There exists a temporary condition of groundwater 10 surplus in the pressure zone of the San Bernardino Basin Area, n upstream from the Bunker Hill Dike, resulting from recent a extraordinary hydrologic conditions, presenting a serious threat 0 of damage to property and injury to persons . It is in the public JA interest and in the interest of sound water resources management 0 that additional extractions in the area be made in order to lower 0 such groundwater levels and that Such temporary surplus be put to a beneficial use. 18 2. Municipal Districts have entered or expect to enter a into a water delivery agreement with Orange County Water Distvict 20 ("Orange County") tinder which Orange County will Pay for water 21 pumped from such area and discharged into the Santa Ana River at 22 times when it can be used to recharge groundwater resources within 23 Orange County. Pumper agrees to pump groundwater from the wej'-- or io wells identified on Exhibit "A" and discharge such groundwater to ii the Santa Ana River by use of the facilities identified in Exhibit 12 "A. Such pumping and discharge shall be made on the schedule and 13 at the rate and amounts set forth in Exhibit "A" or as may be 14 hereafter agreed upon from time to time by the parties. Pumper 15 1will make a good faith effort to pump and discharge as much water 16 as possible within the said -terms but shall not be resDonsibie for 17 any minimum guarantee. 18 5. Upon notice from Municipal Districts, pumper 5,_Ia,l 19 cease such pumping and discharge until notification to resume. 20 6. All water pumped and discharged pursuant to this 21 agreement shall be metered by Pumper at the well. Meter records 22 shall be kept by Pumpers, and copies shall be supplied to 23 Municipal Districts on a month' y basis . Pumper' s records and 24 Imetering facilities shall be available forL by all I 25 parties hereto and by Orange County. 26 7 . Scheduling i'ag will be done on a day to day 8 basis to meet the needs of the Pilot Dewatering Program. To the extent Possible weekly schedules will be developed during 9 the week prior to the week in which deliveries are made. o 11 12 ICapital facilities (if any) and terms with respect thereto: 13 Prior to their commencement, Pumper is to submit a detailed 14 1flist of any capital P acilit-4es/expen3es for which the Pumper is expecting reirn-bursement as part of this Program.
