Retirement Plan; WHEREAS, it is the desire of the City and RAME to amend Article 10 (Deferred Compensation) and Article 11 (401 A Plan) of their existing Memorandum of Understanding dated October 4, 2004; NOW, THEREFORE, in consideration of the mutual promises contained herein, and for such other good and valuable consideration, the receipt of which is hereby acknowledged, the City and RAME agree as follows: Section 1. Article 10 of the Memorandum of Understanding between the City and RAME, dated October 4, 2004, is hereby amended and shall read as follows: ARTICLE 10. DEFERRED COMPENSATION The City of Redlands shall provide a deferred compensation plan to Management Unit employees. Participation by employees is optional and all costs of participation shall be borne by the plan participants. Section 2. Article I 1 of the Memorandum of Understanding between the City and RAME, dated October 4, 2004, is hereby amended and shall read as follows: ARTICLE I I. 401 A PLAN In January of each year, the City shall make an annual contribution to a qualified 401(a) plan on behalf of each Management Unit employee in the amount of$1,125 plus 2% of salary. Section 3. Except as modified herein, all of the provisions of the Memorandum of Understanding between the City of Redlands and Redlands Association of Management Employees, dated October 4, 2004, shall remain in full force and effect. CITY OF REDLANDS L)atc: Nov. 1 , 2005 'Su/an Peppler, Mayor'AT l-EST Lorrie oyzer, City r REDLANDS ASSOCIATION OF MANAGEMENT EMPLOYEES a't�el //'� Date: /d Gary Van orst, President REDLANDS ASSOCIATION OF MANAGEMENT EMPLOYEES ACCUMULATED BENEFIT PROGRAM The City Council approved a Memorandum of Understanding between the City of Redlands and Redlands Association of Management Employees on October 4, 2004 allowing Association members to participate in a qualified 401(a) program. On October 14, 2005, the members of the Association approved the Unit's participation in the Accumulated Benefit Conversion Program offered by Nationwide Financial. The Association agreed that the program will apply to all members of the Unit. The City shall fund the accounts on behalf of each member in the amount of One Thousand One Hundred Twenty Five Dollars ($1125) per employee, plus Two Percent (20) of salary. Upon retirement, Unit Members shall deposit the cash value of vacation leave, incentive payouts, floating holidays and executive leave to the program in the maximum amount allowable. The annual maximum contribution is currently $42,000. Independent Contractor Agreement - Heather Conyers - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, the City Council unanimously approved an independent contractor agreement with Heather Conyers to conduct Mommy and Me Art Classes and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City. Facility Use Agreement - Nutrition for Seniors Program - Following brief discussion, Councilmember Gil moved to a facility use agreement with the Family Service Association of Western Riverside County for the Nutrition for Seniors Program at the Redlands Community Senior Center, 111 West Lugonia Avenue, and authorized the Mavor to execute, and the City Clerk to attest to, the document on behalf of the City. Motion seconded by Councilmember George and carried unanimously. Independent Contractor Agreement - Redlands Community Music Association - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, the City Council unanimously approved an independent contractor agreement with the Redlands Community Music Association for the Children's Summer Workshops and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City. Injury and Illness Prevention Program - Following brief discussion, Councilmember Gil moved to adopt the revised Injury and Illness Prevention Program and authorized staff to implement the program as required by Cal OSHA. Motion seconded by Councilmember George and carried unanimously. MOU Amendment - Redlands Association of Management Emnlovees - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, the City Council unanimously approved establishment of the Nationwide Accumulated Benefit Conversion Program for the Redlands Association of Management Employees, authorized the execution of the document, and approved Amendment No. l to the Memorandum of Understanding with the Redlands Association of Management Employees.
