HomeMy WebLinkAbout8011 RESOLUTION NO 8011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO VACATE EXCESS RIGHT-OF-WAY FOR A PORTION OF ORANGE AVENUE WHEREAS, 1600 Orange Avenue, LLC, has submitted an application requesting vacation of an approximately 1,236-foot long strip of excess public right-of-way, seven-feet- wide, along the north side of Orange Avenue between Alabama Street and Iowa Street (adjacent to County of San Bernardino Assessor Parcel Numbers 0292-167-12-0000, 0292-167-25-0000 and 0292-167-18-0000), and to vacate a 618-foot long strip of excess right-of-way, seven-feet- wide, along the south side of Orange Avenue west of Alabama Street (adjacent to County of San Bernardino Assessor Parcel Numbers 0292-168-22-0000, 0292-168-16-0000 and 0292-168-03- 0000) (Street Vacation No 171), and WHEREAS, the City is authorized to vacate all or part of a public street or public service easement within the City pursuant to Streets and Highway Code section 8300 et seq , and WHEREAS, pursuant to Section 8340 of the Streets and Highways Code, the City may for public convenience and necessity, reserve and except public service easements from a street vacation, and WHEREAS, the City, exercising its own independent judgment and analysis, has prepared an Initial Study for the Luxview Apartments project (Amendment No 40 to Specific Plan 45, Conditional Use Permit No 1108, Tentative Tract Map No 20244), pursuant to the California Environmental Quality Act ("CEQA"), which this street vacation is a part of, and found that, with the incorporation of mitigation measures, there is no substantial evidence that the proposed street vacation may have a significant effect on the environment, and a Mitigated Negative Declaration has been prepared in accordance the State CEQA Guidelines, and WHEREAS, the City Council intends to vacate the excess right-of-way as more particularly described in Exhibit "A," which is attached to this resolution and incorpoiated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1 The City Council hereby declaies its intention to vacate that portion of Orange Avenue described in Exhibit "A," attached hereto Section 2 The proposed Luxview Apartments project is subject to CEQA, of which this street vacation is a part The City has prepared an Initial Study and, with the incorporation of mitigation measures, there is no substantial evidence that the proposed street vacation may have a significant effect on the environment, and a Mitigated Negative Declaration has been prepaied m accordance with the State's CEQA Guidelines Section 3 The City Council will conduct a public hearing on the subject of the proposed vacation at a regularly scheduled public meeting of the City Council on December 3, 2019, beginning at 6 00 pin, or as soon thereafter as the matter may be heard, to be held in the City Council Chambers located at 35 Cajon Street, Suite 2, Redlands, California 92373 1 I 1Fiesoluuons\Res 8000 8099/801 I Street Vacation Intent to Vacate(1)docx.jn Section 4 The City Clerk shall give notice of the public hearing on the public hearing on the proposed vacation by a.
