HomeMy WebLinkAboutContracts & Agreements_196-2004_CCv0001.pdf SECOND AMENDMENT TO AGREEMENT TO FURNISH ENVIRONMENTAL ANALYSES This Second Amendment to Agreement is made and entered into this 21st day of December 2004, by and between the City of Redlands, a municipal corporation ("City") and Michael Brandman Associates ("Consultant"). RECITALS WHEREAS, on August 5, 2003, the City and Consultant entered into an agreement entitled "Agreement for the Provision of Professional Environmental Consulting Services" (the "Agreement") which described the scope of work which Consultant would undertake for City for the total compensation of$127,000 in connection with the necessary environmental review for General Plan Amendment No. 93, Agricultural Preserve Removal No. 100,Zone Change No. 390, and Tentative Tract No. 16361, and WHEREAS, on January 6, 2004, the City and Consultant amended the Agreement is to increase the compensation to be paid by City to Consultant by the amount of$29,060.00 for a total compensation of$156,060, and WHEREAS, the City has determined that additional work is required to amend the Scope of Work for the Environmental Impact Report(EIR) to incorporate more detailed work with regard to Geotechnical Investigations, expanded EIR discussions, and associated project management. NOW, THEREFORE, in consideration of the mutual promises contained herein,the City of Redlands and Michael Brandman and Associates hereby agree as follows: Section 1, Section 4.2 of the Agreement is hereby amended to increase the compensation to be paid by City to Consultant by the amount of $15,500.00 for a total compensation of $171,560.00 including the amount expended in the original contract approved August 5, 2003, and amended January 6, 2004. Section 2. Exhibit "A" of the Agreement which describes the extent of Consultant's Services is hereby amended to include revisions to the EIR to reflect the revisions, the details of which are attached hereto as Exhibit"A". MBA is requesting a contract amendment to address an additional level of work effort needed to support the environmental review, as further described below. This letter outlines the additional work and costs, totaling$15,500. MBA requests approval of these additional expenses and work in a timely fashion so as not to delay the continued processing of environmental documents. Basis for Augment Resolution of Geotechnical Issues(Administrative Draft EIR) MBA's first augment, among other items, addressed the need for additional geologic investigation following peer review of Neblett and Associates work by Earth Consultant's International (ECI). The expectation consistent with the revised scope of work was that Neblett would address ECI's concerns and that the geotechnical issues would be resolved. However, Neblett's initial responses largely dismissed ECI's concerns, indicated that the work they had done was appropriate, and lacked appropriate documentation needed to alleviate the geologic (faulting) and geotechnical (slope stability, etc.) concerns raised by ECI and make an environmental determination under CEQA. MBA requested another meeting with the City to determine the additional work and documentation that would be necessary to properly disclose, document and evaluate geologic and geotechnical impacts under CEQA. MBA coordinated the additional work with Neblett and ECI. The resulting work product included seven reports from Neblett and four documents from ECI. The anticipated level of documentation following the first augment was four reports from Neblett and two review and other support documentation from ECI. Accordingly, MBA needed to review and discern a greater volume of complex documentation in order to develop the Geology Section of the EIR. Project Management Resolution of geotechnical issues has extended the project schedule by approximately six months, extending the amount of time required for monthly project management (billing, workload forecasting, etc), and more involved maintenance of the project schedule. This also extended the administrative management of ECI's work by MBA. Project management involves approximately 10 hours per month �?a $105/hour. Accordingly, an augment is requested for$6,000 to cover this additional level of effort. Direct Costs An additional direct costs budget is recommended to cover additional copying and postage/delivery fees associated with a larger technical appendix. This will also provide a sufficient allowance to provide 5 copies of all documents for the applicant's team. An additional budget of$3,000 is recommended. Only expenses actually incurred will be billed.
