This was conducted as a teleconference meeting in the City Council Chambers, Civic Center, 35 Cajon Street,
Redlands, California Mayor Pro Tempore Davis,Council Member Tejeda and Council Member
Momberger were present via teleconferencing All votes during the meetings were conducted by roll call
In compliance with public health recommendations to limit public gatherings during the Covid-19 pandemic
and acting as the City of Redlands Emergency Services Director, City Manager Charles M Duggan Jr,
directed meetings of the City Council/Successor Agency of the former Redevelopment Agency of the City of
Redlands be closed to the public until further notice or until the current local State of Emergency has been
lifted The City Council will continue to meet to conduct essential business Public comments,up to 250
words and received by 6 00 P M the day of the meeting,were read aloud by the City Clerk
Mayor Foster called the special meeting to order at 5 00 P M and a quorum was established

RECONVENE SPECIAL CITY COUNCIL MEETING
The meeting reconvened at 6 00 P M with an invocation by Council Member Barich followed by the pledge
of allegiance to the Amencan flag
CLOSED SESSION REPORT
City Attorney McHugh announced that no reportable action was taken dunng the closed session
PUBLIC COMMENT
Comments received by 6 00 P M were read into the public record at the meeting Comments related to
specific agenda items are incorporated into the item discussion
Protecting Grocery&Pharmacy Retail Workers -Ana Cabral,with the UFCW Local 1167,raised concerns
that not enough was being done to protect the grocery and pharmacy retail workers She urged for action to
protect them by adding measures such as, allowing employees to wash their hands every 30 minutes,
ensuring employers provide the proper personal protective equipment to all employees and limiting the
number of customers inside a store at any given time She urged everyone to work together so that essential
workers can continue to provide access to food,medicine and other essential supplies
Commercial Eviction Moratonum-Monika De La Paz,owner of Fleur de Lis Gift and Home,urged the
Council to revisit the moratorium voted unanimously on March 26,2020 and consider approving an
ordinance placing a moratorium on commercial evictions for failure to pay rent due to financial impacts
related to COVID-19
Public Meetings -Amanda Frye voiced concern that several agenda items for the City Council and last
night's Planning Commission were not what she considered to be essential matters before the City She
recommended meetings be postponed to the time when the public can participate more fully She also listed
a number of questions for Council to consider related to COVID-19 impacts the City is facing, including,
effects on finances,businesses,health, safety and welfare
Homelessness Health Concerns -Ed Torres,Board Member of the Center for Spiritual Living(CSL),
warned the Council to not forget the 185 Redlands residents who are without homes They can't follow
stay-at-home or shelter-in-place orders issued by Governor Newsom They don't have the ability to properly
protect themselves from acquiring the COVID-19 virus He stated the City is not acting quickly enough to
this health emergency, and he requested Council support the Loma Linda University and the University of
Redlands projects, establishing a location for the homeless to go, if they are feeling ill or demonstrating any
symptoms, so they can be examined by a health professional He urged for Council to take immediate
action

approved,by roll call vote, a Learning Partner Agreement between the City of Redlands and Columbia
Southern University Offering Discounted Degree Programs to City employees and their qualified
dependents

Work-Study Program
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote,Memorandum of Understanding between the City of Redlands and San
Bernardino Community College District to provide college student interns the opportunity to learn about
municipal government careers while providing supplemental staffing to multiple City departments

Enhancing Law Enforcement Research
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote, an agreement with Research Triangle Institute to accept the OVC Burglary
Sub-Award in the amount of$29,947 00 to be appropriated over the course of three years to the Redlands
Police Department, and approved an additional appropriation in the amount of$29,947

CAL-ID Agreement
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote, an Agreement between the City of Redlands and the County of San Bernardino for
Implementation and Operation of Identification Systems (CAL-ID) from July 1, 2020,through June 30,
2030

Transitional Housing Services
Council Member Momberger highlighted the work being done with Steps 4 Life Community Services Their
mission is to provide housing for people referred by the police department and assist the homeless transition
towards self-sufficiency and employment This benefits everyone and utilizes effective methods to empower
and motivate people, so they can take control of their own future The program has helped more than 1,071
people since the program began in 2001
On motion of Council Member Toni Momberger, seconded by Council Member Paul Banch,the City
Council unanimously approved,by roll call vote, an Agreement between the City of Redlands and Steps 4
Life Community Services for the provision of transitional housing services in an effort to address issues
associated with homelessness

Hazard Mitigation Plan
On motion of Council Member Paul Banch, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote, a Professional Services Agreement with APetrow Consulting to update the City's
Hazard Mitigation Plan The consulting services are fully funded under CalOES grant award

Professional Auditing Services
On motion of Council Member Paul Banch, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote, an Agreement for Professional Auditing Services with Eide Badly,LLP to provide
auditing services for fiscal year ending June 30,2019, at a cost of$48,960,with the option to extend to 2020
and 2021, at a cost of$49,939 and$50,938 respectively

approved,by roll call vote,Resolution No 8069, amending the Donation Acceptance Policy to allow for any

Resolution No. 8070 Extension of Time
On motion of Council Member Paul Banch, seconded by Mayor Paul Foster,the City Council unanimously
approved,by roll call vote,Resolution No 8070 to approve a one-year Extension of Time for Commission
Review and Approval No 895 and Conditional Use Permit No 1100, for the adaptive reuse of the historic
Mutual Orange Company Packing Plant to construct a multi-tenant restaurant facility known as Redlands
Food Hall located at 330 North Third Street, and determined that the project remains exempt from
environmental review pursuant to Sections 15331 and 15332 of the State's guidelines implementing the
California Environmental Quality Act

Ford Park Upper Pond Improvements
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council
unanimously determined,by roll call vote,that the project is exempt from environmental review pursuant
to Section 15301(h)of the State's Guidelines implementing the California Environmental Quality Act,
approved a Contract with Three Peaks Corp in the amount of$68,427 50 for the installation of
improvements at the upper pond in Ford Park, and approved an additional appropriation of the same

Landscape Improvements Agreement
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council
unanimously determined,by roll call vote,that approval of the contract for landscape improvements is
exempt from environmental review pursuant to Section 15304 of the State's Guidelines implementing the
California Environmental Quality Act, and approved an Agreement with Bill and Dave's Landscape
Maintenance, Inc in the amount of$68,823 25 for landscape improvements at the South West corner of
Redlands Boulevard and Ford Street

Resolution No 8068 Public Records Destruction
As public comment,Amanda Frye was opposed to destroying the encroachment permits,representing the
engineering records from Municipal Utilities and Engineering Department She added the documents
contain a great deal of historical information Council Member Barich suggested the engineering records
be turned over to Nathan Gonzales, archivist for the A K Smiley Public Library, for historical purposes
Council Member Tejeda pointed out that the staff report indicated the department will maintain an
electronic record of these documents

unanimously approved,by roll call vote,Resolution No 8068, authorizing the destruction of certain
engineering public records from Municipal Utilities and Engineering Department

Resolution No 8063 Certified Election Results
On motion of Council Member Paul Banch, seconded by Mayor Paul Foster,the City Council
unanimously approved,by roll call vote,Resolution No 8063 of the City Council of the City of Redlands
reciting the fact of the Special Municipal Election held on Tuesday,March 3,2020, and declaring that the
voters defeated Measure G It did not carry and shall not be deemed adopted and ratified

Joint Defense and Confidentiality Agreement
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council
unanimously approved,by roll call vote,the Joint Defense and Confidentiality Agreement with San
Bernardino County and the cities of Chino Hills and Rancho Cucamonga, and authorized the City Attorney
and City Manager to make any substantive changes that might later be agreed upon by the other parties to
this agreement

Resolution No. 8046 Pre-Annexation Agreement Utility Connection
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council
unanimously determined,by roll call vote,that the Pre-Annexation Agreement is exempt from
environmental review pursuant to Sections 15303(a)and 15319(b)of the State's Guidelines implementing
the California Environmental Quality Act, and approved Resolution No 8046, approving Pre-Annexation
Agreement No 19-03 for the provision of water service for the development of a single-family dwelling
on a 1 2 acre parcel located at 30765 Eastbern Lane in the unincorporated community of Mentone

Proclamation Sunday at 7 00 P M Community Support Activities
On motion of Council Member Paul Barich, seconded by Mayor Paul Foster,the City Council
unanimously approved,by roll call vote,the issuance of a Proclamation encouraging all citizens of the City
of Redlands to participate at 7 00 pm on Sunday evening,to Joyously sound a bell, chime, cymbal,pots
and pans,anger, or similar device as a symbol of the community of our citizens and a reminder to all that
although the community may be physically separated, our citizens remain united in their support for health
care workers, first responders, grocery store employees and other helpers who are caring for the people of
our community and throughout the world during the Coronavirus pandemic and honoring the victims of
COVID-19

COMMUNICATIONS
Cancellation of April 21, 2020, City Council Meeting
Mayor Foster recommended the Council cancel the Apnl 21, 2020,regular meeting of the City Council,
in light of the current State of Emergency related to COVID-19 Council Member Tejeda stated that
some of the publics'concerns about open meetings would be alleviated by canceling the second April
meeting and moving towards holding one meeting per month
On motion of Mayor Paul Foster, seconded by Council Member Paul Banch,the City Council
unanimously approved,by roll call vote,the cancellation of the April 21,2020,regular meeting of the City
Council The next regular meeting will be held on May 5, 2020

Ratification City Council Meetings Closed to the Public
City Manager Duggan,Jr explained that as the City of Redlands Emergency Services Director,he
directed City Council and Successor Agency meetings be closed to the public until further notice or
until the local State of Emergency is lifted, and he requested Council's ratification The action was taken
in compliance with public health recommendations to limit public gatherings during the Covid-19
pandemic,while also still encouraging the public to participate Public comments,up to 250 words and
received by 6 00 P M the day of the meeting,were read aloud As public comment, John Berry
expressed his opposition to exclude the public from attending City Council meetings, and he questioned
whether the City violated the Brown Act when it chose to announce the closure on a Monday night, only
one day before the regularly scheduled meeting of April 7, 2020 and not the requisite 72 hours advance
notice to the public City Attorney McHugh clarified there was no Brown Act violation and by
establishing guidelines and encouraging the public to participate in meetings,the City is in compliance
with the law and Governor Newsom's Executive Order N-29-20 for this special meeting

unanimously ratified,by roll call vote,the direction by the City of Redlands Emergency Services Director
that City Council/Successor Agency of the former Redevelopment Agency meetings be closed to the

Pavement Management Program Report
Municipal Utilities and Engineenng Director Chow presented the updated Pavement Management
Program report, as recommended by the Municipal Utilities and Public Works Commission,to utilize the
report as a guideline to prioritize and schedule maintenance and rehabilitation of City's roadway system
On motion of Mayor Paul Foster, seconded by Council Member Paul Banch,the City Council
unanimously approved,by roll call vote,the updated Pavement Management Program report(PMP 2020),
and authorized staff to utilize the report as a guideline to prioritize and schedule maintenance and
rehabilitation of City's roadway system, as recommended by the Municipal Utilities and Public Works
Commission

Ordinance No 2907 Development Project Improvement Requirements
Municipal Utilities and Engmeenng Director Chow provided background of Ordinance No 2907,
amending the Municipal Code relating to dedication and improvement requirements for non-subdivision
development projects Staff is recommending it be modified so the threshold is measured by the size of
the building expansion Seven hundred fifty square feet is a reasonable threshold as it will typically allow
for the addition of a bed and a bath or enclosure of a covered patio for residential structures and other
limited modifications to an existing residential and commercial structure
On motion of Mayor Paul Foster, seconded by Council Member Eddie Tejeda,the City Council
unanimously approved,by roll call vote,the introduction of Ordinance No 2907, amending Chapter 12 22
of the Redlands Municipal Code relating to dedication and improvement requirements for non-subdivision
development projects

Wastewater Treatment Plant Equipment Installation
Municipal Utilities and Engineering Director Chow reviewed the request to award a contract to B R
Frost Company for the Redlands Wastewater Treatment Plant Membrane Bioreactor System Equipment
Installation Project,Phase 1A He thanked Council for their support of this critical rehabilitation work
On motion of Mayor Paul Foster, seconded by Mayor Pro Tempore Denise Davis,the City Council
unanimously determined,by roll call vote,that the Project is categorically exempt from environmental
review pursuant to Section 15301 of the State's guidelines implementing the California Environmental
Quality Act, approved the Redlands Wastewater Treatment Plant Membrane Bioreactor System Equipment
Installation,Phase 1A,Project No 73348 and the associated plans and specifications, and awarded a
contract to B R Frost Company in the amount of$196,820 to perform the work

Sewer Collection System Maintenance Support
Municipal Utilities and Engineenng Director Chow presented the need for on-call sewer collection
system maintenance support as a supplement to staffs efforts
On motion of Mayor Paul Foster, seconded by Mayor Pro Tempore Denise Davis,the City Council
unanimously determined,by roll call vote,that approval of the agreement is exempt from environmental
review pursuant to section 15301(b)of the State's Guidelines implementing the California Environmental
Quality Act, approved the Agreement with Houston&Hams PCS,Inc for the provision of providing
on-call sewer collection system maintenance support in an amount not to exceed$300,000, and approved
an additional appropriation of$300,000 from the Wastewater Fund unrestricted fund balance

Sewer Collection System Repair Services
Municipal Utilities and Engineenng Director Chow introduced the agreement for on-call sewer
collection system repair services The agreement would designate Tryco General Engineering to provide
short-term immediate repair services in the event the City is unable to address all needs of the
community Director Chow responded to Council Member Banch and explained payment for services
would only occur when the need arises
On motion of Mayor Paul Foster, seconded by Council Member Eddie Tejeda,the City Council
unanimously determined,by roll call vote,that approval of the agreement is exempt from environmental
review pursuant to section 15301(b)of the State's Guidelines implementing the California Environmental
Quality Act, approved the Agreement with Tryco General Engineering for provision of On-Call Sewer
Collection System Repair Services in an amount not to exceed$500,000, and approved an additional
appropriation of$500,000 from the Wastewater Fund unrestricted fund balance

Tolling Agreement
Development Services Director Desatmk provided background of a tolling agreement related to the
processing of Lone Chang,LLC's application for a development agreement Tentative Tract Map No
16878 will expire on April 5,2020 and the applicant,has used all of its traditional available extensions
under law The applicant has filed an application to negotiate a proposed development agreement In
exchange for the City granting the applicant's map protection against changes in State or City laws, and
an additional 5 years of life,the applicant proposed to donate $10,000 to the City's cultural arts fund
City Attorney McHugh confirmed the tolling agreement, if approved,would extend the time and the
matter would be brought back to the City Council for consideration at a later time,with a more detailed
substantive report
On motion of Mayor Paul Foster, seconded by Council Member Paul Banch,the City Council
unanimously approved a tolling agreement with Lone Chang, LLC relating to the processing of Lone
Chang,LLC's application for a development agreement

Water Main Relocation Contract Award
Municipal Utilities and Engineering Director Chow reviewed a contract for the water main relocation at
Orange Street and 6th Street to facilitate the construction of San Bernardino County Transportation
Authority Redlands Passenger Rail Project He added the City is in ongoing discussions with the
contractor who performed the work originally, and staff is hopeful they will agree to perform the
realignment at no cost to the City City Attorney McHugh clarified that after the agenda was initially
posted, it was determined the contract amount should include an extra$1,000 to cover bond costs,but
that the City may never use it as we may have the original contractor coming in at no cost
On motion of Mayor Paul Foster, seconded by Council Member Paul Banch,the City Council
unanimously determined,by roll call vote,that approval of the contract award is categorically exempt
from environmental review pursuant to Section 15301 of the State's guidelines implementing the
California Environmental Quality Act, and approved the award of contract in the amount of$89,915 48 to
Borden Excavating, Inc for Orange Street and 6th Street Water Main Relocation

COUNCIL MEMBER ANNOUNCEMENTS AND ACTIVITIES
Due to COVID-19,Mayor Foster announced the Council would forgo reports and announcements

There being no further action required the meeting adjourned at 6 49 P M in memory of Lorne Poyzer,
long-time Redlands City Clerk,who served in the office from 1983 until she retired in 2009 She will be
remembered for her strong commitment to the City She played a key role in the City's operations,was
active in the community, instrumental in the success of the Redlands 4th of July event and initiated the
celebration of Veterans Day in Redlands and the raising of the POW/MIA flag on the Liberty Pole in the
1990s
With Council's approval tonight of the cancellation of the meeting scheduled for Apnl 21,2020,the next
regular meeting of the City Council will be held on May 5,2020
