TO THE MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF REDLANDS AND
REDLANDS PROFESSIONAL FIREFIGHTERS ASSOCIATION
This Amendment No. I to the Memorandum of Understanding between the City
of Redlands ("City") and the Redlands Professional Firefighters Association ("RPFA")
and dated September b, 2005 is made and entered into this 15`h day of November, 2005.
RECITALS
WHEREAS, the City and RPFA have met and conferred in good faith and in
accordance with law with regard to amending the Memorandum of Understanding
between the City of Redlands and the Redlands Professional Firefighters Association;
and
WHEREAS, it is the desire of the City and RPFA to amend Articles 48
(Compensatory Time) and 49 (Sick Leave) of their existing Memorandum of
Understanding dated September 6, 2005;
NOW, THEREFORE, in consideration of the mutual promises contained herein,
and for such other good and valuable consideration, the receipt of which is hereby
acknowledged, the City and RPFA agree as follows:
Section 1. Article 48 of the Memorandum of Understanding between the City and
RPFA, dated September 6, 2005, is hereby amended and shall read as follows:
ARTICLE 48 --- COMPENSATORY TIME
The City shall provide each employee in the unit with the option of receiving
overtime compensation in the form of compensatory time off (CTO) or cash payment.
Employees shall be authorized to accumulate no more than two hundred-forty (240)
hours of CTO at the end of each calendar year. Should there be an excess of two
hundred-forty (240) hours at the end of the calendar year, all hours in excess of two
hundred-forty (240) shall be paid out in cash the following January. All accumulated
CTO shall be utilized within twelve (12) months of the time it is earned.
Employees shall be authorized to utilize the accumulated CTO for any purpose.
The City agrees that it is at the discretion of the employee to use CTO in lieu of vacation
or holiday time.
ARTICLE 49 - SICK LEAVE
A. Accrual - Paid sick leave shall accrue at 5.6 hours per pay period and be taken in
twenty-four (24) hour shifts. Employees who work a forty (40) hour week will accrue
sick leave at 3.7 hours per pay period.
B. Buy-Back (24 Hour Personnel) - Unit employees with more than seven hundred
(700) hours of sick leave accrual may buy back up to three (3) shifts of sick leave accrual
each year, based on the following schedule:
I. No sick leave used during applicable period - buy back three (3) shifts.
2. One (1) shift of sick leave used during the applicable period - buy back two (2)
shifts.
3. Two (2) sick leave shifts used during applicable period-buy back one (1) shift.
4. Three (3) or more shifts of sick leave used during applicable period - no buy back
entitlement.
Unit employees with more than one thousand one hundred (I 100) hours of sick
leave accrual may buy back up to six (6) shifts of sick leave accrual each year, based on
the following schedule:
1. No sick leave used during applicable period - buy back six (6) shifts.
2. One (1) shift of sick leave used during the applicable period -- buy back Five (5)
shifts.
3. Two (2) sick leave shifts used during applicable period - buy back four(4) shifts.
4. Three (3) or more shifts of sick leave used during applicable period - buy back
three (3) shifts.
5. Four (4) sick leave shifts used during applicable period - buy back two (2) shifts.
6. Five (5) or more shifts of sick leave used during applicable period --buy back one
shift..
7. Six (6) or more shifts of sick leave used during applicable period - no buy back
entitlement.
C. Buy Back (40 Hour Week Personnel) Employees working forty (40) hour weeks
may accumulate sick leave from calendar year to calendar year to an unlimited amount,
or participate in the City's Sick Leave Buy Back program. In order to participate in the
buy-back, the employee must have a minimum of 96 hours of sick leave on the books. In
November of each year, Association members may elect to be paid cash at their current
hourly rate in accordance with the schedule below, less any sick leave hours used during
that period.

D. Accrual Payment Upon Retirement - Upon service or medical retirement under
the PERS retirement plan, or in the event of the death of an employee prior to retirement,
employees with less than twenty (20) years of service with the City may elect one of the
following options for payment of unused sick leave:
1. Convert all remaining sick leave accrued at the time of retirement to cash value at
the final rate of pay and apply said cash value to applicable premiums payable
under the City's medical insurance program for the employee and eligible
dependents until the cash value is exhausted. fn the event that the employee dies
prier to the exhaustion of the cash value of said benefits, the remaining cash value
may be applied towards the premiums of covered dependents until exhausted,
subject to the conditions and limitations of the applicable insurance policy.
2. At the time of service retirement, disability retirement, or at the death of an active
employee, accrued sick leave may be cashed out at the prevailing hourly rate at
three-percent (3%) for each year of service to a maximum of 100%.
3. At the time of retirement or disability retirement extend service credit equal to
one hundred percent (100%) of accrued sick leave on the books.
Upon service or disability retirement under the PERS retirement plan, or in the
event of the death of an employee prior to retirement, employees who have served a.
minimum of twenty (20) years of service with the City of Redlands, shall be provided
with lifetime health insurance. This insurance shall be at no cost to the retired employee
and shall cover the employee and eligible dependents. The plan shall be equal to that
provided to full time employees. Lifetime health insurance includes medical, dental and
vision care as provided in the Unit MOU. In addition affected employees also have the
option of being compensated for unused sick leave on the books at the time of retirement
by either option 2 or 3 above.
Section 2. Except as modified herein, all of the provisions of the Memorandum of
Understanding between the City of Redlands and the Redlands Professional Firefighters
Association, dated May 1, 2000 - June 30, 2005, shall remain in full force and effect..
IN WITNESS WHEROF, the parties have executed this Agreement, to be
effective as set forth herein."

MOU - Redlands Professional >rirefi2hters Association - On motion of
Councilmember Gilbreath, seconded by Councilmember Gil, the City
Council unanimously approved Amendment No. 1, pertaining to
compensatory time and sick leave, to the Memorandum of Understanding
with the Redlands Professional Firefighters Association and authorized the
Mayor to execute, and the City Clerk to attest to, the document on behalf of
the City.
Agreement - Refueling Station - On motion of Councilmember Gilbreath,
seconded by Councilmember Gil, the City Council. unanimously approved an
agreement for use of the refueling station with the San Bernardino Valley
Municipal Water District and authorized the Mayor to execute, and the City
Clerk to attest to, the document on behalf of the City.
Ordinance No. 2625 - Relocation Appeals Board - Ordinance No. 2625, an
ordinance of the City of Redlands adding Chapter 2.70 to the Redlands
Municipal Code to establish a Relocation Appeals Board, was unanimously
adopted on motion of Councilmember Gilbreath, seconded by Councilmember
Gil.
PUBLIC HEARINGS
Parking and Business Improvement Areas - Public hearings were advertised for
this time and place to consider Resolution No. 6429, ordering the continued
operation of Parking and Business improvement Area B and confirming the
annual report and assessments for Fiscal Year 2.005-06 and Ordinance No. 2621,
an amendment to the Redlands Municipal Code relating to Parking and Business
Improvement Areas. Mayor Peppler declared the meeting open as a public
hearing. Community Development Director Shaw explained the 2005-06
Annual Report, outlining assessments, district boundaries, proposed
improvements and activities and budgets has been prepared and was attached to
the staff report. This report has been approved by the Advisory Board for
Parking and Business Improvement Area B and filed with the City Clerk in
accordance with Section 36533 of the California Streets and Highways Code.
Resolutions declaring the City Council's intent to levy assessments were
approved on September 20, 2005. Approval of Resolution No. 6429 and
Ordinance No. 2621 is the final step required for the continued operation of the
Parking and Business Improvement Area B. Responding to Councilmember
Gilbreath's question, Community Development Director Shaw reported he and
Redevelopment Agency Director Gee are discussing expanding the existing
boundaries or create another area. There were no questions or comments from
the audience and the public hearing was declared closed.
Resolution No. 6429 - Councilmember Harrison moved to adopt Resolution
No. 6429, a resolution of the City Council of the City of Redlands ordering
the continued operation of Parking and Business Improvement Area. B and
