HomeMy WebLinkAbout8051 RESOLUTION NO 8051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS IMPLEMENTING AND INTERPRETING THE PROVISIONS OF THE VOTER APPROVED INITIATIVE ORDINANCE COMMONLY KNOWN AS MEASURE U BY DETERMING THAT APPPLICATIONS FOR NONRESIDENTIAL DEVELOPMENT PROJECTS FILED BY NONPROFIT ORGANIZATIONS SHALL BE EXEMPT FROM THE REQUIREMENT FOR PREPARATION OF A SOCIO-ECONOMIC COST/BENEFIT STUDY WHEREAS, on Novembei 4, 1997, the voters of the City of Redlands approved Measure "U", an initiative ordinance of the City of Redlands, which amended the City's Geneial Plan, and WHEREAS, the results of the November 1997 election were certified on December 2, 1997, and the provisions of Measure "U" became effective on December 12, 1997, and WHEREAS, Section B 3 of Measure "U" provides an express exemption from socio- economic cost/benefit study requirements for development projects that, among other things, directly furthei the primary institutional purposes of non-profit organizations such as churches, hospitals, schools (mcludmg private schools and universities), and the YMCA and YWCA by providing certam recognizable intangible benefits and services to the community, so long as such development projects are either (1) non-residential in character, or (2) provide only dormitory, staff housing or senior congregate care facilities foi those exempt entities, and were constructed on properties owned by the non-profit organization as of a specified date in 1997, and WHEREAS, on December 1, 1998, the City Council adopted Resolution No 5579 which implemented and interpreted Measure U by fa st determining that only "development projects" which are submitted to the City and have specific building design or construction plans with one of the listed entitlements shall be required to prepare a socio-economic analysis and cost/benefit study to determine the fiscal impacts upon, and general benefits accruing to, the City, and WHEREAS, consistent with the afoiementioned express exemption of Measure U in Section B 3, development projects undertaken in the future by non-profit organizations, on property then-owned by such organizations and that are non-residential in character, will also provide intangible benefits and services to the community, are exempt from the payment of property taxes, and accordingly do not typically provide a revenue stream to the City such that a socio-economic study and cost/benefit analysis does not provide any meaningful analysis cost benefit study provides any meaningful fiscal analysis of the benefits provided by such organizations to the City and its residents, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS - Section 1. The City Council hereby determines that the adoption of this Resolution is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to Section 15061(B)(3) of the State CEQA Guidelines because it can be seen with certainty that there is no possibility that such adoption may have a significant effect on the environment 1 1 1Resolutions\Res 8000 8099/8051 Measure U Development Projects 12 3 19.docx Section 2.
