Subdivision Improvement Agreement - Pence Construction, Apphcant - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, the City Council unanimously approved a subdivision improvement agreement for Parcel Map No 16164 for Minor Subdivision No 266 to subdivide an approximately 1 66 acre site into three commercial lots located on the north side of Plum Lane and west of Alabama Street and east of Idaho Street and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City Trails - Flood Control Right -of -Way - Councilmember Peppier expressed concerns about the future financial liability of the City if we proceeded with the request to enter into a common use agreement addressing responsibility for maintenance, operations and habihty for trails constructed in flood control right- of-way Community Development Director Shaw explained the City currently has two development projects that have been approved subject to a condition that they construct a trail adjacent to their property Before they can proceed for issuance of a building permit, a Memorandum of Understanding with the San Bernardino County Flood Control District must be approved by both the City and the County Subsequent to this Memorandum of Understanding, it will be September 6, 2005 Page 2 AGREEMENT TO PROVIDE PROFESSIONAL ENVIRONMENTAL CONSULTING SERVICES FOR THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT AND ASSOCIATED ENVIRONMENTAL DOCUMENTS This Agreement is made and entered into this 6th day of September, 2005, by and between the City of Redlands, a municipal corporation ("City") and ECORP Consulting, Inc ("Consultant"), who are sometimes individually referred to herein as a "Party," and collectively, as the "Parties " In consideration of the mutual promises contained herein, City and Consultant agree as follows 11 ARTICLE 1 - ENGAGEMENT OF CONSULTANT City hereby engages Consultant to prepare an Environmental Impact Report (EIR) and associated environmental documents (the "Services") for the Standard Pacific Homes Project described as Tentative Tract No 16689, Cup No 840, Zone Change No 409, Agricultural Preserve Removal No 107, Williamson Act Removal No 8 and Demolition No 111 (the "Project") 1 2 All work performed by Consultant under this Agreement shall be done in a professional manner, and Consultant represents that it has the skill and professional expertise necessary to provide high quality Services to City at the level of competency presently maintained by other practicing professional consultants in the industry providing similar types of services ARTICLE 2 - RESPONSIBILITIES OF CONSULTANT 2 1 The Services which Consultant shall perform are more particularly described in Exhibit "A," entitled "Proposal to Prepare an Environmental Impact Report for Standard Pacific Homes Residential Development," which is attached hereto and incorporated herein by this reference 2 2 Consultant shall comply with all applicable Federal, State and local rules, laws and regulations in the performance of this Agreement including but not limited to all applicable Labor Code and prevailing wage laws, and all non-discrimination laws including the Americans with Disabilities Act ARTICLE 3 - RESPONSIBILITIES OF CITY 3 1 City shall place at disposal of Consultant all available information in its possession pertinent to the Project 3 2 City will provide access to and make all provisions for Consultant to enter upon City -owned property or right-of-way as required by Consultant to perform the Services pursuant to this j:cc reportslplanningleir contract std pacific.wpd 1 Agreement 3 3 City has designated its Community Development Director, Jeff Shaw, to act as City's representative with respect to the Services to be performed under this Agreement, and such person shall have complete authority to transmit instructions, receive information, interpret and define City's policies and decisions with respect to the Services ARTICLE 4 - INSURANCE AND INDEMNIFICATION 6 1 Consultant's Insurance to be Primary All insurance required by this Agreement shall be maintained by Consultant throughout its performance of the Services and shall be primary with respect to City and non-contributing to any insurance or self-insurance maintained by City Consultant shall provide City with Certificates of Insurance and endorsements evidencing such insurance prior to commencement of the Services 6 2 Workers' Compensation and Employer's Liability A Consultant shall secure and maintain Workers' Compensation and Employer's Liability insurance throughout its performance of the Services in amounts which meet the statutory requirement with an insurance carrier acceptable to City Such insurance shall be primary and non-contributing to any insurance or self-insurance maintained by City The insurance policy shall include a provision prohibiting modification or cancellation of the policy except upon thirty (30) days prior written notice to City Certificates of Insurance shall be delivered to City prior to commencement of the Services B Consultant expressly waives all rights to subrogation against City, its elected officials, officers and employees for losses arising from work performed by Consultant for City by expressly waiving Consultant's immunity for injuries to Consultant's employees and agrees that the obligation to indemnify, defend and hold harmless provided for in this Agreement extends to any claim brought by or in behalf of any employee of Consultant This waives is mutually negotiated by the Parties This subsection shall not apply to any damage resulting from the sole negligence of City, its agents and employees To the extent any of the damages referenced herein were caused by or resulted from the concurrent negligence of City, its agents or employees, the obligations provided herein to indemnify, defend and hold harmless are valid and enforceable only to the extent of the negligence of Consultant, its officers, agents and employees 6 3 Hold Harmless and Indemnification. Consultant shall indemnify, hold harmless and defend City and its elected officials, agents, and employees from and against any and all claims, losses or liability, including attorneys' fees, arising from injury or death to persons or damage to property occasioned by any act, omission or failure of Consultant, its officers, agents and employees in performing the Services required by this Agreement City shall defend, indemnify and hold harmless Consultant from and against any and all claims, losses, expenses, damages, demands, judgments, causes of action, sults, and liability in tort, contract, or any other basis and of every other kind and character whatsoever, to the extent that claims are caused by, result from or arise out of City's sole negligence, gross negligence, intentional misconduct or strict liability i:cc reportslplannmgleir contract std pacific wpd 6 4 Assignment Consultant is expressly prohibited from assigning any of the Services described in this Agreement without the prior written consent of City In the event of mutual agreement between the Parties to assign a portion of the Services, Consultant shall add the assignee as an additional insured and provide City with the insurance endorsements prior to any Services being performed by the assignee Assignment does not include printing or other customary reimbursable expenses that may be provided for in this Agreement 6 5 Comprehensive General Liability Insurance Consultant shall secure and maintain in force throughout its performance of the Services comprehensive general liability insurance with carriers acceptable to City Minimum coverage of one million dollars ($1,000,000) per occurrence and two million dollars ($2,000,000) aggregate for public liability, property damage and personal injury is required City shall be named as an additional insured and the insurance policy shall include a provision prohibiting modification or cancellation of the policy except upon thirty (30) days prior written notice to City Such insurance shall be primary and non-contributing to any insurance or self-insurance maintained by City Certificates of insurance and endorsements shall be delivered to City prior to commencement of the Services 6 6 Professional Liability Insurance Consultant shall secure and maintain professional liability insurance throughout it performance of the Services in the amount of one million dollars ($1,000,000) per claim made Consultant shall maintain professional liability insurance throughout the duration of the Project Certificate of liability insurance and endorsement shall be delivered to City prior to commencement of the Services 6 7 Business Auto Liability Insurance. Consultant shall have business auto liability coverage, with minimum limits of one million ($1,000,000) per occurrence, combined single limit for bodily injury liability and property damage liability This coverage shall include all Consultant owned vehicles used on the project, hired and non -owned vehicles, and employee non -ownership vehicles City shall be named as an additional insured and a certificate of insurance shall be delivered to City prior to commencement of the Services ARTICLE 7 - GENERAL CONSIDERATIONS 7 1 In the event any action is commenced to enforce or interpret any of the terms or conditions of this Agreement the prevailing Party shall, in addition to any costs and other relief, be entitled to recover its reasonable attorneys' fees, including fees for in-house counsel of the Parties at rates prevailing in San Bernardino County, California 7 2 The Consultant's key personnel proposed for the Project is as follows Anne Surdzial, AICP, Project Manager Evelyn Chandler, Cultural Resources Manager Donald Mitchell, Principal Biologist and Inland Empire Operations Manager J:cc reportslplannsnglcsr contract std pacific wpd 4 Ms Surdzial will be supported by the following subconsultants Stephen J Montgomery, SJM Biological Consultants Valorie Thompson, Scientific Resources Associated Consultant agrees that these key personnel will be made available and assigned to City's Project, and that they will not be replaced without concurrence from City 7 3 All documents, records, drawings, electronic data files and data base, photographic prints and negatives, designs and specifications, cost estimates, and other documents developed by Consultant pursuant to this Agreement, and any copyright interest in the above-described documents, shall become the property of City and shall be delivered to City upon completion of the Services 7 4 Consultant and City agree that Consultant is, for all purposes under this Agreement, an independent contractor with respect to the Services provided pursuant to this Agreement and not an employee of City All qualified personnel provided by Consultant pursuant to the provisions of this Agreement are to be employed by Consultant for its account only, and in no event shall Consultant or any personnel retained by it be deemed to have been employed by City or engaged by City for the account of or on behalf of City Nothing in this Agreement shall be considered to create the relationship of employer and employee between the Parties 7 5 Unless earlier terminated as stipulated below, this Agreement shall terminate upon completion and acceptance of the Services by City 7 6 Upon receipt of a termination notice, Consultant shall (1) promptly discontinue all Services and (2) deliver or otherwise make available to City, copies of any data, design calculations, drawings, specifications, reports, estimates, summaries, and such other information and materials as may have been accumulated by Consultant in performing the Services required by this Agreement Consultant shall be compensated on a pro -rata basis for any work completed up until notice of termination 7 7 This Agreement, including the attachments incorporated herein by reference, represents the entire agreement and understanding between the Parties as to the matters contained herein and any prior negotiations, proposals or oral agreements are superseded by this Agreement Any amendment to this Agreement shall be in writing and approved by the City Council of City and signed by City and Consultant 7 8 This Agreement shall be governed by and construed in accordance with the laws of the State of California J:ce reportslplanntnglew contract std pacific wpd 5 IN WITNESS WHEREOF, duly authorized representatives of the Parties have signed in confirmation of this Agreement CITY OF REDLANDS By ECORP Consulting, Inc ( City CJ By 4%i� [. ENVIRONMENTAL CONSULTANTS 412 East State Street Redlands, California 92373 Prepared for City of Redlands Community Development Department 35 Cajon Street, Suite 20 Redlands, California 92373 Donald R Mitchell Inland Empire Operations Manager 1.0 Project Understanding and Approach 1.1 Project Understanding ECORP Consulting, Inc appreciates the opportunity to respond to the Request for Proposal (RFP) for the Standard Pacific Homes Residential Development. We understand that the project applicant, Standard Pacific Homes, has submitted a number of technical studies, prepared by reputable consultants, to facilitate environmental analysis according to the California Environmental Quality Act (CEQA). Prior to preparing this proposal, ECORP staff reviewed the project information made available to potential bidders by the City An ECORP staff biologist and CEQA specialist also made a pre-bid visit to the site, in order to better identify and clarify issues for the proposal The documents reviewed included • a Traffic Impact Study by Urban Crossroads, • a Preliminary Noise Study by Urban Crossroads, e a Geotechnical Investigation by Geocon; • an Environmental Site Assessment by Carlin Environmental Consulting, • a Cultural Resources Assessment by Archaeological Associates; e a Hydrology Summary Report by Hicks and Hartwick, o a General Biological Assessment by TeraCor; a a San Bernardino Kangaroo Rat Presence/Absence Trapping Study by ENVIRA, and a an Independent Review Letter Report by Tom Dodson & Associates Based on the analysis of the project in the technical reports, the City has determined that the project has the potential to significantly affect the Federally -listed (Endangered) San Bernardino Merriam's kangaroo rat (SBKR) (Dipodomys mernami parvus) ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS 1 2 Approach to CEQA Compliance It is our understanding that the City has requested that the CEQA contractor prepare the Initial Study for the proposed project to determine the appropriate CEQA document for the project (either a Mitigated Negative Declaration [MND] or an Environmental Impact Report [EIR]) There are advantages and disadvantages to each document The MND requires less public review time; however it offers less legal protection for the City and requires the applicant to mitigate all impacts The EIR requires more public review time, but offers greater legal protection and does not require mitigation of all impacts It is probable that the City will not be able to make a decision on which document to pursue without the information and analysis that will be provided in the Initial Study ECORP Consulting's approach to the preparation of the EIR is to use the existing documentation prepared for the project as the primary source of information We have identified a few areas where additional or supplemental technical studies may be required, described below. We have provided the scope and cost for these studies as optional tasks (see Sections 3.2.1 and 3 2 2) Biological Resources. Multiple biological resources studies have been performed on the proposed project site The primary biological resources issue for the development of the site is the presence of the Federally -listed (Endangered) SBKR (Dipodomys merrrami parvus). In October 2003, protocol -level trapping surveys were on the site conducted by a permitted biologist and failed to detect SBKR on the project site Subsequently, an unauthorized trapping effort (i.e., a consultant inadvertently trapped on the Standard Pacific TT 16689 site) did identify SBKR on the northern portion of the project site An attempt was made to exclude SBKR from the southern portion of the site by installing a fence However, it's not clear whether SBKR may already have existed in the more southerly portions of the site at that time. The City subsequently hired a consultant to perform a peer review related to the SBKR issues for the site This consultant concluded that the biologist who monitored the fencing may not have been appropriately qualified (i.e., permitted by USFWS) and that there is still no conclusive evidence that SBKR may not exist in multiple areas of the site (Dodson 2005). Therefore they recommended a protocol -level trapping study of the entire site We are proposing an additional SBKR habitat assessment by Mr Stephen Montgomery (S.JM Biological Consultants). Based upon the previous SBKR documentation for the site, we may recommend protocol -level trapping throughout the site This trapping effort is included as an optional task (see Section 3 2 1) ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS Eligibility Evaluations for On -Site Structures The cultural resources assessment prepared by Archaeological Associates mentioned the agricultural -related structures on the site only in passing, describing them as"modern" No information was given on how this determination was made We have proposed a reconnaissance -level survey by an archaeologist that specializes in architectural history/historic archaeology as part of the Initial Study process This reconnaissance -level visit is included in our proposal If it is determined that the structures may not be warranted, ECORP will conduct an evaluation to determine if the structures are eligible for listing The evaluation is included as an optional task (see Section 3.2 2) ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS 3 2.0 Corporate Description, Key Personnel, and Description of Experience 2.1 Project Team This project would be managed and staffed from ECORP Consulting's Inland Empire office in Redlands ECORP has assisted public and pnvate land owners with environmental regulation compliance since 1987. We offer full service capability, from initial baseline environmental studies through environmental planning review, permitting negotiation, liaison to obtain legal agreements, mitigation design, construction supervision, and monitoring and compliance reporting. We bring together an experienced team of CEQA/NEPA specialists, engineers, hydrologists, biologists, wetland specialists, environmental analysts, archaeologists, and geographic information system specialists ECORP is a certified small business in the State of California and under many federal NAICS and SIC codes ECORP has a total of 95 employees, including 17 employees assigned to the Redlands office We conduct environmental analysis for federal, state, regional, and local government and private clients ECORP has established professional working relationships with federal and state regulatory agencies, based on technical excellence and a thorough understanding of regulatory processes. We are experienced with the California Fish and Game Code, Section 1600; the regulatory requirements of the federal Clean Water Act (CWA), Sections 401, 402, and 404; the National Environmental Policy Act (NEPA), the National Historic Preservation Act (NHPA), Sections 106 and 110, the federal Endangered Species Act (ESA), Sections 7 and 10, the California Environmental Quality Act (CEQA), the California Endangered Species Act (CESA), and the Coastal Zone Management Act (CZMA) A partial list of our environmental services includes. Ms. Surdzial is ECORP's CEQA/NEPA Manager. She has 15 years experience preparing and managing the preparation of ISs/EAs and EIRs/EISs for a variety of projects subject to review under the CEQA and NEPA. She is also experienced in land use planning issues and is a former planner for the City of Redlands. She is currently the Project Manager for the EIR for the Bulldog Commons project for the City While employed at another firm, Ms Surdzial was the Project Manager for the CEQA Initial Study and NEPA Environmental Assessment for the flood control improvements on the Mission Zanja between 9th Street and 7th Street In October 2004, Ms Surdzial was a speaker/panel member ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS for the California Association of Environmental Professionals' CEQA Basics Workshop She has a B.S. in Environmental Science from U C. Riverside Don Mitchell has 18 years of experience in the field of environmental science, with particular emphasis on wildlife assessments, impact analysis, and project management He has extensive experience in conducting biological studies, and focused threatened and endangered species surveys, sensitive habitat surveys He has also conducted or managed surveys for the San Bernardino kangaroo rat, Stephens' kangaroo rat, California gnatcatcher, desert tortoise, Mohave ground squirrel, and a wide variety of southern California and Mojave Desert terrestrial plant and wildlife species Ms. Evelyn Chandler will provide expertise for cultural resources. Ms. Chandler is a graduate of the University of Redlands, with 15 years of experience in cultural resources management Ms Chandler has managed several projects involving the evaluation of structures in Redlands, including the 65 -acre Griffin Industries residential development in southeast Redlands, the Bulldog Commons project at Grove and Sylvan and the First Protestant Reformed Church at the site of the new Boys and Girls Club She also evaluated impacts to the Zanja as part of the flood control improvements at 9th Street for the IS/EA. Steve Montgomery founded SJM Biological Consultants in 1983, and has over 20 years of experience managing and conducting field surveys, analyzing data, and preparing reports for diverse types of biological studies Mr Montgomery specializes in small mammal species, and he holds a U S Fish and Wildlife Service (USFWS) permit to trap and handle SBKR, a California Department of Fish and Game (CDFG) Memorandum of Understanding (MOU) to trap and handle SBKR His other qualifications include USFWS permits and CDFG MOUS for the Stephens' kangaroo rat and Pacific pocket mouse, and USFWS permits for Yuma clapper rail, California gnatcatcher, and Amargosa vole Mr. Montgomery conducted SBKR habitat assessment and trapping studies for the Sector 8 and Fairmont projects in Redlands He was also the SBKR expert for the Metropolitan Water District's Inland Feeder Project and the U S Army Corps of Engineer's Seven Oaks Dam project He has also conducted trapping and habitat assessment surveys for SBKR at various locations in the Santa Ana River, Lytle Creek, and Cajon Creek washes for sand and gravel mining companies Valorie Thompson, Ph.D., Principal of Scientific Resources Associated, has over 15 years of experience in environmental planning, air quality studies, air toxics emission evaluations, health ECORP Consulting, Inc. ENV1RONAIENTAL CONSULTANTS 6 risk assessments, process safety management, hazard and operability studies, off-site consequence analysis, and atmospheric dispersion modeling. She has managed numerous environmental planning, air quality, and risk assessment projects. Dr Thompson has also assisted government clients in the development of air emission inventories and compliance strategies for large military bases She has a Ph.D. in Chemical Engineering from Purdue University A copy of resumes for all key personnel are attached to this proposal. 2.3 Project Experience The following projects describe the CEQA project experience of ECORP Consulting and the key personnel assigned to this project. EIR for Bulldog Commons Development Project Client City of Redlands Project End Date. January 2006 (est) Key Personnel. Anne Surdzial (Project Manager), Don Mitchell, Evelyn Chandler, Valorie Thompson ECORP Consulting is currently preparing an EIR for the development of a 3 -acre site into an apartment complex. The Bulldog Commons development consists of 40 dwelling units in two, 2 - story buildings in an infill area in the City of Redlands near the University of Redlands. As part of intersection improvements required to provide access to the project site, the Mill Creek Zanja channel would be affected. This portion of the channel is listed on the National Register of Historic Places (NRNP) and the California Register of Historical Resources (CRHR), because it is the earliest remaining civil engineering project in southern California In addition to impacts to Cultural Resources related to the Zanja, hydrology and biological resources impacts were also key environmental issues. ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS 10 3.0 Scope of Work The project will be evaluated at the completion of Task 2 to determine if an MND or an EIR is the appropnate environmental document As requested in the RFP, this scope of work assumes that the Initial Study will recommend the preparation of an EIR. 3 1 Task 1— Project Kickoff, Preparation of a Project Description Within 5 working days of the Notice to Proceed, ECORP will attend a project kickoff meeting with the City planning staff, project applicant, and any others requested by the City (such as public works staff). We have assumed we will receive copies of previously -prepared technical reports for the project at this meeting ECORP will prepare a project description based on information provided by the project applicant. The project description will describe the project's location, characteristics, and construction scenario ECORP will provide three copies of the project description to the City for review and comment The revised version of the project description will be contained in the Initial Study Alternatives to the project will be developed in Task 3, if an EIR is determined to be the appropriate CEQA document 3.2 Task 2 — Initial Study A CEQA Initial Study is generally used to determine which CEQA document is appropriate for a project (Negative Declaration [ND], Mitigated Negative Declaration [MND], or EIR) However, an Initial Study may also be useful even if the Lead Agency has already concluded that an EIR is required CEQA Guidelines Section 15063 (a)(1) states, If the lead agency can determine that an EIR will clearly be required for the project, an initial study is not required but may still be desirable. The Initial Study can be used to eliminate resources from discussion in the EIR that are clearly not affected by the proposed project. ECORP will prepare an Initial Study for the proposed project, and provide written justification of answers. ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS 11 To determine the scope of the project impacts, and if the impacts can be mitigated, additional study for air quality, biological resources, and cultural resources may be required at the Initial Study stage The scopes of work for these resources are provided below, and their costs are provided in the cost estimate for the Initial Study We have also provided optional tasks for additional technical studies for biological resources and cultural resources, which are discussed in Sections 2 2 1 and 2 2 2 The costs for these resources are presented separately from our main cost estimate. Air Quality. Included in ECORP's cost estimate for Task 2 is an analysis of the air quality impacts of the construction and operation of the proposed project According to the SCAQMD webpage, the screening tables in Chapter 6 of the CEQA Air Quality Handbook should no longer be used under any circumstances because they are based on obsolete mobile source emission factors and trip generation data. Methodologies in the Appendix to Chapter 9 of the CEQA Air Quality Handbook or use a land use model should be used until new screening tables are developed Emissions associated with the construction phase of the project will be estimated The emissions estimates will be based on information provided by the project design team with regard to construction requirements, and/or will be developed based on standardized approaches as presented in the South Coast Air Quality Management District's CEQA Air Quality Handbook for construction of single-family residential developments. The significance of the emissions based on appropriate significance criteria developed by the City of Redlands and the South Coast Air Quality Management District's CEQA significance thresholds. Where required, SRA will evaluate mitigation measures to reduce potential impacts associated with construction. This assessment will address criteria pollutant impacts Operational impacts associated with the project mainly include increases in traffic and area sources such as energy use. Based on the traffic analysis provided by the applicant, SRA will evaluate the potential for a significant air quality impacts associated with traffic. In the event that the traffic analysis projects a degradation in LOS at any affected intersection to LOS E or worse, SRA will conducted a detailed CO "hot spots" analysis to determine the potential for an exceedance of the CO standard The analysis will be conducted in accordance with Caltrans guidelines. For the purpose of providing a cost estimate, SRA assumes that one intersection will be evaluated for CO "hot spots." Biological Resources Our scope of work for the Initial Study includes a habitat assessment for SBKR on the entire property by Steve Montgomery, who holds a USFWS permit to trap and handle SBKR and a CDFG MOU to trap and handle SBKR Based on this habitat assessment, he 12 ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS will recommend if additional SBKR trapping studies will be required to confirm the presence/absence of the species on the site, particularly on the southern portion of the property. The scope of work for this trapping study is in Section 3 2 1, as an optional task If the City agrees with this approach, this optional task will be conducted and the results will be presented in the Initial Study Cultural Resources, A reconnaissance -level survey of the agricultural buildings/structures on the site will be conducted as part of the scope of work for the Initial Study The structures within the project area will be examined by a Historic Archaeologist to assess their approximate date of construction based on architectural characteristics and construction materials and techniques If there is a possibility that the buildings were constructed prior to 1955, then ECORP will conduct the optional task described in Section 3 2.2. This task will better determine the age of the buildings and if they are eligible for listing Also included in the cost for the Initial Study are records searches for paleontological resources with the San Bernardino County museum and Native American resources with the Native American Heritage commission These records searches were not provided with the applicant - submitted reports We have assumed, for costing purposes, that the City or applicant can provide ECORP with a copy of the archaeological resources records search conducted by the applicant's consultant 3.2.1 Optional Task - San Bernardino Kangaroo Rat Studies Based upon review of the previous biological studies, the proposed assessment by Mr Stephen Montgomery, and upon authorization by the City of the optional task, a USFWS protocol -level trapping study for SBKR will be conducted by a USFWS permitted biologist. Following completion of the study, a report detailing the methods and results of the surveys will be submitted to the City and the USFWS. The results of the trapping study will be incorporated into the Biological Resources section of the Initial Study. 3.2.2 Optional Task - Eligibility Evaluations for On -Site Structures If the structures appear to be of historic age (i.e , over 50 years old), based on the reconnaissance -level survey included as part of the Initial Study, additional research will be conducted to determine the exact dates of construction and to evaluate them for significance to the California Register of Historical Resources (CRHR) Evaluation methods will include archival 13 ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS research to determine if the structures are associated with any significant events or persons in local history and detailed field recordation of the structures An evaluation report will be prepared documenting the methods and results of the study The report will provide recommendations on the CRHR eligibility of the structures, and if considered they are considered eligible, will assess impacts to the structures from the proposed development of the parcel, and recommend mitigation measures as applicable 3.3 Task 3 — Notice of Preparation/Administrative Draft EIR 3.3.1 Notice of Preparation ECORP will prepare the Notice of Preparation, soliciting participation in determining the scope of the EIR. The Initial Study will be attached to the NOP ECORP will distribute 50 copies of the approved IS/NOP package for distribution to the County Clerk, various public agencies whose approval and/or comments are required (Responsible Agencies), agencies with resources affected by the project (Trustee Agencies), and interested parties and groups Within the 30 -day public review and comment period, Responsible Agencies, Trustee Agencies, and members of the public may provide comments about the EIR contents and the project in general 3.3.3 Administrative Draft EIR An Administrative Draft EIR will be submitted to the City for review and comment prior to the preparation of the Draft EIR. The EIR will be prepared using technical and environmental reports provided by the Applicant, the air quality analysis, and the results any optional tasks chosen by the City The EIR will include the topics for which impacts were identified either as "potentially significant" or "less than significant with mitigation incorporated" in the Initial Study checklist. It is important to carry forward the mitigation required in the Initial Study to the EIR, so that it will be documented in the Mitigation Monitoring and Reporting Program (MMRP). However, it is our approach that the majority of the documentation in the EIR will be for those issues where more information or analysis was required, and a determination of significance could not be made in the Initial Study The EIR will also analyze up to three alternatives' an alternative of less intensive development, an alternative with more intensive development, and the No Project Alternative We have assumed that the applicant would provide any engineering data required for the alternatives development. ECORP Consulting, Inc. ENVIRONMENTAL CONSULTANTS 14 A total of three copies of the Administrative Draft EIR will be provided to the City for review and comment. For costing purposes, we have assumed that the technical reports prepared by the Applicant will be incorporated by reference and will not be included in the EIR as technical appendices 3.4 Task 4 — Draft EIR and Notices After review and comment on the Draft EIR, ECORP will revise the EIR and print sufficient copies for public review. We will also prepare the Notice of Completion and Notice of Availability to accompany the Draft EIR and for publication in a newspaper of general circulation We have made the following assumptions regarding document and notice circulation' • ECORP Consulting will print and distribute 29 hard copies and one electronic copy of the EIR as follows - Fifteen copies will be sent to the State Clearinghouse - Three hard copies and one electronic copy of the Draft EIR will be provided to the City - One hard copy will be provided to the AK Smiley Public Library - ECORP and the City will develop a list of interested agencies and other interested parties These agencies/individuals will be mailed a complete copy of the EIR It is assumed that the list will contain no more than 10 addresses. • The City will provide a list of surrounding property owners. These owners will receive a Notice of Availability, stating that the EIR is available for review at the Planning Department and at the library • ECORP will post the Notice of Availability with the County Clerk We have assumed that the City will arrange to have the notice published in the newspaper, and will pay all fees associated with newspaper publication and with County Clerk filing 3.5 Task 5 - Administrative Final EIR/Draft MMRP ECORP will prepare an Administrative Final EIR, consisting of copies of comment letters received on the Draft EIR, responses to these comments, any errata sheets required based on the comments, and the Draft MMRP Three copies of the Draft EIR will be prepared for City review ECORP Consulting, Inc. We will file the Notice of Determination with the County Clerk, and mail the Final EIR to the required agencies and individuals We have assumed printing of 20 Final EIRs, including 3 copies for the City We will also prepare one electronic copy for the City. We have assumed that the City will pay all filing fees associated with the County Clerk 3.7 Task 7 - Meetings In addition to the kickoff meeting included in Task 1, the ECORP Project Manager will attend an estimated five meetings two for the Environmental Review Committee and three for both the Planning Commission and City Council We have also proposed a meeting at the conclusion of Task 2 to review the recommendation of an EIR or MND.
