OF ORANGE AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO 171) WHEREAS, 1600 Orange, LLC , has submitted an application requesting vacation of a 1,236-foot long strip of excess public right-of-way, along the north side of Orange Avenue between Alabama Street and Iowa Street (adjacent to APNs 0292-167-12-0000, 0292-167-25- 0000 and 0292-167-18-0000), and to vacate a 618-foot long strip of excess right-of-way the south side of Orange Avenue west of Alabama Street (adjacent to APNs 0292-168-22-0000, 0292-168-16-0000 and 0292-168-03-0000) in the EV/2500RM (Multiple Family Residential) District of the East Valley Corridor Specific Plan, and WHEREAS, the City is authorized to vacate all or part of a public street or public service easement within the City pursuant to the Public Street, Highway and Service Vacation Easements law (State of California Streets and Highway Code, Section 8300 et seq ), and WHEREAS, pursuant to Section 8340 of the California Streets and Highway Code, the City may for public convenience and necessity reserve and except public service easements from a street vacation, and WHEREAS, at its September 30, 2019 meeting, the Planning Commission made a determination that the street vacation conforms to the City's General Plan, and WHEREAS, on November 5, 2019, the City Council of the City of Redlands adopted Resolution No 8011, declaring its intention to vacate such portion of Orange Avenue, described in Exhibit A, attached, and set a public hearing date and time for the proposed vacation, and WHEREAS, Street Vacation No 171 was included in the analysis provided in the Mitigated Negative Declaration (MND) prepared for the Luxview Apartments project (Tentative Tract Map 20244 and Commission Review and Approval No 914), which was adopted for this 1 I\Resolutions\Res 8000 8099`8049 Street Vacation No 171 doc DOC#2019-0448732 Page 3 of 11 project on October 15, 2019, in accordance with the California Environmental Quality Act (CEQA), and WHEREAS, In accordance with Sections 15162 and 15164 of the CEQA Guidelines, no additional or further environmental review is required for this request, as it is within the scope of the approved entitlements and environmental analysis, and WHEREAS, pursuant to section 8320 of the Streets and Highways Code of the State of California, the City Clerk of the City of Redlands subsequently caused the publishing of notices in the Redlands Daily Facts, for two successive weeks prior to the hearing, and the posting of notices along the lines of the portion of right-of-way at least two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted, and WHEREAS, on December 3, 2019, the City Council held a duly noticed public hearing on the proposed vacation and considered all verbal and written testimony provided by persons interested in the proposed vacation, THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows Section 1 In accordance with Sections 15162 and 15164 of the CEQA Guidelines, no additional or further environmental review is required for this request, as it is within the scope of the approved entitlements and environmental analysis, and Section 2 The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapters 1 through 3, inclusive, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that a 1,236-foot long strip of excess public right-of- way, along the north side of Orange Avenue between Alabama Street and Iowa Sheet, and a 618- foot long strip of excess right-of-way the south side of Orange Avenue west of Alabama Street as more specifically described in Exhibit "A" attached hereto and made a part hereof(the "Right-of- Way") is unnecessary for present or prospective public use and that the public interest and convenience require the vacation of that portion of the Right-of-Way and the termination of the public right to use the Right-of-Way Section 3 The City Council hereby orders the vacation of a portion of the Right-of- Way described and depicted in the attached Exhibit "A" Section 4 Pursuant to Section 8340 of the Streets and Highways Code of the State of California, in connection with the vacation of a portion of the Right-of-Way described in the attached Exhibit "A," the City of Redlands reserves and excepts from such vacation a permanent easement for in-place public utility facilities that are in use as of the effective date of this resolution to maintain, operate, replace, remove, and renew such in-place utilities in, upon and over the portion of the Right-of-Way proposed to be vacated Section 5.
