HomeMy WebLinkAboutContracts & Agreements_4-2004_CCv0001.pdf FIRST AMENDMENT TO AGREEMENT TO FURNISH ENVIRONMENTAL ANALYSES This First Amendment to Agreement is made and entered into this 6th day of January 2004, by and between the City of Redlands,a municipal corporation("City")and Michael'Brandman Associates ("Consultant"). RECITALS WHEREAS, on August 5., 2003, the City and Consultant entered into an agreement entitled "Agreement for the Provision of Professional Environmental Consulting Services" (the "Agreement") which described the scope of work which Consultant would undertake for City for the total compensation of$127,000 in connection with the necessary environmental review for General Plan Amendment No.93,Agricultural Preserve Removal No. 100,Zone Change No.390,and Tentative Tract No. 16361, and WHEREAS, the City has also determined that additional work is required to amend the Scope of Work for the Environmental Impact Report(EIR) to incorporate more detailed work with regard to Geotechnical Investigations,Traffic Analysis,Cultural Resources and other expanded EIR discussions. NOW, THEREFORE, in consideration of the mutual promises contained herein, the City of Redlands and Michael Brandman and Associates hereby agree as follows: Section 1. Section 4.2 of the Agreement is hereby amended to increase the compensation to be paid by City to Consultant by the amount of$29,060.00 for a total compensation of$156,060 including the amount expended in the original contract approved August 5, 2003. Section 2, Exhibit "A" of the Agreement which describes the extent of Consultant's Services is hereby amended to include revisions to the EIR to reflect the revisions, the details of which are attached hereto as Exhibit "A". Box 35 Redlands, California 92324 Subject: Request for Amendment to Michael Brandman Associates' contract with the City of Redlands for the preparation of an EIR for TT 16361 Dear Richard: Michael Brandman associates (,MBA.) is requesting a contract amendment to provide additional services that are not included within the existing scope of work and budget agreement for the subject EIR. RIBA met with City staff and the project applicant on Monday, November 17, and during the course of that meeting, it was agreed that additional research and analyses are warranted to address important concerns raised in the peer review reports, to provide additional details concerning the proposed project, and to address responses to the Notice of Preparation of a Draft EIR. This letter describes the additional work and costs, totaling$29,064. A. Geotechnical Investigations $11,400 Earth Consultant's International ,ECI) will provide oversight of additional geological investigations and will conduct additional professional peer review of further geotechnical analysis to be completed by the applicant's consultant, as follows. I. Neblett and Associates (Neblett) is expected to address the items identified in ECI's peer review by a written response, including supplemental information, with the exception of fault investigations which will be addressed by supplemental trenching and supplemental fault investigation reports. ECI will review Neblett's response, and prepare a letter report indicating whether the response is sufficient to address the issues raised in SCI's peer review. 2. ECI will meet with N&A representative to identify potential trenching locations at the site. The trenching locations will be selected to help answer questions regarding the lineaments previously mapped through the site b� Matti et al. (1992), plus another lineament through the central portion of the site. One day of fieldwork is budgeted for this task. .Mr. Richard Nfalacofff,AICP December 5,2003 Page 2 I ECI will review the supplemental fault trenches after they have been excavated, cleaned and logged by N&A's geologists. Two days of fieldwork have been budgeted for this task If faults of concern are identified in these supplemental fault trenches, additional work may be required to trace the faults through the site, beyond the work covered here. 4. ECI -,will review the supplemental fault trenching report prepared and submitted by N&A and prepare a written response. 5. Six hours of time for meetings or phone conferences have been budged by,ECI, B. Supplement to Traffic Impact Analysis $12,210 Using the information from the Kunzman Associates' report to the extent possible, Kimley-Horn and Associates (1<11A) will perform the following additional analyses: 1. Review City of Redlands policies, specifically Measure U, which pertains to traffic volumes and impacts on residential streets (non-arterial streets). Make traffic counts, for a 2l-ht-hr period on one weekday-, at six locations on residential streets in the area: a) Highview Drive cast of Canyon Drive; b) Flighviev.,Drive east of Avenue c) Kendall Way between Highview Drive and Florida Street; d) Avenue N between Fhgh%-ie%,-Drive and Florida Street; e) Florida Street east of Alta Vista Drive; and f', Florida Street west of l7t-Street. 3. Make traffic counts at seven intersections in the area during peak traffic periods (7:00 to 9:00 AM and 4:00 to 6:00 PM on one weekday): al) Alta Vista Drive/Sunset Drive; b", Alta,�'ista Drive/South lane. cl Alta Visrta drive/Florida street; d) Florida Street//Avenue N; e) Florida street/17th Street. f) Flighvie,,v Drive/Kendall Wav;and g) Highview Dnve/Avenue N. 4. Estimate the amount of daily and peak hourlx traffic the proposed project would place at the six street locations and the seven intersections listed above. S. Calculate the increase in daily and peak hourly traffic at each of the six street locations and the seven intersections due to the addition of the proposed project. 6. Evaluate how much travel times and delay at intersections would be affected by the addition of traffic for the Covington Tract. Assess whether the impacts of the additional traffic would be considered significant using technical criteria and Measure U policies, taking into consideration the proposed reclassification of Highview Drive to a Rural Collector street. It is understood that the reclassification of Highriew Drive to Rural Collector Street classification will not entail any physical changes to the existing road: By making selective Feld measurements, verify if Highview Drive meets the street width and parkway criteria set forth in the Citv's "Development Standards for Rural Areas." Indicate the instances, if ant, where existing conditions do not meet the Cin-'s criteria. 9. Evaluate neighborhood traffic impacts assuming that the Covington Tract would have full access gather than emergency only) via Freya Drive. 10. Prepare a technical memorandum to document the data and analyses. 11. Kunzman and Associates is expected to-address items D1. and D2 as identified in the (KHA) peer review by a written response including supplemental information. KHA will review the Kunzman's response, and prepare a letter report indicating whether the response is sufficient to address the issues raised in KH's peer review. C. Native American Consultation $2,000 MBA will consult with the Native American Heritage Commission and the hlalkki Museum to request input concerning potential presence of Native American prehistoric resources and/or sacred sites. This will involve written and verbal correspondence, including distribution of the existing cultural resource reports and MBA's peer review comments. The budget for this task also covers attendance at one meeting at the project site with selected tribal representatives and City staff D. Expanded EIR Discussion $1,550 Fuel Modification Zones (5350) MBA %will expand the project description to further describe the fuel modification requirements, including an exhibit identifring the `footprints'of the fuel modification zones. Water Supply Issues (51,200) NfBA will expand the project description and utility sections of the EIR to include discussion of water supply issues. The discussion uxill be based on a letter to be prepared by John Egan, the Water District's consultant, and is expected to address how the new tank, distribution lines and other pressure boosting, looping, etc. improvements wi' benefit the community•with respect to reliability of supp!N,'storage, distribution, long-term maintenance, and fire flows. Septic System MBA will expand the project description to further describe the proposed private septic tank system, and also discuss this issue in the Geology section of the EIR. It is assumed that the applicant will provide MBA with a complete description of the proposed septic tank system, including tank and pipeline materials and sizing;location parameters, safeguards against leaks, maintenance requirements, etc. E. Project Management $2,000 Additional, project management time is needed to coordinate and supervise the above efforts including coordinatig with subcontractors, subcontractor agreement amendments, and direction to in-house staff, and Mr. Richard hlalacoff,MCP December 5,2003 Page 4 an additional meeting with the Citi_- and Applicant to resolve any issues raised by the second round of peer review. F.
