HomeMy WebLinkAboutOrdinances_2907 ORDINANCE NO 2907 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 12 22 OF THE REDLANDS MUNICIPAL CODE RELATING TO PUBLIC IMPROVEMENTS FOR NON-SUBDIVISION DEVELOPMENT PROJECTS THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS Section 1 Section 12 22 020 of the Redlands Municipal Code, titled "Definitions," is hereby amended to read as follows "12 22 020 DEFINITIONS For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section ALLEY A public or private way permanently reserved as a secondary means of access to abutting property BUILDING Includes any building, structure, or dwelling for which a building permit is required to be issued by the City DIRECTOR The city's Municipal Utilities and Engineering Dnector or the director's authorized designee IMPROVEMENTS Means and includes sidewalks, gutters, pavement, driveways, curbs, streets, alleys, trails, storm drain facilities, water systems, sanitary sewei systems, street lighting, fire protection installation and pavement transitions PERSON Any person, firm, partnership, association, corporation, company or organization of any kind The term "person" also includes any owner, lessee or agent constructing or arranging for the construction, modification or alteration of a building or dwelling " Section 2 Section 12 22 030 of the Redlands Municipal Code, titled "Dedications Required," is hereby amended to read as follows "12 22 030 DEDICATIONS REQUIRED A Any person who constructs, or causes to be constructed, any building m the city shall, upon the determination of the director, provide by means of an irrevocable offer of dedication or other appropriate conveyance as approved by the city attorney the rights of way necessary for the construction of any street, highway, alley, trail or pathway described or identified in the city's general plan, any applicable specific plans or as otherwise required by the director in accord with an established city street system, plan or standard Rights of way shall also be provided for any improvements to existing facilities, including rights of way for stoiiu drains, water, wastewater 1 I IOrdmances\Nos 2900-2999 in Word12907 Amending 12.22 Public Improvements Required Ord Clean 4 15 20 doe or other required public facilities All rights of way shall be accompanied by a title examination and be free of all hens and encumbrances B The dedications required by subsection A of this section shall, upon the determination of the director, also apply to any person who alters, enlarges, expands or causes to be altered, enlarged or expanded any building in the city C. The dedications required by this chapter shall be made prior to, and as a condition of, issuance of the building permit for the subject property D Prior to the issuance of the buildmg permit for the subject property, there shall be paid to the public works department a fee m an amount established by city council resolution for pro cessmg the irrevocable offer of dedication" Section 3. Section 12 22 040 of the Redlands Municipal Code, titled "Public Improvements Required," is hereby amended to read as follows "12 22 040 PUBLIC IMPROVEMENTS REQUIRED A Any person who constructs, or causes to be constructed, any building m the city shall construct all improvements required by the city's general plan and any applicable specific plans, or as otherwise required by the director in accordance with an established city street system, plan or standard, upon the property and along all street frontages adjoining the property upon which such building is constructed, unless adequate improvements already exist In each instance, the director shall determine whether or not the necessary improvements exist and are in accordance with the General Plan and such specific plans Each building permit application shall be so endorsed at the time it is issued B The improvements required by subsection A of this section shall, in the determination of the director, also apply to any person who alters, enlarges or expands, or causes to be altered, enlarged or expanded, any building in the city, if such work exceeds seven hundred fifty (750) square feet " Section 2 The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect as provided by law ul W Foster, Mayor ATTEST ACI5W e Donaldson, City Clerk 2 I lOrdmanceslNos 2900-2999 m Word\2907 Amending 12 22 Public Improvements Required Ord Clean 4 15.20.doc I, Jeanne Donaldson, City Clerk, City of Redlands, hereby certify that the foregoing Ordinance was duly adopted by the City Council at the special meeting thereof, held on the 5th day of May, 2020, by the following vote AYES.
