HomeMy WebLinkAboutContracts & Agreements_31-1987_CCv0001.pdf uS Deprjnrr*nt of Tronsporto4on Grant Agreement Federal A> tion Part 1 - Offer AdministrationApproved:OMB No. 2120-0065 Date of Offer SEP 2 1*7 Redlands Municipal AirportlPlanning Area Project Number: AIP No. 3-06-0195-01 Contract Number: DTFA08-87-C-20377 To: City of Redlands, California (herein called the"Sponsor") From: The United States of America (acting through the Federal Aviation Administration, herein called the 'FAA") Whereas,the sponsor has submitted to the FAA a Project Application dated July 105 1987 for a grant of Federal funds for a project at or associated with the Redlands Municipal Airport/Planning Area which Project Application, as approved by the FAA, is hereby incorporated herein and made a part hereof; and Whereas, the FAA has approved a project for the Airport or Planning Area (herein called the "Project") consisting of the following: Install fence (approx. 7,000 l.f.); realign west portion of parallel taxiway (approx. 1,400' x 40' ); construct aircraft parking apron (approx. 1,120' x 350' ), including tie-down anchors, fire hydrants(3 each with approx. 1,250 1.f. waterline), and lighting. all as more particularly described in the Project Application. It is understood and agreed by and between the parties hereto that this Grant Offer is made and accepted upon the basis of preliminary Plans and Specifications; and the parties agree that within 180 days from the date of acceptance of this Grant Offer, the Sponsor shall furnish final Plans and Specifications to the FAA, that no construction work will be commenced hereunder, and that no contract will be awarded for the accomplishment of such work until the said final Plans and Specifications have been approved y the FAA; and the parties do further agree that any reference made in this Grant Offer or in the aforesaid Application to Plans and Specifica- tions shall be considered as having reference to said final Plans and Specifications as approved. Page 3 of 4 pages The Sponsor's acceptance of this Offer and ratification and adoption of the Project Application incorporated herein shall be evidenced by execution of this instrument by the Sponsor, as hereinafter provided, and this Otter and Acceptance shall comprise a Grant Agreement,as provided by the Act,constituting the contractual obligations and rights of the United States and the Sponsor with respect to the accomplishment of the Project and compliance with the assurances and conditions as provided herein. Bloom Supervisor, Standards Section T" Part 11 - Acceptance The Sponsor does hereby ratify and adopt all assurances,statements, representations,warranties,covenants, and agree- ments contained in the Project Application and incorporated materials referred to in the foregoing Otter and does hereby accept this Offer and by such acceptance agrees to comply with all of the terms and conditions in this Offer and in the Project Application. In addition,for grants involving projects to be carried out on property not owned by the Sponsor,there are no legal impediments that will prevent full performance by the Sponsor. Lock Airport Manager Redlands Municipal Airport 1745 Sessums Drive Redlands, California 92374 Dear Mr. Lock: Redlands Municipal Airport, Redlands, CA AIP No. 3-06-0195-01 Grant Offer The Redlands Municipal Airport, Fiscal Year 1987 Airport Improvement Program (AIP) No. 3-06-0195-01, Contract DTFA08-87-C-24377, has been approved. Enclosed are the original and four copies of a Grant Offer, under which the United States commits itself to participate in the allowable cost of the project not to exceed $750,000.00. Your acceptance of the Grant Offer will obligate the City of Redlands, to accomplish the described development. An official of the Sponsor shall accept the offer on or before the date specified in Paragraph 6, Page 2 of the Grant Offer by signing the enclosed instruments in the space provided. The date of the execution of the Grant Offer should be the same as, or later than, the date of the resolution. The certificate of Sponsor's attorney shall be the same as, or later than, the date of execution. When the documents are fully executed, certified, attested, and appropriate seals impressed, lease return the original and three copies of the Grant Agree- ment to this office. Please note that the revised Federal Aviation Regulation (FAR) Part 152, effec- tive May 22, 1900, required that the acceptance of an Offer must be in writing and that the Sponsor's attorney must certify that the acceptance complies with all applicable law, and constitutes a legal and binding obligation of the Sponsor. '06 the basis of this revision, copies of any resolutions or ordinance authorizing acceptance need not be provided this office. Also enclosed is a revised copy of the assurances contained in Part V of the Project Application FAA Form 5100-100. These new assurances replace the ones you previously submitted.
