A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING ITS INTENTION TO VACATE EXCESS PUBLIC SIDEWALK
RIGHT-OF-WAY ON THE PROPERTY LOCATED AT 1765 WEST
LUGONIA AVENUE
WHEREAS, Mr Prakash Bhakta, the owner of the property located at 1765 West
Lugonia Avenue, has submitted an application requesting vacation of excess public sidewalk
right-of-way that is eight (8) feet in width and approximately two hundred (200) feet in length on
the property located at 1765 West Lugonia Avenue (APN 0292-341-22-0000), located north of
the intersection of Plum Lane and Idaho Street, and on the south side of W Lugonia Avenue„
and
WHEREAS, the City is authorized to vacate all or part of a public street pursuant to
California Streets and Highway Code Section 8300 et seq , and
WHEREAS, pursuant to Section 8340 of the California Streets and Highway Code, the
City may, for public convenience and necessity, reserve and except public service easements
from a street vacation, and
WHEREAS, at its meeting on April 14, 2020, the City's Planning Commission made a
determination that the proposed street vacation will conform to the City's General Plan, and
WHEREAS, the proposed street vacation qualifies for an exemption from environmental
review in accordance with the California Environmental Quality Act ("CEQA") pursuant to
Section 15061(b)(3) of the State CEQA Guidelines for projects where it can be seen with
certainty there is no possibility of any significant environmental effects, and
WHEREAS, the City Council intends to vacate the excess right-of-way, as more
particularly described m Exhibits "A" and "B" to this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF REDLANDS AS FOLLOWS
Section 1 The City Council of the City of Redlands hereby declares its intention to
vacate the excess eight (8) foot wide public sidewalk right-of-way located on 1765 West Lugoma
Avenue described in Exhibits "A" and "B," which are attached hereto and incorporated herein by
reference
Section 2 The proposed street vacation of the excess, eight (8) foot wide, public
sidewalk right-of-way located on 1765 West Lugoma Avenue is exempt from environmental
review in accordance with Section 15061(b)(3) of the State CEQA Guidelines because this City
Council can see with certainty, based upon the testimony provided m the staff report, that
approval of the street vacation will have no physical effect on the environment

Section 3 The City Council will conduct a public hearing on the proposed street
vacation at a regularly scheduled meetmg of the City Council on September 1st, 2020, beginning
at 6.00 p m , or as soon thereafter as the matter may be heard, to be held in the City Council
Chambers located at 35 Cajon Street, Suite 2, Redlands, California 92373
Section 4 The City Clerk shall give notice of the public hearing on the public
hearing on the proposed vacation by
A Publishing notice m the Redlands Daily Facts, for two successive weeks prior to the
hearing, and
B Posting notices of the proposed street vacation conspicuously at the location of the
excess eight (8) foot wide sidewalk right-of-way at 1765 West Lugonia Avenue to be
vacated at least two weeks prior to the date set for the public hearing The notice shall
be posted no more than three hundred (300) feet apart, and at least three such notices
shall be posted The notice shall reference the adoption of this Resolution of Intention
and shall state the date, time, and place of the street vacation hearing
