PARTIES AND DATE. 1 . 1 This Agreement entered into in the City of Redlands , State of California, this 19th day of April, 1983 , between the City of Redlands , a municipal corporation ("City") and the Redevelopment Agency of the City of Redlands , a public body ("Agency" ) . 2 . RECITALS. 2. 1 Agency has been established within City under authority of the California Community Redevelopment Law pursuant to Ordinance No. 1436 of the City adopted on April 6 , 1971. 2 . 2 Agency has undertaken a program under the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq . ) for the redevelopment , replanning and redesign of blighted areas with stagnant , improperly utilized and unproductive land requiring rede- velopment in the interest of the health, safety, and general welfare of the people of the City of Redlands . 2 . 3 City and Agency have previously entered into certain agreements between themselves to provide mutual aid and assistance in the redevelopment of certain areas of City and City and Agency have a common interest in and wish to facilitate redevelopment within City and to provide for the cooperation of City and Agency in carrying out redevel- opment activities . 2.4 City and Agency, in consideration of these mutual undertakings , desire to provide for the financ- ing of the redevelopment of certain areas of City. NOW, THEREFORE, in consideration of the foregoing and the mutual promises and convenant-s contained herein, the parties hereto agree as follows : 3. TERMS . 3 . 1 Administrative Fund. City will establish a Community Redevelopment Agency Administrative Fund to be maintained in the treasury of City as authorized by Health and Safety Code Section 33610 , et seq. , with money appro- priated to that fund to be paid to Agency as a loan to be repaid upon the terms and conditions as may be established by the City Council of City . 3 . 2 Use of Services and Facilities . The Agency shall have access to the services and facilities of the City and City Staff. The Planning Commission of the City of Redlands shall also cooperate with the Agency in providing for redevelopment activities and other assistance to the Agency within the City. 3 . 3 Reimbursement . Agency agrees to reim- burse City for services rendered to Agency and for costs -2- incurred by City on behalf of Agency, which amounts may include the payment of a part of the salaries of City officers and employees , where such officers and employees perform services for Agency. No officer or employee of City shall be entitled to extra compensation for work performed for Agency unless such compensation is authorized by the City Council of the City of Redlands . 3 .4 Loans From Administrative Fund. All sums paid by City from the Community Redevelopment Agency Administrative Fund shall be deemed loans to Agency, to be repaid to City at such times as funds become available to Agency for repayment . Any such sums advanced as loans shall bear interest at a rate of interest per annum to be deter- mined by the City at such time as funds are allocated to the Agency pursuant hereto and shall bear interest at such hereafter designated rate from the date of payment by City. Repayment of such loans need not be made by Agency until all other debts or obligations of the Agency which may hereafter be incurred by it have been satisfied, and the repayment obligation of Agency shall be subordinate to any interim or permanent financing of Agency. 3 . 5 Redevelopment Revolving fund. City will establish a Redevelopment Revolving Fund to be maintained in the treasury of City as authorized by Health and Safety Code Section 33620, et sect . , with money appropriated to that fund to be paid to Agency as a loan to be repaid upon the terms -3- and conditions as may be established by the City Council of City. 3 . 6 Repayment of Revolving Fund Loans . Agency agrees to reimburse City for moneys expended from the Redevelopment Revolving Fund upon majority vote of the City Council for the purposes of the acquisition of real property in any project area, the clearance , aiding in relocation of site occupants , and preparation of any project area for redevelopment . Upon two-thirds vote of the City Council, moneys deposited in the Redevelopment Revolving Fund may be paid to Agency, upon such terms and conditions as City Council may prescribe for the purpose of depositing such moneys in a trust fund to be expended for the acquisition of real property in any project area, the clearance of any project area for redevelopment , and any expenses necessary or incidental to the carrying out of a redevelopment plan which has been adopted by City. All sums paid by City from the Redevelopment Revolving Fund shall be deemed loans to Agency, to be repaid to City at such times as funds become available to the Agency for repayment . Repayment of such loans need not be made by Agency until all other debts or obligations of Agency which may -4- hereafter be incurred by it have been satisfied, and the repayment obligation of Agency shall be subordinate to any interim or permanent financing of Agency . 3 . 7 Mutual Assistance. City will assist the Agency in the planning, financing, acquisition, construction and maintenance or operation of redevelopment activities undertaken by Agency within City in accordance with applic- able state and federal law.
