HomeMy WebLinkAboutDeeds & Easements_24-1892EM, -i E INDENTURE, made this ��9 '� - - d of 4_vOn *-L' 1903, between the SOUTHERN CALI- FOP TIA RAILWAY COMPANY, a corporation, :first party, and the CITY OF BEDLAM, a municipality, organized and existing under and by virtue of the laws of the State of California, second party. WHEREAS, the second party desires and pro- poses to widen Oriental Avenue, a public highway within its limits; and VHRREAS, in order to effect the proposed widening of said street or avenue it is necessary for the second party to have the use of the lands and prvai ses hereinafter described which belong to the first party, and WHEREAS, the first party is willing to convey said lands and premises to the second party for the uses and pur- poses, and upon the con itions hereinafter expressed: N014 THEREFORE, for and in consideration of the premises and of the stun of One Dollar ($l), lawful money of the United States to it in hand paid by the second party, the receipt whereof is hereby acknowledged, the first party does, for the uses and upon the conditions hereinafter ex- pressed,hereby remisc,release and quit -claim unto the sec - and party that certain lot, piece or parcel of land situated in the City of Redlands, County of San Bernardino, State of California, described as follows: 1 A stri-p or parcel of land. 20 feet in width and 250 feet in length situate in the City —of Redlands, County of San Bernardino, State of California, be- , ing the south 20 f eet of lots 14, 15, 16, 17 and 18 in Block "B" of Fairbanks and 7,11son's sub -division of part of lots 27 and 28, Block 77, Rancho San Bernardino, as said lots are shown and designated on map of said sub -division recorded in the office of the ;recorder of said San Bernardino County, in Fook 4 of Maps, at page 47. ..° TO HAVE AND TO HOLD said premises unto the second party upon the following conditions: 1. That said land above described shall be used and devoted to street purposes only by the second party. 2. That that certain street or avenue in said City of Redlands known as Silveria Avenue shall never be opened across the station grounds and tracks of the first party in said City of Redlands. 3. NOIV) =REFORE, This Indenture Wi tnesseth: That in consideration of the premises the first party does hereby give unto the second party and the public residing in said City of Redlands the right, license and privilege of using that portion of its station grounds in the City of Redlands, County of San Bernardino, State of Califor- nia., hereinafter described, and shown in yelloT color upon the blue. --print herto attached , marked "Exhibit A", hereby referr- ed to and made a, part hereof, as and for a drive -way from Or- iental Avenue to Silveria Avenue in said. City of Redlands, un- til the right, license and privilege hereby given shall be re- voked by the first party upon service of a notice in writing to that effect upon the second party; said written notice may be served upon the second party by enclosing the same in an F� envelope addressed to the Clerk of said City of Redlands, and deposited in any United States Post Office, postage prepaid, to take effect ton days after mailing. The lands and premises herein referred to are sit- uated in. the City of Redlands, County and State above Dzentior_ed and particularly described as follows: A portion of the Southern California Railway Compan; 's Station grounds in the City of Redlands, described as beginning at the northv,est corner of Lot 1, Block I'D„ of the Central To•b�si.'te Subdivision; thence west along the north end of Silveri.a, Avenue, end along the north line of Lot 2 of said Block I'D" of the Central Twarisite Subdivision, to the north- west corner of said Lot 2; thence south to a point 20 feet north- of the sovitheast corner of Lot 18, of Block "B", :Fairbanks & Wi lson's subdivision; thence west 20 feet; thence north, to a point 15 feet north of the prolongation of the north lire of said .Lot 2; thence east to a point 15 feet north of the place of beginning; thence south 15 feet to the place of beginning.
