HomeMy WebLinkAbout8082RESOLUTION NO 8082 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS SUSPENDING CERTAIN PROVISIONS OF CHAPTER 19 04 OF THE REDLANDS MUNICIPAL CODE RELATING TO THE- COMPETITIVE - EVALUATION OF CERTAIN RESIDENTIAL SUBDIVISION PROJECTS WHEREAS, m 1987, the voters of the City of Redlands approved Measure N, a citizen - sponsored, initiative zoning measure which amended the previously approved 1978 citizen - sponsored initiative zoning measure commonly known as Proposition R, to establish the limitation of four hundred (400) dwelling units that may be approved, annually, within the City, and WHEREAS, Section 19 04 040 of the Redlands Municipal Code codified the City's Residential Development Allocation program, which is a competitive evaluation system for certain residential subdivision projects that was adopted to implement dwelling unit limitation of Measure N and Proposition R, and winch also require that a competitive evaluation system for certain residential subdivision projects be established by the City, and WHEREAS, on January 1, 2020, Senate Bill 330, titled the "Housing Crisis Act of 2019," became effective and, in relevant part (Government Code section 66300), prohibits certain cities m the State from establislmng of iinplementnig limits on the number of permits that may be issued for the approval and construction of housing, and WHEREAS, after a review of Government Code section 66300, City Development Services Department staff have determined that Redlands is prohibited from enforcing the voter - approved annual limitation of the City's issuance of dwelling unit permits, and WHEREAS, the City's Development Services Department staff is suggesting that the reasons underlying Measure N's and Proposition R's requirement for establishing a competitive evaluation system have been frustrated, and made moot and purposeless, by the State's passage of the Housing Crisis Act of 2019, and WHEREAS, accordingly, for the "good government" purposes of efficiency and economy m providing services to the community, Development Services Department staff is recornrnending the City Council suspend enforcement of the City's Residential Development Allocation program for the time period during which the State maintams its prohibition against the City's implementation of the annual dwelling unit permit limitation of Measure N and Proposition R, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1 Adoption of this resolution is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to section 15061(b)(3) of the State Guidelines implementing CEQA 1 1 \Resolutions\Res 8000-8099\8082 Title 19 SB 330 doex Section 2 The City's Residential Development Allocation program, as established in Redlands Municipal Code section 19 04 040, is hereby suspended for the time period during which the State maintains its prohibition against the City's implementation of the annual dwelling unit permit limitation of Measure N and Proposition R Section 3 This resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution ADOPTED, SIGNED AND APPROVED this 19th day of May, 2020 ATTEST Donaldson, City Clerk 2 I 1Resolutions\Res 8000 8099\8082 Title 19 SB 330.docx Co•.41q___rcoat Paul W Foster, Mayor 1, Jeanne Donaldson, City Clerk of the City of Redlands, hereby certify that the foregoing Resolution was adopted by the City Council at a regular meeting thereof held on the 19th day of May, 2020 by the following vote AYES Councilmembers Barich, Tejeda, Momberger, Davis, Mayor Foster NOES None ABSENT None ABSTAIN None 3 I \Resolutions\Res 8000 8099\8082 Title 19 SB 330.docx e Donaldson, City Clerk
