HomeMy WebLinkAboutContracts & Agreements_225-2013_CCv0001.pdf Fundina Agreement for Prosl2ect Park Beautification This Funding Agreement for Prospect Park Beautification ("Agreement")is made this 5th day of November, 2013 ("Effective Date") between Friends of Prospect Park ("FOPP") and the City of Redlands ("City") for the purpose of providing funds to City for additional City work force labor for the purpose mfenhancing the maintenance Ofand beautifying Prospect Park. F[}PPand City are sometimes individually referred toherein as a "Party" and, together, 3sthe "Parties." In consideration of the mutual promises contained herein, FOPP and City agree as follows: Section 1. FOPP agrees to provide funds for a part time park maintenance employee for approximately twenty(20) hours per week at an hourly rate to be determined by City, which includes all required direct payroll related costs, such as workers' compensation insurance, payroll taxes, and other employment costs incurred byCity, but not including supervision Oroverhead expenses.The park maintenance worker shall perform the tasks more fully described in Attachment I of this Agreement. In addition, FOPP agrees to provide funds for landscape plantings for the landscape areas identified in Attachment 2ofthis Agreement. FOPPmay provide funds for additional landscape plantings, with the prior approval ofthe FUPP'srepresentative orher designee. The total funding under this Agreement shall not exceed $20,000 per year. FOPP funding is provided to enhance the level of maintenance currently being provided to the park by City, and is not intended to replace current levels of maintenance provided byCity. Section 2. The term ofthis Agreement shall befor aperiod ofone year, commencing Onits Effective Date and may be renewed for additional one year terms by written amendment to this Agreement executed by authorized representatives of the Parties. Notwithstanding the foregoing, FOPPmnay terminate this Agreement upon thirty (30) days prior written notice if the quality of work performed under this Agreement does not meet the standards OfFOPP. Prior tDexercising the right toterminate, FOPP shall meet with City staff to review areas of deficiency and provide City a period of thirty (30) days to correct any deficiencies. City may terminate this Agreement 3tanytime upon thirty/30\days prior written notice toF(]PP. Section 3. In addition to the work provided under this Agreement,other Prospect Park landscaping, renovation orimprovement projects may beadded with approval Ofthe authorized representatives of the Parties. Section 4. FOPP will make payments monthly in arrears to City within ten (10)days of receipt of receiving invoice. FOPP and City representatives shall meet to discuss progress under this Agreement on a quarterly basis /dates of which to be agreed upon by the Parties), or at the request ofeither Party to discuss any concerns related to the work to be performed under this Agreement. Section 6. Asa funding source only, FOPP, its officers, directors, and assigns shall not be liable for any acts, errors,oromissions ofthe park maintenance worker tVbe hired bVCity. Section 7. Plant and maintain gardens and grounds A,U,asneeded tokeep attractive, weed free,and mulched. See Attachment 2, map. 2. Remove plants;vine etc from 10 foot radius at base of all newly planted trees in park area. 3. Mulch cleaned out tree base areas oftrees. 4. Remove and/or cut down overgrown vines and unwanted groundcover throughout park. Hau{awayor dumnpster. S. Remove unwanted plant debris (bamboo,vines,ground cover) between Pavilion and PP Carriage House. Haul away ordumnpster. 6. Maintain road and fence along split rail fencing of unwanted parkway debris(pine needles, etc) at Prospect Park Carriage House Road entrance. 7. Mulch all newly planted trees. Haul in mulch chips to park. 8. Deep water newly planted tree periodically. 9. Remove dead newly planted trees and re-plant asneeded. 10. Remove suckers off base ofornamental trees throughout park I1. Trim Cecile Brunner rose hedge. Haul away ordurnpnter 12. Remove weeds and clean up perimeter of PP Carriage House parking lot area and orange grove walking path. 13. Trim Solarium shrubs near restnoonosand Prospect Park Carriage House road entrance. 14. Trim,feed and mulch roses, asneeded. 15. Keep park free ofgraffiti. Difficult Advance Skill Level Jobs, Materials Needed 1. Maintain painted garden structures and benches, signs poles etc. using standardized colors throughout park. 2. Monitor and repair erosion areas on decomposed granite (DG) pathways and roads with City staff assistance. I Monitor, repair and work with City staff to install new irrigation lines: drips bubblers or risers as needed to: Landscaped areas such os:-LauerOverlook area trees, newly planted Redbudtrees inlower picnic area, Japanese Raisin tree area,Amphitheatre area trees, Prospect Park Carriage House Road.trees, Dr Hill's newly planted tree near restroomns, Carothers'sWay,etc. 4. Check and replace irrigation risers inUovverbeds,asneeded. Additional Minimal and Advanced Job Level to be considered includes: G. Thin out weed trees on lower picnic area hillside and green belt. (work with City staff Cal-fire contract) 6. Assisting with community volunteer work and work events in Prospect Park, as assigned. 7.
