HomeMy WebLinkAboutContracts & Agreements_167-2013_CCv0001.pdf SIDE LETTER To AMEND CURRENT MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF REDLANDS(CITY)AND THE REDLANDS PROFESSIONAL PURPOSE: The City of Redlands (City) and the Redlands Professional Firefighters Association (RPFA) agree to amend the Memorandum of Understanding effective July 1, 2012 -June 30, 2015 to provide corrections and clarifications to previously agreed upon language, as follows: PROVISION: The current provision, Article 47'S|cx LEAVE, Section 47D8-Accno4L PxvxxEmr UPON RETIREMENT, paragraph Bisasfollows: Section 47.03 ACCRUAL PAYMENT UPON RETIREMENT A. Upon service or medical retirement under the PERS retirement plan, or in the event of the death of an employee prior to retirement employees with less than twenty (20) years service with the City may elect one (l) of the following options for payment of unused sick leave: 1. Convert all remaining sick leave accrued at the time ofretirement to cash value at the final rate of pay and apply said cash value to applicable premiums payable under the City's medical insurance program for the employee and eligible dependents until the cash value isexhausted. inthe event that the employee dies prior tuexhaustion of the cash value of said benefits, the remaining cash value may be applied towards the premiums of covered dependents until exhausted,subject to the conditions and limitations ofthe applicable insurance policy. 2. At the time of service retirement, disability retirement, or at the death of an active employee, accrued sick leave may be cashed out otthe prevailing hourly rate at three-percent(39&)for each year ufservice toamaximum nfIUOY6. 3' Atthe time of retirement or disability retirement extend sen/ice credit equal to one hundred percent(100%)ofaccrued sick leave onthe books. B. Affected employees also have the option of being compensated for unused sick leave on the books atthe time ofretirement byeither option 2or]above. Therefore, to provide correction and clearly state previously agreed upon language, the following language is provided to replace Article 47-SICK Lsxvs, Section 47.03-A[CnoALPxvmswT UPON RETIREMENT, paragraph B: Section 4Z03 ACCRUAL PAYMIENTUPON RETIREMENT A. Upon service or medical retirement under the PERS retirement plan, orinthe event of the death of an employee prior to retirement, employees hired prior to City Council adoption of the 2012-20I5 K8OU who have served a minimum of twenty (20) years service with the City, shall be provided lifetime health insurance in accordance with Article 31 Section G. In addition, employees hired prior to City Council adoption of the 2012-2015 MOU also have the option of being compensated for unused sick leave on the books atthe time ofretirement byeither option Zor3above.
