HomeMy WebLinkAboutContracts & Agreements_146-2000_CCv0001.pdf MEMORANDUM OF UNDERSTANDING Between The City of Redlands And The Redlands Police Officers Association June 17, 2000—June 30, 2005 BETWEEN THE CITY OF REDLANDS AND THE REDLANDS POLICE OFFICERS ASSOCIATION June 17, 2000–June 30, 2005 ARTUCLE-1, -JER—M OF MEMORANDUM_QE VNDERSTANDING Except where expressly stated otherwise herein, the City and Association agree that the provisions of this Memorandum of Understanding (M. .U.) shall become effective on June 17, 2000, and shall expire on June 30,2005, ARTICLE 2 PREAMBLE It is the intent and purpose of this M.O.U. to set forth the understanding of the parties reached as a result of meeting and conferring in good faith regarding, but not limited to, matters relating to the wages, hours, and terms and conditions of employment between the City of Redlands (hereinafter referred to as "City") and the Redlands Police Officers Association(hereinafter referred to "Association"). ARITICLE 3 - RECOGN1110 The Redlands Police Officers Association, Inc. (hereinafter referred to as "Association") is the recognized employee organization for all sworn personnel (hereinafter referred to as "affected employees") employed in the Police Department except for those employees occupying the classification of Lieutenant, Captain, and Chief of Police. ,kR11CLE 4 - SALARIES 2QQQC,Q PENS ATIQ)NN-,SIUDY IMPLEM;ENTATI ,�PN, For the purpose of implementing the compensation study, Redlands base salary shall include 5%certification pay, For the purpose of implementing the compensation study, effective the first full pay period following June 16, 2000, base salary shall be increased by 5% in exchange for 2 eliminating Basic Certificate Pay and reducing Intermediate Certificate pay from 14%of base salary to 9% of base salary and reducing Advanced Certificate Pay from 22.5% of base salary to 17.5% of base salary. As a result of the conversion, there shall be no cost to the employee. YEAR I - NE3UALARY RAMI TES Effective with the first fall pay period following June 16, 2000, all Unit employees shall be placed into their new salary range. The new salary range was determined in accordance with bringing all Unit classifications to within 7.54x'0 of the survey city median, as updated September 2000, The placements in the new range shall result in an across the board base salary increase for each employee as follows: Police Officer 3.1% Corporal/Investigator 3.6% Sergeant 6.5% YEAR 2 —Effective the first full pay period following July 1, 2001, all Unit members shall receive a 2.5% (two and one-half percent) wage increase. YEAR 3- Effective the first full pay period following July 1, 2002, all Unit members shall receive a 2.5% (two and one-half percent) wage increase. YEAR 4—Effective the first full pay period following July 1, 2003, all Unit members shall receive a 10% (ten percent) wage increase. YEAR 5 —The City and the Association will conduct and complete a salary survey by August 31, 2004, utilizing the same comparison agencies as used in the September 2000 salary survey: Ontario San Bernardino Corona Pomona Fontana Palm Springs Chino Rialto Upland Montclair Colton Hemet San Bernardino County Riverside County 3 The salary survey shall use the actual top step base salaries of the above comparison agencies, in effect as of July 1, 2004. The purpose of updating the salary survey will be to determine the wage increase in Year 5 (five) of this agreement. Effective the firstfull pay period following July 1, 2004, all Unit members shall receive a wage increase equal to the amount necessary to raise their respective Unit classifications to the labor market median as determined by the 2004 updated compensation study.. For the purpose of implementing the compensation study, Redlands base salary shall include 5%certification pay. There shall be no readjusting of the study as a result of any subsequent changes in base salaries of comparison agencies. ARTICLE 5-RETIREMENT-PUBLIC EMPLOYEES RET IREMENISYSID111 (P On behalf of each employee covered by this agreement, the City shall continue to pay to the Public Employees Retirement System an amount equal to the required employee contribution to that system, provided the contribution willnot exceed a total of nine- percent (9%) of regular compensation. The City shall continue to include in its contract with PERS, the following provisions: HIGHEST SINGLE YEAR SUR' IVORCONTINLIANCE ( Widow's one-half continuance) 2% @ 50 RETIREMENT FORMULA Effective on January 1, 2005, the City shall take all necessary action to amend its contract with PERS to implement the 3% @ 50 retirement formula set forth in Government Code Section 21362.2. The City and the Association shall split equally the added cost resulting from the change in the City's employer contribution rate attributable to the 3% @ 50 formula. The employees' half-share shall. be paid through a reduction in the City's Employer Paid Member Contribution (EPMC). The City and the Association agree., however, that the employees' half-share share, shall not exceed 5.87% and that any excess shall be paid by the City. EXAMPLE #I.- Assume that the implementation of the 3% (�v, 50 formula causes the City's employer contribution in fiscal year 2004-2005 to increase. from 7.5% to 12.9%. The City shall decrease its EPMC from 9% to 6.3% due to splitting the 5.4% increase of the employer's rate attributable to the 3% @ 50 formula. 4 EXAMPLE #2. Assuming that the implementation of the 3% gc 50 formula causes the City's employer contribution in, fiscal year 2004-2005 to increase from 1% to 16%. The City shall decrease its EPMC from. 9% to 3.13% due to the employees' half-share being capped at 5.87%. ARUCLE-6- ENIEMV-1 ALLOWANCE Upon completion of six (6) months of employment within a Police Department classification, eniployees in the unit will be provided with a uniform allowance in the amount of nine hundred dollars ($900) per year. The uniform allowance shall be paid as follows: fifty percent (50%) paid the first week in January of each year and fifty percent(50%)paid the first week in July of each year. ARICICLE 7- POST CERICIFICATION 1! Effective June 17, 2000, members of the unit shall be eligible for an increase in base salary when a POST certificate is earned under the following schedule: INTERMEDIATE CERTIFICATE 9% of base salary ADVANCE CERTIFICATE 17.5% of base salary (The above percentages shall not be compounded upon each other). AR11CLE_L-_QYE_R11ME COMPENSATION The City shall pay each employee premium overtime compensation (time and one-half the employee's regular hourly rate, as that term is used in the Fair Labor Standards Act) for all hours worked in excess of forty(40) in a seven(7) day period. Paid vacation leave, compensatory time off and holiday leave shall be counted as hours worked towards reaching the forty (40) hour threshold. ARTICLE 2--ELNAL YEAR COMI!ENSATI-ON Effective July 1, 1990, each employee represented by this unit shall have the option of having their base salary increased one (1) year prior to service retirement to include the following: percentage of vested employee's contribution to PERS, vacation accrued during the final year, sick leave accrued during the final year (maximum of ninety six (96) hours), and floating holidays, as well as medical, dental and life insurance premiums when an employee provides one year advance notice of retirement, The Association agrees that the employee will then be responsible for, all health care, dental and life insurance premiums the final year of employment through payroll deduction. zn 5 The Association agrees that any of the preceding language on final year compensation adjustments will be superseded by whatever limitation oil final year compensation is mandatedbyPEISS. ARTICLE 10- REIMBERSEMENT OE EDUCAJI!QT—NA.L EXPE—NNES The City agrees to pay one hundred percent (100%) reimbursement for the actual costs of fees, including tuition and books, charged for the same or similar course at the University of California, Riverside. Eligibility determination shall be made by the Chief of Police. To be eligible for reimbursement under this Section, the employee must submit evidence of actual expenses incurred and satisfactory completion of course work with a grade of "C" or better if a letter grade is offered. If the course does not offer a letter grade, the employee must provide proof of satisfactory completion. ARUCLE 11 - PAGER PAY All employees represented by this unit who are required to carry a pager for the benefit of the City shall receive one hundred dollars ($100) per month in addition to their regular base salary, The department head shall determine which members shall be required to carry pagers. All employees receiving this incentive shall be required to carry the pager at all times. ARTICLE 12 ® COURT PAUCALL BACK PAY Members in the unit who are called to duty or to court from their off-duty period shall be compensated a minimum of three (3) hours at time and one- half(11/2) of base salary. This compensation shall be over and above the actual time worked. This compensation shall also apply when an, Officer's work schedule is changed when less than seventy-two (7 2) hours notice of said change has been given, except in the event of a bonafide emergency situation, ie., earthquake, flood or natural disaster. An Officer who is physically in the building but not scheduled for work and is called to work shall receive three (3)hours call back pay. An Officer who is not physically in the building and called to work shall receive three (3) hours of callback pay. An Officer who is scheduled for duty, physically in the building prior to his/her shift and is called to work-,,, shall not be eligible for three (3) hours call back pay. This compensation shall not apply to scheduled court appearances which can be accounted for by the five (5) additional accumulated hours per pay period associated with the 3/12 workweek. 6 ARTICLE 1 WNGEYLTY—PAY The City agrees that employees in this unit who have twenty (20) years of continuous service with the City of Redlands shall advance to Step "F" on the salary resolution Icer their classification. This increase will be effective at the beginning of the pay period closest to the first day oftheir 21"year of service. In the event that anemployee is not at the E step when he/she is eligible for the E step, at the completion of twenty 2 ) years of service,the employee will advance to the nest step in their salary range, and continue to advance based on merit until the employee reaches the E step.. ART 4 --CRIME l F T I `I' Employees in the unit assigned to Crime Scene Technician duty shall be compensated with an additional one and one-half(13/2 ) hours of pay per pay period at time and one- half(1'12). Eligibility for crime Scene Technician pay will be determined by the police Chief or his/her designee, When an employee in the unit is assigned to be a, Field Training Officer (FTC), during the time that-a trainee is assigned to the FTO, he/she shall be eligible to receive ITC pay in the amount of two and one-half(2.5)hours per pay period at straight time: AR11CLE,1 -HEALIH INSJURANCE The City will contribute the monthly health insurance premium for the health Net Insurance plan. The City also agrees<to reimburse members and eligible dependents for all deductibles and co-payments including prescriptions. During the term of this agreement, a labor management committee composed of RPO and the City shall meet to review available health insurance options. RTI I F INSURANCE 'rhe City agrees to contribute the monthlydental insurance premium under either the Principal Dental Insurance flan; Denti-Care or theCity's self-funded plan. - M The City agrees to provide a stipend in the amount of one hundred fifty dollars ($150)per month for those employees who can submit proof" of alternative medical insurance coverage and opt for the stipend its lieu of the medical insurance benefit. 7 RI --V IS IONINS The City agrees to contribute the entire monthly premium for members of this unit and heir eligible dependents for a vision insurance plata with Medical Eye Services.. .RTICLE 20 - LIEL I 1 IRAN-CE The City agrees to continue to provide life insurance coverage in the amount of ten thousand dollars ($10,000) per employee. Employees in the unit at their option and expense, will be allowed to purchase additional increments of life insurance at the City's louver group rite.. ARTICLE 21 - VA ATJQ N The vacation accrual for members of the unit shall be as follows. PAYMENT AT RSTIR EMENT — Employees with fifteen (1 5) years of continuous service with the City who retire under the PER retirement plan have the option of lifetime medical insurance under the Association's medical insurance program, for employee and eligible dependents or cash in unused sick leave at two percent(2%) for each year's service at the prevailing hourly rate. At retirement, employees with, less than fifteen (15) years service with the City have the option of cashing in unused sick leave at the prevailing hourly rate for future medical for employee and eligible dependents until said funds are exhausted or cash in unused sick leave, at the prevailing hourly rate, at two percent (2%) for each year of service with the City. In the event that the employee dies prior to exhaustion of the cash value of said benefits, the remaining cash value may be applied towards the premiums of covered dependents until exhausted, subject to the conditions and limitations of the applicable insurance policy. ARTICLE 23 -HOLIDAYS The holidays which will be honored for employees in the unit will be those listed in Resolution number 4831, signed on 12-17- 1, These include: New Year's Day (January 1) Martin Luther King Day(Third Monday in January) President's Day (Third Monday in February) Memorial 'Day (Last Monday in May) Independence Day (July 4) Labor Day(First Monday in September) Columbus Day (Second Monday in October) Veteran's Day (-November 11) Thanksgiving Day Friday after Thanksgiving Day Christmas Day (December 25) 9 Two (2) Floating Holidays Effective December 1991, Christmas Eve Day shall be observed as a holiday when Christmas Day falls on Tuesday, Wednesday, Thursday, or Friday. Employees in the unit shall not be allowed to carry holidays over from one calendar year to the next, Holidays not taken by December 31" of any given year shall be paid off during January of the year following the year in which the holidays were accrued. Holiday pay shall be compensated at eight (8) hours per holiday, Those employees working more than eight (8) hours per day (flexible work schedule) have the option of being compensated for the remaining hour/hours with, accrued compensatory time, accrued floating holiday hours or accrued vacation. ARTJCLE 24- BEREAVEMM.LEAYE Employees -who are represented by this unit shall be eligible for two ) days paid leave in the event of the death in the immediate family. In addition, eligible employees may be allowed to use accrued sick leave with full pay not to exceed three (3) days. Immediate family shall be defined as the following relatives to either the employee or spouse: spouse, child, parent, grandparent, brother and sister. ARTICLE 25,- MILITARYLEAVE The City and the Association agree to adhere to all provisions of Federal and State regulations pertaining to military leave. ARTICLE 26- COMPENSATORY TIME-QEE Effective July 1, 1980, the City shall provide each employee in the unit with the option, at the discretion of the employee, of receiving overtime compensation in the form of compensatory time off (CTO) or cash. Affected employees shall be authorized to accumulate no more than three hundred twenty (320) hours of CTO during any calendar year. If at any time during a calendar year, an affected employee has already accumulated three hundred twenty (320) hours of compensatory time, then overtime payments shall be made in cash. All accumulated CTO shall be utilized within twelve (1 2) months of the time it is carried. Consistent with both the reasonable requirements of police administration and the provision of this paragraph, affected employees shall be authorized to utilize the accurnufated CTO for any purpose, The City agrees that it shall be at the discretion of the member of the unit to use, compensatory time off in lieu of vacation or holiday time. 10 Time off for the purpose of an illness will only be accounted for with accrued sick leave. A—RTICLE 27 ® LE—AYE OF ABSENCE WITHOUT PAY If an employee in the unit takes more than seven (7) accumulated days of leave without pay in a calendar year, commencing at the beginning of the eighth (8th) day of leave without pay and any day of leave without pay thereafter during the calendar year; sick leave and vacation accruals will be adjusted proportionately to eliminate benefit accruals for any day an employee is on leave without pay status. ARIJ!CIE 28- FAMILY LEAVE The City will grant family leave in accordance with the Moore-Brown-Roberti Family Rights Act of 1993 and the Federal Medical and Family Leave Act. ARTMLE.22.- WELLNESSkR.OGRAM Members of the unit will be eligible to participate in, the City's current wellness program with Family Fitness Center, in accordance with proarn participation guidelines. ARTICLE 30-W—Q-RKAEEK All employees assigned to one of the Patrol Teams shall work a 3/12 work week consisting of three (3) consecutive work days of 12.5 (twelve and one- half) consecutive work hours, followed by four (4) consecutive days off each week(except instances of shift rotation). Each employee shall also work an additional 10 (ten) hour day in each 28 (twenty-eight) day period. The scheduling of the 10 (ten) hour day shall be at the department's discretion, but every effort will be made to schedule these hours on day/days that is/are, contiguous with the Officer's scheduled workweek. Department necessity will be the standard for scheduling of these hours. All employees assigned to a unit other than one of the regular Patrol Teams shall work- a 4/10 consisting of four (4) consecutive workdays of ten (1 0) consecutive hours followed by three (3) consecutive days off each week or Patrols 3/12 schedule at the discretion of the Chief. ARTI—C E 31 -POLICEpun—OTHLIUNWIPAL DUTY Effective January 1, 1977„ an employee in the unit who perfornis services for an individual or organization other than the City of Redlands for which the City of Redlands 11 has the night to bill for such services shall be paid at the rate of one and one-half times (11/2) the then existing hourly rate of the affected perfortning the service. ARTICLE 32 -CORP-01RALIUNK The parties hereby agree that the rank of Police Corporal shall be assigned the same base wage range as that assigned to the rank of Police Investigator. ER.OVISIONS The Association agrees thatit will not authorize, instigate, aid, condone, or engage in any strike which will interrupt or interfere with the operation of the City. The City places the Association on notice of its intention and right to terminate any employee who instigates or engages in any strike or work stoppage which interrupts or interferes with the operation of the City. AR-11CLE 34 - PREVAILING BENEFITS Except as provided herein, all wages, hours and other terms and conditions of employment presently enjoyed by employees in the it shall remain in full force and effect during the term of this I. .U., unless mutually agreed to by both parties. ARL1_CLF,a5_- SAVINGSACLAUSE Should any provision of this agreement or the application of such provision be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the City and Association shall meet and confer immediately upon what constitutes an equivalent benefit to that which was determined to be unlawful. Such equivalent benefit will be implemented retroactive to the date the old benefit ceased. McHugh, City Attorney, and authorized the Mayor and City Clerk to sign the agreement on behalf of the City. Contract Amendment - City—N-lanagler - On motion of`Councilmember George, seconded by Councilinember Haws, the City Council unanimously approved the first amendment to the employnient agreement Nvith John Davidson, City Manager, and authorized the Mayor and City Clerk to sign the agreenient on behalf of the City. Funds - Lease-Purchase - Police Vehicle - On motion of Councili-riember George, seconded by Councilinember Haws, the City Council unanimously approved a lease-purchase agreement with Ford Motor Credit Company for one Ford Crown Victoria police vehicle and authorized an additional appropriation in the amount of $8,617.80 for the first payment on the three-year lease- purchase agreernent and authorized the Mayor and City Clerk to sign the agreement on behalf of the City. East Valley Community Justice Center Pr ct - Cin motion of Councilmernber George, seconded by Councilmember Haws, the City Council unanimously approved a forrrial, expression of support of the East Valley Community Justice Center as proposed by the Redlands Police Department mid authorized the Chief of Police to coordinate the preliminary planning of the project with various City staff and elicit support and funding for the project. Ai4reernent - Wastewater Treatment Plan - On inotion of Councillnefriber George, seconded by Councilmember Haws, the City Council unanimously approved Task Order No. 4 of' the master services agreement with Carollo Engineers to provide engincel-Ing sei­vices for nitrogen removal, planning and permit compliance support and authorized the Mayor and City Clerk to sign the agreement on behalf of the City. MOU - RPO A - On motion of Counci]in ember George, seconded by Councilinerriber lla-vvs, the City Council unanimously ratified the Memorandum of Understanding with the Redlands Police Officers' Association and authorized the Mayor and City Clerk to sign the agreement on behalf of the City.
