The undersigned is the owner ("Owner") of approximately 321 acres of real property
located in Redlands, California, designated as San Bernardino County Assessor's Parcel Nos.
167-091-09, 167,091-10, 167-091-11 and 167-091-12, and shown on the map attached as Exhibit
"A," which is incorporated herein by this reference (the "Property").
Owner understands and agrees that:
Staff of the City of Redlands (the "City") is conducting environmental studies for all or a
portion of the Property for a private development project commonly known as the "Redlands
Commons," and consisting of approximately 85,500 square feet of retail space, 20,000 square
feet of office space and 205 single family homes on a parcel directly adjacent to the Property,
and consisting of the development of the Property with approximately 32 acres of general
commercial development (the "Project"). Owner's execution of this Pen-nit does not constitute
Owner's approval of the Project nor waive any of owner's rights with respect thereto.
City staff and its consultant find it necessary to enter the Property to gather data needed
to complete environmental studies associated with the Project. The nature and scope of the
requested activities include a visual site inspection and investigation of the Property for
biological, cultural and geotechnical information gathering. No physical work will be performed
on the Property.
The City, in return for Owner granting permission to enter the Property, agrees:

• To retain a qualified consultant to perform the above-described inspections and investigation.
• To require the consultant to coordinate the inspections with Owner's schedule and, unless the
Owner requests otherwise, to require the consultant to perform the inspections during normal
business hours.
• To give the Owner forty-eight (48) hours' notice prior to enter upon the Property.
• To undertake no physical changes to the Property and leave the Property in its pre-entry
condition.
• To indemnify and save harmless the Owner from all claims, demands, suits, judgments,
expenses and costs on account of injury or death of person or loss of, or of damage to, the
Property of any kind or nature, including but not limited to attorneys' fees, arising out of any
entry upon the Property pursuant to this Permit, and the performance by the consultant of
such inspections; provided, however, the indemnification obligation does not extend to any
Property damage the Owner may have suffered by reason of hazardous waste on the Property
prior to the date hereof, nor does it indemnify the Owner from any liability as a consequence of
the presence of hazardous waste on the Property.

• Provide the Owner with a copy of all inspection reports.
• Provide the Owner with a copy of City's consultant's liability insurance certificate (attached
hereto as Exhibit "B").
This Entry Permit may be revoked by the Owner at any time on three days' written notice
to the City.
IN CONSIDERATION OF THE ABOVE, PERMISSION TO ENTER UPON THE PROPERTY
IS HEREBY GRANTED BY OWNER.
