TO THE MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF REDLANDS AND
REDLANDS PROFESSIONAL FIREFIGHTERS ASSOCIATION
This Amendment No. 2 to the Memorandum of Understanding between the City
of Redlands ("City„) and the Redlands Professional Firefighters Association (-RPFA")
and dated September 6, 2005 is made and entered into this 16'h day of May, 2006.
RECITALS
WHEREAS, the City and RPFA have met and conferred in good faith and in
accordance with law with regard to amending the Memorandum of Understanding
between the City of Redlands and the Redlands Professional Firefighters Association;
and
WHEREAS, it is the desire of the City and RPFA to amend Articles 42 (Union
Activities) of their existing Memorandum of Understanding dated September 6, 2005;
NOW, THEREFORE, in consideration of the mutual promises contained herein,
and for such other good and valuable consideration, the receipt of which is hereby
acknowledged, the City and RPFA agree as follows:
Section 1. Article 42 of the Memorandum of Understanding between the City and
RPFA, dated September 6, 2005, is hereby amended and shall read as follows:
ARTICLE 42 — UNION ACTIVITIES
Local 1354 may appoint members of its union to serve on a bargaining team for
the purpose of meeting and conferring with City officials, however bargaining team
members must be identified prior to bargaining commencing. Release time for
bargaining shall be with the approval of the Fire Chief. Should the department be unable
to provide release time, another bargaining session shall be scheduled at a mutually
agreeable time between the Union and City.
Firefighters serving on the bargaining team during their scheduled working hours
shall earn their regular rate of pay during any workday hours that bargaining occurs.
Firefighters not on duty shall not earn pay, including overtime, for meeting and
conferring.
Grievance Handling
Local 1354 may appoint members of its union to act as employee representatives
for the purpose of investigating grievances and attending, grievance meetings. Release
time for grievance handling shall be with the approval of the Fire Chief. Should the
department be unable to provide release time, another time shall be scheduled that is
mutually agreeable between the Union and City.
Firefighters acting as employee representatives for the purpose of grievance
handling during their scheduled working hours shall earn their regular rate of pay during
any work day hours that grievance handling occurs. Firefighters not on duty shall not
earn pay, including overtime, for grievance handling.
Official Union Business
Each year Local 1354 members may contribute vacation leave hours to create a
total bank of two hundred-forty (240) hours that members may utilize for Official Union
Business Leave, such as attending training or conventions. Official Union Business
Leave must be pre-approved by the Fire Chief and the City Manager.
The City agrees to provide additional release time in the amount of one hundred
ninety two (192) hours for one Union representative to attend I.A.F.F., C.P.F. and/or
other conferences and educational seminars for up to three (3) consecutive shifts. These
hours shall be placed in the association bank in July of each year.
Notification of Union Officials
A current list of members making up the Board of Directors, including their term
of office, shall be submitted to the Personnel Office and Fire Chief as changes in Board
membership occur.
Union Meetings
The Union shall be allowed the use of City facilities to hold union meetings.
Represented employees who are on duty shall be allowed to attend said meetings with
approval of the duty Chief.
Section 2. Except as modified herein, all of the provisions of the Memorandum of
Understanding between the City of Redlands and the Redlands Professional Firefighters
Association, dated July 1, 2005 to June 30, 2010 shall remain in full force and effect.
IN WITNESS WHEROF, the parties have executed this Agreement, to be
effective as set forth herein."

Contract Award - Civic Center Facilities Improvement Project - Bids were
opened and publicly declared on April 27, 2006, by the City Clerk for the
Improvements to Civic Center Facilities Project, a bid opening report is on file
in the Office of the City Clerk. On motion of Councilmember Gilbreath,
seconded by Councilmember Gallagher, the City Council unanimously waived
the bid irregularity on the basis that waiver of the irregularity is legally
permissible and provides no competitive advantage to the apparent low bidder.
On motion of Councilmember Gilbreath, seconded by Councilmember
Gallagher, the City Council unanimously awarded the contract for the
Improvements to Civic Center Facilities Project, Project No. 1-0665, to Hinkley
and Associates, Inc. based on the total bid amount of 5216,000.00 and
authorized staff to approve contingent costs up to 10 percent over the total bid
amount and authorized the Mayor to execute, and the City Clerk to attest to, the
document on behalf of the City.
Agreement - Filter Media - Water Treatment Plant - On motion of
Councilmember Gilbreath, se-onded by Councilmember Gallagher, the City
Council unanimously determined that the approval of a contract for the purchase
and installation of filters for the City's water treatment plant is exempt from
CEQA pursuant to Guidelines Section 15269(b) which relates to emergency
repairs for publicly-owned facilities necessary to provide essential public
services. On motion of Councilmember Gilbreath, seconded by Councilmember
Gallagher, the City Council unanimously declared, based upon the
substantiative evidence presented in writing by City staff, that an emergency
exists necessitating the repair and/or replacement of filters at the City's Water
Treatment Plant and that the award of a contract, without bids, for the purchase
and installation of filters is necessary to respond to the emergency. On motion
of Councilmember Gilbreath, seconded by Councilmember Gallagher, the City
Council unanimously approved the agreement for a public improvement project
with ERS Industrial Services, Inc. for purchase and installation of filter media at
the Horace Hinckley Water Treatment Plant in the amount of$80,000.00.
MOU Amendment - Redlands Professional Firefighters Association - On
motion of Councilmember Gilbreath, seconded by Councilmember
Gallagher, the City Council unanimously approved Amendment No. 2 of
the Memorandum of Understanding with the Redlands Professional
Firefighters Association pertaining to union activities and authorized the
Mayor to execute, and the City Clerk to attest to, the document on behalf of
the City.
Resolution No. 6499 - Hybrid Entity- HIPAA - On motion of Councilmember
Gilbreath, seconded by Councilmember Gallagher, the City Council
unanimously adopted Resolution No. 6499, a resolution of the City Council of
the City of Redlands designating the City of Redlands a "Hybrid Entity" under
