hereby grants to Henry Ho Cole, of the County of San Bernard.irn-'
State of California., for himself, and as Trustee for the owner
of the waters of Mill Creek in said Cotu-it,, and State, a per-
petual right, -of -way in and thro,a h that certain Oorm water
ditch to be built by the City of Redlands along the line of
the f0ill Creek Zanja in said City, (the 14ap of said ditch being
on file in the Office of the Recorder of said County of
San Bernardino) , for the natural flow of the waters of said
'fill Creek, or such part or portion thereof as may be turned
into the upper end of said ditch by said Mill Creek owners
The said City oi, Redlands shall forever maintain and keep
in constant repair, at its own expense, the necessary and
proper arrangement for the delivery into the flume or Zanja
belonging to the said owners of Hill Cr�,ek (and novi sitUated
about one thousand (1000) feet west, from the West lino: of
First Street in said C ty of Redlands), of all the flow of
Mill Creek Water that tray be, turned into the upper end cif said
Zanja by said i,Till Creep owners, less the natural segiage and
evaporation, and said. Cit,-vr of pedl,�mds agreas to hold said
owners of Mill Creek harmless mad free — from all expense for
an;= loss or damage b� Storm or Waste Water r��nnin8 thm uji the
said Storm Water Ditch;
This conveyance is made on the furthe: condition that the
said Mi11 Creek owners waive any and all claims that they may
have to the right-of-way heretofore used to convey the waters
of Mill Creek from the point Where the waters of Mill Creek
Zanja enter I.,lie upper' end of said Stern Water Diiuch to the
head of the fLUie hereinbefore described.
