HomeMy WebLinkAboutContracts & Agreements_9-1993_CCv0001.pdf Revised: February 17, 1993 MEMORANDUM OF UNDERSTANDING REGARDING COORDINATED PLANNING ACTIVITIES PERTAINING TO THE SANTA ANA RIVER WASH AREA This MEMORANDUM OF UNDERSTANDING (the "Memorandum") is entered into between the CITY OF REDLANDS, a general law city ("Redlands"), the CITY OF HIGHLAND, a general law city ("Highland"), the COUNTY OF SAN BERNARDINO, a charter county ("County"), the SAN BERNARDINO COUNTY FLOOD CONTROL DISTRICT, a special governmental district ("Flood Control District"), and the SAN BERNARDINO VALLEY WATER CONSERVATION DISTRICT, a special governmental district ("Conservation District"), effective as of the date on which the last party hereto executes this Memorandum. EXPLANATORY RECITALS A. Redlands and Highland share a contiguous boundary in that area of San Bernardino County known as the Santa Ana River Wash and depicted on the map attached hereto as Exhibit "A" (the "Wash"). By reason of development within their respective boundaries in the vicinity of the Wash, and because the residents and water users within Redlands and Highland satisfy a substantial portion of their beneficial water needs from groundwater captured and conserved within the Wash, Redlands and Highland each have an interest in the planning for and implementation of activities and uses within the Wash; and B. A portion of the Wash is within the unincorporated territory of the County, and the County has an interest in the planning for and implementation of activities and uses within the Wash. The County has transportation plans which inay include proposals to construct roadways over and adjacent to the Wash: and C. The Flood Control District has the primary mission of flood control and conservation of waters in the Santa Ana River Wash. The Flood Control District owns Substantial amount of properties and operates facilities in the Santa Ana River Wash. The Flood Control District is one of the local sponsors for the Corps of Engineers federally funded Seven Oaks Dam Project and the Flood Control District is responsible for managing the project features within the Santa Ana River Wash, as well as other flood control right of ways and facilities. D. The Conservation District has as its primary purpose the conservation of waters 1 of the Santa Ana River for the benefit of the residents, water users and lands within its boundaries, and owns a substantial portion of the land within the Wash. The Conservation District owns and operates water conservation and water spreading facilities within the Wash, and intends over time to develop additional conservation facilities to continue to meet the future water needs of the residents, water users and lands within the Conservation District. Many of these facilities may be developed as a result of, or pursuant to, mining and reclamation on Conservation District lands within the Wash; and E. The parties mutually desire to enter into this Memorandum and to create an advisory committee to review and offer recommendations regarding proposed activities within and affecting the Wash, and to facilitate coordinated planning of private and governmental activities within the Wash. NOW THEREFORE, Redlands, Highland, the County, the Flood Control District and the Conservation District agree as follows: 1. Creation and Membership of Committee. There is hereby created the Santa Ana River Wash Coordinating Committee(the "Committee") for the purpose of facilitating coordinated planning of activities within the Wash. Unless expanded in accordance with Paragraph 7 below, the Committee shall be composed of ten voting members. Each party shall, within thirty days of the effective date of this Memorandum, designate two persons to serve as that party's representatives on the Committee; and each party may designate additional persons to serve as alternate representatives in the event that the designated representatives are unable to attend a Committee meeting. 2. Internal Organization of Committee. Committee meetings shall be held once a month, or at such other times as a majority of the members of the Committee may determine. 2.1 The Committee shall elect a chairperson by majority vote at the first meeting and, thereafter, the position of chair shall rotate annually among all of the parties in the order they are listed in the opening statement of this Memorandum. Unless otherwise agreed by a majority of the members of the Committee, Committee meetings shall be conducted at the office of the party then serving as the chair of the Committee. 2.2 The party chairing the Committee shall be responsible for preparing and transmitting to the other parties agendas and minutes of Committee meetings; provided, however, that any member of the Committee may, by written request to the party chairing the Committee, place a matter on an agenda for consideration by the Committee. The party chairing the Committee shall select one of its representative to preside over the Committee meetings, and such member shall be entitled to vote on all Committee matters. 2.3 Six members present at a Committee meeting shall constitute a quorum for the transaction of business by the Committee. Except as otherwise specified herein, any action of the Committee shall require the unanimous vote of all members (or their alternates) in attendance at the meeting. 3. Advisory Nature of the Committee. The Committee shall have no ultimate administrative, legislative or adjudicative powers, and shall have no power to bind any of the parties to this Memorandum; but the Committee may both provide recommendations to the parties and other public and private entities on matters pertaining, to the Wash, and facilitate coordination of planning, efforts relating to Wash activities. The Committee shall have no independent staff or budget; any staff or financial resources required by the Committee may be provided voluntarily by one or more of the parties. 4. Purpose of the Committee. The purpose of the Committee may include, but shall not be limited to, the following: (a) Review of general plan designations and zoning and building regulations adopted by Redlands, Highland and the County with respect to the Wash, and evaluation of the compatibility and consistency of land use regulations within the Wash. (b) Review and evaluation of current and proposed sand and gravel excavation operations and activities within the Wash, including such operations and activities within land owned by the Conservation District and other lands. (c) Review and evaluate proposals to construct highways and regional and local roadways across or in the vicinity of the Wash. (d) Review and evaluate proposals for flood control facilities within, or which would impact, the Wash. (e) Review and evaluate Current and future proposals for the management of the endangered flora species known as the Woolly Star and the Spineflower, and other sensitive, candidate and endangered plant and animal species that are resident within the Wash. (f) Review and evaluate documentation prepared under the California Environmental Quality Act, Public Resources Code Section 211000, et 5M. ("CEQA") pertaining 3 to activities within or which may impact the Wash, and facilitate coordination of CEQA documentation and activities pertaining to matters affecting the Wash. (g) Review and evaluate plans, permits, and supporting documentation prepared under the Surface Mining and Reclamation Act, Public Resources Code Section 2710, et sec . ("SMARA") pertaining to existing and proposed mining and mineral extraction activities within or which may impact the Wash; and facilitate coordination of SMARA processing with respect to proposed mining and mineral extraction activities within the Wash. (h) Review, evaluate and facilitate coordination of any existing or proposed groundwater cleanup or other groundwater quality remedial programs that affect, or be affected by, water conservation activities within the Wash. (i) Review, evaluate and facilitate coordination of proposed programs within the Wash to replenish or recharge local groundwater supplies. 5. No Liability. No party shall be liable for any act or omission of anv other party hereto. 6. Notices. Any notice, instrument or other writing required to be given or delivered by this Memorandum shall be given or delivered by personal delivery or by depositing the same in any United States mail depository, first class postage prepaid, and addressed as follows: If to Redlands: City of Redlands P.O. Upon the written approval of Redlands, Highland, the County, the Flood Control District, and the Conservation District, the membership of the Committee may be expanded to include other public entities. Any entity so included on the Committee shall select representatives in the manner set forth in Paragraph 1 above, and shall otherwise have all of the rights and obligations of a member of the Committee. 8. Withdrawal and Termination. Any party may withdraw from the Committee by written notice to all of the remaining parties. Unless otherwise agreed in writing, this Memorandum and the Committee shall continue so long as two or more parties desire to maintain the Committee. 9. Amendment to the Memorandum. This Memorandum may be amended by written instrument duly executed on behalf of each of the parties to this Memorandum. The area is owned by the San Bernardino Valley Water Conservation District, Bureau of Land Management, the Flood Control District and some private holdings. This memorandum will create a ten person advisory committee composed of two members from the City of Redlands, City of Highland, County of San Bernardino, San Bernardino County Flood Control District and the San Bernardino Valley Water Conservation District. The committee will review and offer recommendations regarding proposed private and governmental activities within the wash. REASON FOR RECONBIENDATION: Board approval is required for the District to enter into the MOU. REVIEW BY OTHERS: This item was reviewed by the Third District Supervisorial Staff on March 2, 1993, Risk Management on March 3, 1993 and Deputy County Counsel Charles S. Scolastico on March 4, 1993.
