We, the Joint Citizens Council Committee and Tri-City Aggregates,
ine., agree in principal to the concepts contained in the Tri-City
Aggregates, Inc. 72 Conditions of Approval, dated March 21, 1989.
The Committee has met on numerous occasions with Tri-City Aggre-
gates, Inc. representatives in arriving at these mitigations.
However, we would like to emphasize the following essential items.
1. Tri-City Aggregates, Inc. agrees to apply for a permit
for location of the processing plant in the West Plunge
Creek Basin with the City of Highland. The Committee
encourages the two City Councils to allow Tri-City Ag-
gregates to process material from Webster Quarry in the
East Plunge Creek Basin until the West Basin permit is
approved and built. The Committee encourages the two
City Councils to allow Tri-City temporary access to the
East Basin by using Mill Street and Orange Street to
the East Basin. Any new processing plant east of Tennes-
see is totally unacceptable to the Committee.
2. Mining and processing operations within the Santa Ana
River Wash shall be limited to the hours of 5:00 a.m.
to 10:00 p.m. , Monday through Friday, and 6:00 a.m.
to 6:00 p.m. , Saturday.
3. Tri-City Aggregates, Inc. agrees not to protest Annex-
ation No. 69 by the City of Redlands, conditioned on the
City of Redlands adopting a policy of fully supporting
mineral extraction in the upper Santa Ana River Wash.
4. It is imperative that a Resource Management Master
Plan be prepared covering all aspects of the wash in-
cluding cumulative impacts, recreation, water conserva-
tion and environment. The applicant agrees to abide by
the Plan and fund a fair share of any cost related to
the Plan as determined by the lead agency.
5. The Committee encourages the two City Councils to work
together to form a joint powers agreement as quickly
as possible to oversee all activities in the to Ana
River Wash.
6. It is imperative that a wash haul route to the Tennessee
Freeway be in place to eliminate truck traffic from
local streets. All parties will make a good faith effort
to complete this in a timely manner.
7. Tri-City Aggregates agrees to limit their processing of
Webster Quarry and East Basin materials to two million
tons annually.

8. Applicant shall cooperate with a joint powers agency
or similar entity established by the Cities of Highland
and Redlands to regulate and control the areas in which
the project is situated and insure compliance with any
rules and regulations established by said entity.
9. In the event the Cities of Highland and Redlands re-
ceive any complaint regarding applicant' s compliance
with these Conditions of Approval, applicant shall
respond and resolve the complaint to the satisfaction
of the City Tanager. The applicant, upon written notice
from the City Manager where complaint is received, shall
respond within 14 working days. In the event the com-
plaint is not resolved, or the applicant does not comply
with instructions regarding resolution of complaint, site
approval shall be reviewed.
10. The Cities of Highland and Redlands will require and
document that existing operations in the wash be held
in compliance with the permits before approving any
new permits or modifications for mining or processing
(long term lease, etc. ) .
11. The Committee implores the Cities of Highland and Redlands
to put the County on notice that they intend to force
compliance with existing permits. Before approving any
applications for mining, applicants should be forced to
comply with existing permits.
12. The Committee and Tri-City Aggregates, Inc. agree to
noise, dust and wind monitoring.
13. Once the processing plant permit is issued by the City
of Highland the existing Plunge Creek plant will not be
in service beyond three years.
