RESOLUTION NO. 8087
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
FINDING THAT A SEGMENT OF THIRD STEET IS UNNECCESSARY FOR
PRESENT OR PROSPECTIVE STREET PURPOSES, AND ORDERING THE
SUMMARY VACATION OF A 170 LINEAR FOOT SEGMENT OF THIRD
STREET RIGHT-OF-WAY, LOCATED ON THE SOUTH SIDE OF WEST
STUART AVENUE (STREET VACATION NO. 179)
WHEREAS, the City has initiated an application for the summary vacation of a portion
of excess, undeveloped right-of-way, approximately 170 linear feet in length, and ranging in
width from 50 to 54 feet, on the south side of West Stuart Avenue and north side of parcels
related to the rail line owned by the San Bernardino County Transportation Authority; and
WHEREAS, the City is authorized to vacate all or part of a public street or public service
easement within the City pursuant to the Public Street, Highway and Service Vacation
Easements Iaw (California Streets and Highway Code, Section 8300 et. seq.); and
WHEREAS, pursuant to Section 8331 of the California Streets and Highway Code, a
public hearing is not required and the City inlay sunnnnarily vacate a street if the street or highway
has been impassable for vehicular travel and no public money was expended for maintenance on
the street for a period of five consecutive years prior to vacation; and
WHEREAS, pursuant to Section 8334 of the California Streets and Highway Code, the
City may sunnmarily vacate excess right-of-way of a street not required for street purposes; and
WHEREAS, in accordance with Section 8334.5 of the California Streets and Highway
Code, the street may be summarily vacated as there are no known in -place public utility facilities
that are in use that would be affected by the vacation; and
WHEREAS, the proposed street vacation qualifies for an exemption from environmental
review in accordance with the California Enviroiunental Quality Act ("CEQA"), pursuant to
Section 15061(b)(3) of the State CEQA Guidelines for projects where there is no possibility of
any significant environmental effects; and
WHEREAS, on May 19, 2020, the City Council held a public meeting on the proposed
summary vacation, and considered all verbal and written testunony provided by interested
persons interested on the proposed vacation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF REDLANDS AS FOLLOWS:
Section 1. The proposed vacation of a portion of said Third Street right-of-way,
located on the south side of West Stuart Avenue and north side of the rail line, is exempt from
envirom-rental review in accordance with Section 15061(b)(3) of the State CEQA Guidelines.

Section 2. The City Council having elected to proceed under the provisions of
Division 9, Part 3, Chapter 4 of the Streets and Highways Code of the State of California, hereby
orders the summary vacation of approximately 170 linear feet of Third Street, as more
specifically described in Exhibits "A" and `B" attached hereto and made a part hereof, based
upon tFie—following determinations:
A. For a period of five consecutive years or more, the subject segment of Third
Street has been impassible for vehicular traffic.
B. No public money has been expended for maintenance of the subject segment of
Third Street duria3g the period it has been impassible.
C. In accordance with Streets and Highways Code Section 892, the subject segment
of Third Street is not useful as a non -motorized transportation facility; and
D. The subject segment of Third Street is excess and unnecessary right-of-way for
street or highway purposes.
Section 3. This resolution shall take effect immediately following the recordation of
this Resolution by the San Bernardino County Recorder.
Section 4. That from and after the date of this Resolution is recorded, the subject
segment of Third Street as referenced herein is vacated and no longer constitutes a public right-
of-way ingress and egress easement.
