HomeMy WebLinkAboutContracts & Agreements_113-2001_CCv0001.pdf Non-Financial Memorandum of Understanding(MOU) between Employment & Training Resources Center, Inc. and City of Redlands—Police Department Both parties mutually agree to the following provisions, conditions and convenants. Henceforth, the Employment & Training Resources Center- Inc. shall be referred to as the Lead Agency and the City of Redlands — Police Department, shall be referred to as the Linkage Agency. Section I—Term of Allreement A. The term of the MOU shall be from July 1. 2001 through June 30, 2002, unless terminated pursuant to general terms and conditions in Section VI. R Subsequent services shall be authorized by a written extension by authorized agents of both the Lead Agency and the Linkage Agency. Section 11—Linkage Agency Services A. The Linkage Agency shall identify eligible youth applicants who are determined to be able to benefit from the services provided by the Lead Agency. B. The Linkage Agency shall coordinate with the Lead Agency to document services provided to youth served by both Agencies. G The Linkage Agency shall cooperate with the Lead Agency for any monitoring conducted to assess the Lead Agency's ability to coordinate services with the Linkage Agency. D. The Linkage Agency shall have their staff provide information to their clients regarding programs offered by the Lead Agency, and refer appropriate youth customers to the Lead Agency to be considered for employment and training services. Section III—Lead Agency Responsibilities A. Provide orientation, written information, and all necessary technical assistance to the Linkage Agency regarding youth program implementation. B. The Lead Agency will work directly with the Linkage Agency to facilitate and document the services provided by the Linkage Agency for eligible youth. The outcomes of the Lead Agency's facilitation of coordination efforts and the gathering information, will be shared with the representative of the Linkage Agency to continually improve services to the youth. C. Provide employment and training services to eligible youth customers who are enrolled in the Youth Program funded by the Workforce Investment Act, through the County of San Bernardino. Jobs And Employment Services Department. Section IV—Joint Responsibilities A. The Lead Agency and Linkage Agency agree to protect and maintain confidentiality of all clients as specified in the provisions of WIA Section 146 (f) and Section 10850 of the Welfare and Institutions (W&I) Code and Division 19-100 of the Department of Social Services Manual of Policies and Procedures. The Lead Agency and Link-age Agency shall not discriminate against any persons on the basis of race, national origin or ancestry, religion, sex, marital status,age, political affiliation,or disability. D. The Lead Agency and Linkage Agency shall comply with all federal, state, and local laws, statutes, and ordinances and their applicable regulations. E. The Lead Agency and Linkage Agency provide excellent customer-centered services to youth customers. Section V— In-Kind Provisions A. The Linkage Agency has agreed that any services they provide eligible youth, shall be provided on an in-kind basis and at no cost to the Lead Agency, the youth contract, or the youth customer receiving the services. Section VI—General Terms And Conditions A. Insurance Requirements—Workers Compensation: The Lead Agency and Linkage Agency each agree to provide Worker's Compensation for their own employees who may provide services under this MOU, & Indemnification — The Lead Agency and Linkage Agency agrees to indemnify, defend, and hold harmless the County, the Local Workforce Investment Board, State Workforce Investment Board and its authorized officers, employees, agents, and volunteers from any all claims, actions, losses, damages, and/or liability arising out this MOU from any cause whatsoever, including the acts, errors or omissions of any person, and for any costs or expenses incurred by the County on account of any claim therefore, except where such d i in emnification is prohibited by law. C.
