A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING ITS INTENTION TO VACATE EXCESS RIGHT-OF-WAY OF A
PORTION OF PARK AVENUE
WHEREAS, NYS LLC, as the authorized agent foi the owner of the property located at
1615 Park Avenue, has submitted an application requesting vacation of a portion of excess street
right-of-way, approximately 330 lmeai feet in length, adjacent to the frontage of the parcel located
at 1615 Park Avenue (APN 0292-192-19-0000), and
WHEREAS, the City may vacate all or part of a public street pursuant to Streets and
Highway Code section 8300 et seq and, pursuant to Streets and Highways Code Section 8340,
the City may for public convenience and necessity reserve and except public service easements
from a street vacation, and
WHEREAS, the proposed stieet vacation qualifies for an exemption from enviromnental
review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to
Section 15061(b)(3) of the State CEQA Guidelines for projects where there is no possibility of
any significant environmental effects, and
WHEREAS, at its ineetmg on October 22, 2019, the City's Planning Conunission made a
detemmmation that the proposed street vacation will conform to the City's General Plan, and
WHEREAS, the City Council intends to vacate the excess right-of-way, as more
particularly described in Exhibits "A" and "B" to this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS
Section 1. The City Council hereby declares its intention to vacate that portion of Park
Avenue described m Exhibits "A" and "B," which are attached hereto and incorporated herein by
refei ence
Section 2 The proposed street vacation of a portion of Palk Avenue is exempt from
environmental review in accordance with Section I5061(b)(3) of the State CEQA Guidelines
Section 3 The City Council will conduct a public hearing on the pioposed street
vacation at a regularly scheduled public meeting of the City Council on December 17, 2019,
beginning at 6 00 p in 01 as soon thereafter as the matter may be heard, to be held in the City
Council Chan -the' s located at 35 Cajon Street, Suite 2, Redlands, California 92373
Section 4. The City Clerk shall give notice of the public hearing on the public hearing
on the proposed vacation by
A Publishing notice in the Redlands Daily Facts, for two successive weeks prior to the
heat sing, and
B Postmg notices of the proposed street vacation conspicuously along the portion of Park

Avenue to be vacated at least two weeks prior to the date set for the public hearing The
notices shall be posted no more than 300 feet apart, and at least three such notices shall
be posted The notices shall reference the adoption of this Resolution of Intention and
shall state the date, tune, and place of the street vacation hearing

GRANT OF ROADWAY EASEMENT
This Grant of Roadway Easement is entered into by and between
UNITED STATES POSTAL SERVICE, A TAX-EXEMPT, INDEPENDENT ESTABLISHMENT OF
THE EXECUTIVE BRANCH OF THE FEDERAL GOVERNMENT
and the City of Redlands, a Municipal Corporation (herein "City") duly organized in accordance
with the laws of the State of California
For valuable consideration, receipt of which is hereby acknowledged
UNITED STATES POSTAL SERVICE, A TAX-EXEMPT, INDEPENDENT ESTABLISHMENT OF
THE EXECUTIVE BRANCH OF THE FEDERAL GOVERNMENT
hereby grants to the City of Redlands an irrevocable roadway easement over that certain real
property ("Easement Area"), described on Exhibit "A" and shown on Exhibit "B" attached hereto,
for the following purposes.
A Right-of-way at any time, or from time to time, to construct, maintain, operate
replace, and renew the roadway described on Exhibit "A" and shown on Exhibit "B", and
appurtenant structures in, upon and across said Easement Area or any part thereof, and
Ingress and egress Over the Easement Area for vehicular or pedestrian traffic
