HomeMy WebLinkAbout8054Recording requested by and when recorded return to CITY CLERK'S OFFICE CITY OF REDLANDS P O BOX 3005 REDLANDS, CA 92373 Electronically Recorded in Official Records County of San Bernardino Bob Dutton Assessor Recorder -County Clerk DOC# 2019-0471762 12/20/2019 Titles 1 Pages 5 02 38 PM SAN Fees $0 00 Taxes $0 00 V0956 CA SB2 Fee 0 00 Total $0 00 (THIS SPACE FOR RECORDER'S USE ONLY) RESOLUTION NO 8054 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF PARK AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SMD EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO 172) WHEREAS, NYS, LLC, as the authorized agent for the property owner for 1615 Park Avenue, has submitted an application requesting vacation of a portion of excess right-of-way, approximately 330 lmear feet in length, adjacent to the frontage of the parcel located at 1615 Park Avenue (APN 0292-192-19-0000) in the M-1 (Light Industrial) District, and WHEREAS, the City is authorized to vacate all or part of a public street or public service easement within the City pursuant to Streets and Highway Code section 8300 et seq , and WHEREAS, pursuant to Section 8340 of the Streets and Highway Code, the City may for public convenience and necessity reserve and except public service easements from a street vacation, and WHEREAS, at its October 22, 2019 meeting, the Planning Commission made a detennmation that the street vacation conforms to the City's General Plan, and WHEREAS, at its November 19t11 meeting, and pursuant to the Streets and Highways Code section 8320, the City Council adopted Resolution No 8041 for the Notice of Intent to Vacate, set the date and time of a public hearing to vacate such portion of Park Avenue, described in Exhibit "A," attached, and WHEREAS, in accordance with Streets and Highways Code section 8320, the City Clerk of the City caused the publishing of notices in the Redlands Daily Facts, for two successive weeks prior to the hearing, and the posting of notices along the lines of the portion of right-of- way at least two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted, and WHEREAS, the proposal qualifies for exemption from environmental review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to Section 1 1 \Resolutions\Res 8000 8099\8054_ Street_Vacation_No_172 doc.jn DOC #2019-0471762 Page 2 of 5 15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any enviionnental effects, and WHEREAS, on December 17, 2019, the City Council held a duly noticed public hearing on the proposed vacation and considered all verbal and written testimony provided by persons interested in the proposed vacation, THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows Section 1 The proposed vacation of a portion of street right-of-way is exempt from environmental review m accoidance with Section 15061(b)(3) of the State CEQA Guidelines Section 2 The City Council hereby finds from all evidence submitted that a portion of excess right-of-way, approximately 330 linear feet m length, adjacent to the frontage of the parcel located at 1615 Park Avenue, and as more specifically described in Exhibit "A" attached hereto and made a part hereof (the "Right -of -Way") is unnecessary for present or prospective public use and that the public interest and convenience require the vacation of that portion of the Right -of -Way and the termination of the public right to use the Right -of -Way Section 3 Pursuant to Streets and Highways Code section 8340 of the State of California, in connection with the vacation of a portion of the Right -of -Way described in the attached Exhibit "A," the City of Redlands reserves and excepts from such vacation a permanent easement for in-place public utility facilities that are in use as of the effective date of this resolution to maintain, operate, replace, remove, and renew such m -place utilities in, upon and over the portion of the Right -of -Way proposed to be vacated Section 4 Pursuant to Section 892 of the Streets and Highways Code of the State of California, the portion of the Right -of -Way proposed to be vacated is not useful as a non -
