County OES and City are sometimes individually referred to herein as a "Party" and, together, as the "Parties.' RECITALS WHEREAS, County OES and City enter into this MOU based on the following: A. Community Emergency Response Team (CERT)Training/Response Trailers, hereinafter referred to as CERT trailer(s), have been purchased by the San Bernardino Operational Area through grant funding provided by the Department of Homeland Security. Each CERT trailer is outfitted with CERT supplies and safety equipment for use in CERT training and for emergency incident response. B. CERT trailers are equipped by County OES with the necessary supplies and equipment to support CERT classes and CERT emergency response. C. City will store the CERT trailer in a secure location with limited public access and provide a reservation policy that insures 24-hour, seven-daysa-week access to the CERT trailer. D. County OES and City agree to the terms set forth in this MOU with regard to services such as storage, access, deployment, inventory replenishment and maintenance. DXN11`ARjv*!.XYjb SB C-F-Al- 2 1,1 3A)8 8-52 a,m, NOW, THEREFORE, based on the forgoing recitals that the Parties agree to be true and correct, it is mutually agreed as follows: AGREEMENT A. SERMICES CITY RESPONSIBILITIES: 4. ImLcnvmC CERT trailer shall be stored in a secure location with limited public access. Whenever possible,trailer is to be parked in an enclosed facility and/or under a carport type structure. CERT trailers shall be locked at all times when not deployed or in use. The storage site should be a Government property such as a firestation, a law enforcement facility or a public works yard. CERT trailers may be relocated by City within Citys geographical boundaries, so long as County `SES is given prior notification of the move by City in writing,facsimile andlor email transmission, 2. S-AN ► 12EPL_OYMENT City must submit a reservation policy that will be kept on file with the County CERT Coordinator at the Office of Emergency Services, City must insure 24-hour seven-day-a-week access to CERT trailers. For policy and procedure for accessing or reserving a CERT trailer, refer to page 8 section 8 of the San Bernardino County Operational Area CERT Trailer Standard Operating Procedure document. 3. ffiVEN10 _REPL ffY_AN—L) I&VENTORY-,-, ENISHMENT A Safetylinventory Checklist will be available in each trailer that each user must complete when checking out a CERT trailer for use.A master Safety/Inventory Checklist can be found on page 11 of the Trailer SOP document.The Safetylinventory Checklist will allow the user to verify that the CERT trailer is fully stocked, including disposable items, and that any items used during previous CERT training have been replaced. This completed inventory checklist will be signed by the user and faxed to County©ES. Any stock used during a training session, which has been acquired from the trailer,will be replaced at user expense. When the CERT trailer has been restocked and returned to its assigned storage location, the user will fax a copy of the completed inspection checklist to County CES confirming Its readiness for redeployment. A detailed description of the CERT trailer inventory is provided in the San Bernardino County Operational Area CERT Trailer Standard Operating Procedure(see page 6, 5-A). S3 CERT 3 siol'i X:52 amt Completed Safetylinventory Checklists are to be sent quarterly to the County CERT Coordinator. Checklist to be completed by City. Check List Reports are due on February 15th, May 15th, August I Sth and November I Sth starting In February of 2008. Mailing Instructions are located at the bottom of the checklist. It is the responsibility of the user to refill the CERT fire extinguishers at user's expense before returning the CERT trailer to City. City shall be responsible for assuring that all fire extinguishers have been serviced and refilled at least once every six years. It will also be the responsibility of City to service any fire extinguishers that may lose its charge during storage. 4. TRAILER MAINTENANCE City must insure that CERT trailers are ready for deployment. Any CERT trailer deficiencies, defects or damage should be immediately reported to the County CERT Coordinator at(909) 356-3998, After hours, City should contact the San Bernardino County Confire Communications Center at(909) 356-3805. COUNTY OF SAN BERNARDINO FIRE DEPARTMENT/OES RESPONSIBILITIES: PROVISION OF CERT TRAILERS County OES will provide an enclosed cargo type CERT Trailer for deployment in each of the Emergency Management Zones (EMZ). CERT trailers will be equipped with training and emergency response materials and with equipme nt necessary for the safe deployment of a CERT trailer. City may place additional related training equipment in the CERT Trailer at their own risk. The County assumes no responsibility for equipment loss. Refer to the CERT Trailer SOP document, page 6, 5-A for a complete trailer supply inventory and a list of safety equipment. A physical description of a CERT trailer is located on page 8, section I OA, and photographs of a CERT trailer are on Page 9. 10-13 of the Trailer SOP. B. INDEMNIFICATION City(hereafter, 'INDEMNIFYING PARTY')shall indemnify, defend with counsel acceptable to the County of San Bernardino, and hold harmless the County of San Bernardino, County OES, and their officers, agents, employees, and volunteers from and against any loss, cost, damage, expense, claim. suit, DAI,Apttokl(-k,'�H 4 1 15"N S,i.,a, al. demand, or liability of any kind or character, including but not limited to, reasonable attorney fees arising from or relating to any negligent or wrongful act of omission of the INDEMNIFYING PARTY, its officers, agents, or employees, which occurs in the performance of, or otherwise in connection with this MOU, but only in proportion to and to the extent such loss, cost, damage, expense, claim, suit, demand, or liability of any kind or character, including reasonable attorney fees, is caused by or results from the negligent or wrongful act or omission of the INDEMNIFYING PARTY, its officers, agents or employees. C. TERMINATION Either Party may terminate this MOU upon thirty days written notice. Should either Party terminate this MOU, the terminating Party shall be responsible for all costs associated with termination of the MOU. The terminating Party will be responsible for returning the CERT Training Trailer to County Fire Vehicle Services. Additionally, the terminating Patty will be responsible for completing a CERT Trailer inventory check list prior to its return. D.
