HomeMy WebLinkAboutOrdinances_2870ORDINANCE NO. 2870 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTERS 18 156 OF THE REDLANDS MUNICIPAL CODE RELATING TO REGULATIONS FOR SMALL COLLECTION AND BEVERAGE CONTAINER RECYCLING FACILITIES THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS Section 1. Chapter 18 156 of the Redlands Municipal Code, entitled "Development Provisions for Specific Uses" is hereby amended to add Article XI, entitled "Recycling Centers," to read as follows "Article XI Recycling Centers 18 156 800 Purpose of Provisions 18 156 810 Definitions 18 156 820 Permit Requirements 18 156 830 Development and Operating Standards 18 156 800 PURPOSE OF ARTICLE The City Council fmds that recycling of glass, plastic, aluminum and other nonferrous metals is important to the cornrnunity and the sustainability of resources, and allowing for small collection recycling facilities in multiple locations in the city A Provides a convemence to residents and encourages recycling activities B The City Council finds that regulating recycling centers, also known as small collection facilities and container redemption centers, for glass, plastic, aluminum and other nonferrous metals is to ensure compatibility of such uses with surrounding uses and properties and to avoid any impacts associated with such uses C The council finds that regulation of such facilities is necessary in order to ensure that these facilities will provide a safe customer environment while not creating any adverse effects on surrounding properties nor contributing to a general decline of existing cornmeicial districts or single-family neighborhoods 18 156 810 DEFINITIONS As used in this Article, the following words shall have the meanings ascribed to thein A RECYCLE The process of collecting, sorting, cleansing, treating and reconstituting materials that would otherwise become solid waste, and return them to the economic mainstream in the form of raw material for new, reused, or reconstituted products that meet the quality standards necessary to be used in the marketplace 1 1 California beverage containers (e g , reverse vending machines), and which occupies an area of less than five hundred (500) square feet C SMALL COLLECTION RECYCLING CENTER A site where beverage containers as defined rn this Title may be redeemed for cash or other compensation, which occupy an area not exceeding one thousand (1,000) square feet Facility may accept containers by donation, redemption or purchase, and recyclable materials from the public (unless required as a Certified Recycling Center by the California Public Resources Code) Said facility may be a beverage container recycling center or reverse vending machine(s) 18 156 820 PERMIT REQUIREMENTS A The location and type of the proposed facihty on any site shall be subject to the approval of an Administrative Use Permit issued in accordance with Chapter 18 193 of this Title A Small Collection Recycling Center 01 a Small Beverage Containei Recycling Center may be an allowable use m any commercial or industrial zoning district of the City, including any conunei cial, industrial, or rmxed use district of a specific plan, as an accessory use to an existing principal comineicial or industrial use 2 For purposes of this section, any mixed use (i e , commercial and residential) zoning district, including any mixed use district of a specific plan, shall be considered a primarily commercial district, and small collection recycling facilities may be allowable as an accessory use to an existing principal commercial use B Recycling centers and facilities are prohibited in all residential zoning districts in the City, including any residential only district of a specific plan C Any existing Small Collection Recycling Center or Beverage Container Recyclmg Center without a permit to operate as of the date of this ordinance shall have no more than 180 days from the date of adoption to file an application for an Adrninistiative Use Permit 18 156 830 DEVELOPMENT AND OPERATING STANDARDS A A minimum of one hundred (100) lineal feet of separation shall be provided between a proposed recycling facility and any residential property, as measured from the nearest residential property lune B An operational plan for a continuing cleaning and maintenance program, as well as the control of noise, odor, dust, litter, shall be submitted for review prior to application approval I \Ordinances\Nos 2800-2899 in including but hmited to days and hours of operation, odor and dust control, cleaning and maintenance of the facility and surrounding area, design and appearance of related structures, or any other conditions necessary to avoid or nutigate any potential nuisance effects of such facilities " Section 2 The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordmance and shall cause it, or a summary of it, to be published once m the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect
