ROBERTS, R.S. , MPH, Director Department of Environmental Health Services SUBJECT: CONTRACT WITH CITY OF REDLANDS TO OPERATE A HOUSEHOLD HAZARDOUS WASTE COLLECTION CENTER RECOMMENDATION: Approve an agreement with the City of Redlands to jointly operate, with the Department of Environmental Health Services , a household hazardous waste collection center in Redlands . REASON FOR RECOMMENDATION: Every day, households generate hazardous wastes which may pose a threat to public health and groundwater if disposed into municipal sewer systems , municipal refuse disposal sites , or septic systems . This project expands the household hazardous waste collection system to the Redlands area through a joint effort of County Environmental Health Services and the City of Redlands Fire Department. FINANCIAL IMPACT: No impact to Environmental Health Services net county cost or appropriations . This program is included in the FY 86/87 budget with costs offset by revenue from the City. Set forth service to be rendered,amount to be paid,manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination, other terms and conditions,and attach plans,specifications,and addenda,if any.) THIS CONTRACT, between the City of Redlands and the County of San Bernardino, provides for the County' s Department of Environmental Health Services to provide technical service to assist in the operation of a Household Hazardous Waste Collection Program within the City of Redlands during the period November 1 , 1986 , and June 30, 1987 . THIS AGREEMENT, is made and entered into between the County of San Bernardino, herein after referred to as "County" and the City of Redlands, herein after referred to as "City" . WITNESSETH WHEREAS , the County Department of Environmental Health Services is prepared to assist in the operation of a household hazardous waste collection center and the City desires to arrange for such services within the City boundaries ; THEREFORE, it is agreed and covenanted by these parties as follows : I THE COUNTY SHALL, by and through its Environmental Health Services Department : 1. Secure a safe storage shed which meets California Department of Health Services ' standards for the storage of hazardous waste. 2 . Assume responsibility for obtaining the necessary site permits . Further, the DEHS will train City of Redlands Fire Department personnel and provide an operation manual which designates 021-12311-000 Rev. 11/80 P_aoe_L .1-i- wastes to be accepted, defines a categorization scheme for wastes anticipated , and specifies emergency procedures to be followed. 3 . Arrange for the delivery of 55 gallon, DOT approved drums, sufficient absorbent material for the disposal of the waste and all required labels for the drums. 4 . Prepare all manifests for disposal and arrange for the removal of the wastes by a licensed waste hauler for disposal at a Class I disposal site. 5 . Be responsible for and indemnify, defend and hold harmless City from any claim or judgment for damages arising from injury or damage caused by County employees , or injury or damage caused in the course of normal, non-negligent operations of this project, that is operations carried out correctly and within the rules and guidelines issued by the DEHS for such operations . II CITY SHALL: 1 . Pay to the County an amount to cover actual costs of materials , transporation and disposal of waste collected. Payment shall be in two installments, $5 , 000 within 30 days of initiation of the project to cover the costs of the storage shed and necessary supplies; the remainder to be paid at the end of the fiscal year and shall cover actual costs of materials and services incurred by the County, the amount not to exceed $13, 600 . 2 . Operate a Household Hazardous Waste Collection Center at the Redlands Corporation Yard, Redlands , California, in accordance with DEHS established procedures . Employees of the City will accept the specified wastes at least one day each month at times agreeable to City and County. Employees of the City will label, categorize, and pack waste in accordance with DEHS requirements . The waste will be stored in their original containers in labeled 55 gallon drums inside a storage shed to be located within the locked gates of the facility. 3 . Be responsible for providing workers compensation for any and all of its employees or volunteers under a state approved policy or self insured program. 4 . Be responsible for maintenance of property and the safety of persons and property on City land where the project is carried on, subject to the provision of paragraph 1 ( 5 ) above. 5 . Shall indemnify, defend, and hold harmless County from any claim or lawsuit damages arising from any action or non-action of any city employee, occurring on city project property when: ( 1) no county employee is involved, and ( 2) when the action or non- action is not directly involved with the project, such as, but not limited to, general cleaning and maintenance of the premises . Page 2 of 4 Estimated project cost for Redlands Household Hazardous Waste Collection Program, to be operated at the Redlands Corporation Yard. These estimates are based on the following assumptions : 14 , 500 residential collection service users paying 10<.-/month additional collection fee; 8 month program, November 1, 1986 - June 30, 1987 Waste Collected; initial 2-4 weeks 7 drums monthly, thereafter 3 drums . Fire Department administrative and operation services will be provided on an in-kind basis , unless there is a surplus . County Department of Health Services ' services will be provided on an in-kind basis , unless there is a surplus . Project Costs : Operating Expenses : Disposal Costs $250 drum $ 7 , 000 Publicity 2 , 000 Subtotal $ 9 , 000 Capital Expenses : Storage Facility and Safety Equipment 4 , 600 Total .$13 , 600 Revenues : Monthly City Refuse Surcharge $11, 600 LWV Grant from Golden Empire 2 , 000 /aop Page 3 of 4 TERM AND TERMINATION THIS AGREEMENT, shall be in effect November 1, 1986, and shall remain in effect through June 30 , 1987 , but may be renewed for successive months, unless , otherwise terminated or amended. Not- withstanding the foregoing, either party may terminate this contract at any time upon 30 days prior written notice to the other party.
