The parties to this Hold Harmless Agreement are Aubrey L.
Williams and Margie R. Williams , husband and wife as joint
tenants as to an undivided one-half interest, and Bearl Leach
and Frances E. Leach, husband and wife as joint tenants as to
an undivided one-half interest, hereinafter sometimes called
"Williams" ;and the City of Red ids , hereinafter sometimes called
ffcitytf
The City agrees to construct a concrete retainer wall
approximately 12 inches high within the southerly 5 feet of the
roadway and right-of-way of Lugonia Avenue, located northerly
of and adjacent to a portion of Section 22, Township I South,
Range 3 West, SBB & M, more particularly described as follows :
Beginning at the intersection of the South right-of-way line of
Lugonia Avenue with the West right-of-way line of Ohio Street;
thence West along said South right-of-way line, 52 feet to the
True Point of Beginning; thence South 97 feet; thence West 50
feet; thence North 97 feet; thence East 50 feet to the True Point
of Beginning.
Williams agrees to hold the City harmless and to indemnify
the City from all claims , demands , liabilities , or legal actions
of J
any injury to persons or properties , including costs , loss of

services , expenses , and compensation on account of, or in any
way arising from any use, occupation , presence, activity, or
accident on or adjacent to said curb . It is expressly under-
stood and agreed that all rights under Section 1542 of the
Civil Code of the State of California are hereby waived, which
section reads as follows :
"A general release does not extend to claims which the
creditor does not know or suspect to exist in his
favor at the time of executing the release which if
known by him must have materially affected his settle-
ment with the debtor. "
This agreement shall apply and be binding upon the parties
hereto,, and their heirs , assigns , transferees , representatives ,
trustees., and all other successors in interest.
